For Meeting of: June 7, 2016 ITEM TITLE: Closed record public hearing and ordinance reflecting the Hearing Examiner's recommendation on a proposal by Brian Griff and Larry Loveless to rezone nine parcels in the vicinity of S 80th Ave & Tieton Dr. from Single - Family residential (R -1) to Two - Family residential (R -2) zone SUBMITTED BY: Joan Davenport, AICP Community Development Director Trevor Martin, Associate Planner (509) 575 -6162 SUMMARY EXPLANATION: On January 4, 2016, Brian Griff and Larry Loveless submitted an application for a Rezone of Tax Parcel Numbers: 181329- 22461, 181329- 22462, 181330- 11424, 181330- 11425, 181330- 11426, 181330- 11427, 181330 - 11428, 181330- 11429, and 181330 -11430 from R -1 to R -2 zoning. This is a project based rezone consisting of approximately 2.14 acres. These lots encompass the southwest corner of the intersection of Tieton Drive and South 80th Avenue. Duplexes have been built on four of the existing lots while single family homes occupy the other three lots. Two existing lots remain vacant, and are the lots in which two new duplexes will be constructed provided the City Council approves the Hearing Examiner's recommendation. The vacant lots are adjacent to and between duplexes. The surrounding area includes single family housing, duplexes across Tieton Dr. (at 8101 Tieton Drive and in an R -2 zoned area at 401 -405, and 407 S. 81 stAve.) and an 18 acre R -3 zoned mobile home park located at 8301 Tieton Drive. Two to four blocks to the south are a multitude of duplexes that have been built off Midvale and Westbrook Avenue. A public hearing was held on March 24, 2016 and the Hearing Examiner issued his recommendation of approval on April 7, 2016. ATTACHMENTS: Description Upload Date D Proposed Ordinance —Griff -Lo vel ass Rezone 512612016 D Complete Record —Griff -Lo veless Rezone 5126/2016 Type Ordinance Backup Material ORDINANCE NO. 2016- AN ORDINANCE concerning land use regulation, planning, and rezoning of nine parcels of property located in the vicinity of South 80th Ave. and Tieton Dr. from Single - Family Residential (R -1) to Two - Family Residential (R -2), and consider approving the recommendation of the Hearing Examiner WHEREAS, pursuant to YMC 6.88, the State Environmental Policy Act (SEPA) Administrative Official issued a Determination of Nonsignificance for the rezone request in accordance with WAC 197 -11 -355, as required under SEPA; and WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on April 7, 2016, (the "recommendation "), recommending that the City approve the rezoning of nine parcels of property as more fully described herein; and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ( "YMC ") § 15.23.030(D) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following parcels of property located in the vicinity of South 80th Ave. and Tieton Dr. shall be, and the same hereby are, rezoned from Single - Family Residential (R -1) to Two - Family Residential (R -2): Tax parcel numbers: 181329 - 22461; 181329 - 22462; 181330 - 11424; 181330 - 11425; 181330 - 11426; 181330 - 11427; 181330- 11428; 181330 - 11429; and 181330 - 11430. Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of said property. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated April 7, 2016, are hereby adopted by the City Council as its findings in support hereof pursuant to YMC § 15.23.030(E), and are incorporated herein by this reference as if fully set forth herein. Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
