RESOLUTION NO. R-2016-036
authorizing the City Manager to modify an existing grant agreement
with Washington State Department of Transportation to fund fixed -
route buses.
WHEREAS, the City of Yakima applied for funding from the State of Washington to
replace seven buses; and,
WHEREAS, WSDOT has awarded funding to the City of Yakima for the fixed -route
bus replacement; and,
WHEREAS, in order to receive funding for these programs, it is necessary for the City
and the WSDOT to enter into an agreement setting forth the terms, conditions, and
requirements to fund the programs; and,
WHEREAS, funding has been awarded already under a federal 5339 grant that passes
through the State of Washington. It has been determined to be in the best interest of both
parties to modify grant agreement GCB1853, which currently provides $400,000 in funding
for three 30 -foot fixed -route buses and modify it to $400,000 for two 40 -foot fixed -route
buses, and to include the Washington State Tier1 funding ($2,000,000) to fund the
purchase of five fixed -route buses (one 40 -foot fixed -route bus and four 35 -foot fixed -route
buses); now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to modify Grant Agreement GCB1853 with
Washington State Department of Transportation from three 30 -foot fixed -route buses to
seven fixed -route buses (three 40 -foot buses & four 35 -foot buses) and the associated
funding levels.

The FIRST AMENDMENT to AGREEMENT GCB 1853 entered into between the Washington
State Department of Transportation (hereinafter referred to as "WSDOT"), and Yakima Transit
(hereinafter referred to as "CONTRACTOR"), and/or individually referred to as the "PARTY"
and collectively referred to as the "PARTIES,"
RECITALS
WHEREAS, the State of Washington in its Sessions Laws of 2015, Chapter 43, Section 207,
subsection (2), (3), (4) and (7), added new revenue funds for Paratransit/Special Needs,
Paratransit/Special Needs Non-profit, Regional Mobility and other proviso funding through the
multimodal transportation account, rural mobility grant program account, and regional mobility
program account, as identified in the budget through its 2015-2017 biennial appropriations to
WSDOT;
WHEREAS, WSDOT's Public Transportation Division administers the multimodal
transportation account funds to provide assistance solely for transportation projects as identified
in LEAP Transportation Document 2015 NL -3, as developed June 28, 2015;
WHEREAS, both PARTIES agree to amend AGREEMENT GCB 1853 to add $2,000,000 in
State multimodal funds awarded under the Tier Program to Project A for the purchase of four (4)
35ft buses and one (1) 40ft .transit buses;
WHEREAS, both PARTIES agree to amend AGREEMENT GCB 1853 to modify the Scope of
Work by reducing the number of buses funded with FTA 5339 from three (3) 30ft buses to two
(2) 40ft buses to increase passenger capacity; and
WHEREAS, both PARTIES agree to amend AGREEMENT GCB 1853 to add the Project
Identification Number (PIN), G200027, in the Project Title caption space in the agreement's
header for project tracking purposes.
NOW THEREFORE, the following AMENDMENTS are hereby incorporated into
AGREEMENT GCB 1853:

2. Amend the Caption Heading, "Project Title:" to read as follows:

5. Amend the current language set forth in Exhibit I, Funding by Project: Project A to read as
follows:

Budget: Funding and percentages identified reflects total project funds for 2013-2017. Capital
funding allocations are for the purchase of the Project Equipment specified. Upon completion of
the purchase, any funds remaining will be retained by WSDOT for other transportation projects.
6. A copy of this AMENDMENT to the AGREEMENT shall be attached to and made a part of
the original AGREEMENT. Any references to the "AGREEMENT" shall mean
"AGREEMENT as amended."

7. All other terms and conditions of the original AGREEMENT not hereby amended shall
remain in full force and effect. This document may be simultaneously executed in several
counterparts, each of which shall be deemed original having identical legal effect.

Resolution authorizing the amendment to an existing grant
agreement with Washington State Department of Transportation to
fund fixed -route buses

SUMMARY EXPLANATION:
This resolution amends the existing Grant Agreement GCB1853 from funding three fixed -route
buses (three 30 -foot buses) to funding seven fixed -route buses (three 40 -foot buses and four 35 -
foot buses).
Yakima Transit operates 19 of its 25 buses to provide vital transit services to our citizens. Several
buses are well past their useful life. The grant funds will assist Yakima Transit in its commitment in
replacing the aging fleet and reducing expensive repair costs.
Funding was previously awarded to the City of Yakima under a federal 5339 grant through the
State of Washington as Grant Agreement GCB1853. It is in the best interest of the City of
Yakima and the Washington State Department of Transportation to amend Grant Agreement
GCB1853, which currently provides $400,000 in funding for the purchase of three 30 -foot fixed -
route buses; amending it to allow for the purchase of two 40 -foot fixed -route buses to increase
passenger capacity. In addition, the amendment to Grant Agreement GCB1853 will include the
Washington State Tier1 funding of $2,000,000 secured by Senator Curtis King through the
State's Transportation Committee, for the City of Yakima to fund the purchase of five additional
fixed -route buses (one 40 -foot fixed -route bus and four 35 -foot fixed -route buses).
All seven buses have been ordered. The first order of three 40 -foot buses is anticipated to arrive
in March 2016 and the second order, consisting of four 35 -foot buses, is anticipated to arrive in
March 2017. Both the amended and original Grant Agreement GCB1853 have been enclosed for
City Council review.

The SECOND AMENDMENT to AGREEMENT GCB1853 entered into between the
Washington State Department of Transportation (hereinafter referred to as "WSDOT"), and
Yakima Transit (hereinafter referred to as "CONTRACTOR"), and/or individually referred to as
