The illegal fence is currently constructed 18 feet into the right -of -way. The only comment from Development Services Team from the Water Division, is that the water meter was behind the fence and that access to the water meter must be maintained. Doug Maples, Code Administration and Planning Manager has reviewed the application and recommended that Council deny the Right of Way Use Permit and the fence would have to be placed on or behind the property line. 0 Mr. Trino Rivera, applicant, was notified of the decision and asked why the fence needed to be placed at this location. Mr. Rivera stated that he wanted to give his renters a yard that is fenced in because there is no room in the rear. From the supplied aerial photo, you can see additional yard all the way back to the alley.
