For Meeting of: June 7, 2016 ITEM TITLE: Ordinance repealing Yakima Municipal Code Chapter 11.58 Flood Damage Prevention, to address required changes by the Federal Emergency Management Agency SUBMITTED BY: Joan Davenport, AICP, Community Development Director/ Planning Manager Jeff Peters, Supervising Planner (509) 575 -6163 SUMMARY EXPLANATION: On May 6, 2016, the Washington State Department of Ecology's Floodplain Management division notified the City of Yakima of a conflict between the provisions of it's ordinances YMC Ch. 11.58 Flood Damage Prevention and 15.27 Critical Areas, and the potential of being removed from the National Flood Insurance Program. As a result of the new information, the City of Yakima's Community Development Department reviewed both ordinances and found that there is no further benefit from retaining YMC Ch.11.58 as all provisions and regulations were incorporated into YMC Ch. 15.27. No. 2560 § 1 (part), 1981) to address required changes by the Federal Emergency Management Agency (FEMA). WHEREAS, the Yakima City Council passed Ordinance No. 2560 on November 3, 1981, adopting the City's Flood Damage Prevention Ordinance (YMC Ch. 11.58); and WHEREAS, On September 2, 2008, the City of Yakima adopted YMC Ch. 15.27 Critical Areas, both incorporating and updating the regulatory standards of Ch. 11.58; and WHEREAS, On May 6, 2016, the Washington State Department of Ecology's Floodplain Management division notified the City of Yakima of a conflict between the provisions of ordinances YMC Ch. 11.58 Flood Damage Prevention and 15.27 Critical Areas, and the potential of being removed from the National Flood Insurance Program; and WHEREAS, the Washington State Department of Ecology's Flood Management division recommended the City repeal the entirety of YMC Ch. 11.58; and WHEREAS, the City of Yakima finds no further benefit from retaining the provisions of YMC Ch. 11.58, having been fully and completely incorporated into YMC Ch. 15.27; and WHEREAS, the City Council of the City of Yakima, hereby finds and determines that it is in the best interest of the residents of the City of Yakima to remain compliant with the National Flood Insurance Program, and repeal Ordinance No. 2560 which adopted YMC Ch. 11.58, which promotes the general health, safety and welfare of the residents of Yakima; therefore BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Repealer. Ord. No. 2560 § 1 (part), 1981, the YMC Ch. 11.58 Flood Damage Prevention Ordinance, is hereby REPEALED. Section 2. Authorization to File. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 3. Effective Date. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
