CITY OF YAKIMA AND IAFF LOCAL 469
THIS MEMORANDUM OF UNDERSTANDING (MOU) is made and entered into by
and between Local 469, International Association of Firefighters, AFL -CIO, representing
all unionized employees of the City of Yakima Communications Center (hereinafter
"Union ") and the City of Yakima, a Washington municipal corporation (hereinafter
"City ").
WHEREAS, the City desires to treat all new employees in the 911 Call Center similarly
in terms of sick leave balance on the first day of employment.
WHEREAS, the City and the Union have engaged in negotiations on the terms and
conditions of extending up -front sick leave balances to new employees in Dispatcher and
Lead Dispatcher positions.
WHEREAS, the City and the Union agree on the following terms and conditions, which
shall apply to all employees of the City of Yakima Communications Center represented
by the Union.
NOW, THEREFORE, it is agreed by and between the City and the Union as
follows:
Effective December 1, 2007, each newly hired permanent employee of the
Communications Division shall receive 96 hours of sick leave on their first day of
employment, subject to the following restrictions:
1. For permanent part -time employees, sick leave shall be prorated to the
percentage of a full -time position budgeted for that person.
Example: An employee that is hired for a permanent part-time position
budgeted at 75% of a full -time position shall receive 75% or 72 hours of
sick leave on the first day of employment.
2. No additional sick leave will be accrued during the employee's first year of
employment.
3. Should the employee either voluntarily or involuntarily terminate employment
during the first year and have used sick leave greater than eight hours per month
while employed, the hours exceeding eight hours per month shall be deducted
from the employee's accrued paid leave balance (i.e. vacation, compensatory
time, etc.)
Example: An employee terminates at the end of two full months of
employment and has used 24 hours of sick leave. The employee has used 8
more hours than the normal accrual for a 2 -month period. Therefore, 8
hours will be deducted from the employee's other accrued paid leave
balance such as vacation, comp time, in lieu, etc. prior to any cash out for
those accruals.
This MOU is in effect as of the date signed and shall have no retroactive application.
