HomeMy WebLinkAboutWashington Fruit and Produce Company - Stormwater Maintenance Agreement STORMWATER MAINTENANCE AGREEMENT THIS AGREEMENT TO MAINTAIN STORMWATER FACILITIES IS ENTERED INTO THIS 17 DAY OF December , 2013, BY AND BETWEEN THE CITY OF YAKIMA (HEREINAFTER "CITY ") AND Washington Fruit and Produce Company AND ITS HEIRS, SUCCESSORS, OR ASSIGNS (HEREINAFTER "LANDOWNER "). SWPPP Permit No.: 13 005 Parcel No.: 181312- 31007, - 31005, - 34404, - 34401, - 34400, - 34402, - 34405, and -34406 Project Name: Washington Fruit — Phase 1 Cherry Line Facility W ITN ESSETH WHEREAS, the Landowner has submitted for approval by the City a permit application and Site Plan, which require the construction and installation of stormwater management facilities pursuant to the City of Yakima Post - Construction Stormwater Runoff Ordinance; and WHEREAS, the Post - Construction Stormwater Runoff Ordinance requires, as a condition of permit approval, a maintenance agreement between the City and the Landowner to ensure the Landowner will construct and maintain the stormwater facilities identified in the Site Plan; and WHEREAS, the City and the undersigned, its successors and assigns, including any homeowners association, agree that the health, safety, and welfare of the residents of the City of Yakima, Washington requires that on -site stormwater management facilities be constructed and maintained on the Property; and WHEREAS, under said Ordinance it is provided that private stormwater management facilities must be maintained by the property owner, and a maintenance agreement must be executed before the development plan is approved. NOW, THEREFORE, in consideration of the foregoing premises, the mutual covenants contained herein, and the following terms and conditions, the parties hereto agree as follows: 1. The Landowner shall construct and install stormwater management facilities as depicted and shown on the Site Plan, in accordance with the plans and specifications (attach Site Plan that shows type and location of stormwater facilities to be maintained). 2. The Landowner shall maintain the stormwater management facilities as shown on the Site Plan in good working order acceptable to the City (attach maintenance schedule showing type and frequency of maintenance. Maintenance schedule shall meet or exceed the Recommended Maintenance Criteria in Appendix 5A of the Stormwater Management Manual for Eastern Washington). 3. The Landowner hereby grants permission to the City, its authorized agents, and employees to enter the property and to inspect any stormwater management facilities pursuant to the Post - Construction Stormwater Runoff Ordinance and this Maintenance Agreement. 4. In the event the Landowner fails to maintain stormwater management facilities as shown on the Site Plan in good working order acceptable to the City, the City may enter the property and take whatever steps it may deem necessary to maintain said stormwater facilities. It is expressly understood and agreed that the Stormwater Maintenance Agreement (March, 2012) Page 1 City is under no obligation to maintain or repair said facilities, and in no event shall the Agreement be construed to impose any such obligation on the City. 5. In the event the City, pursuant to this Agreement, performs work of any nature, or expends any funds in performance of said work for labor, use of equipment, supplies, or materials, the Landowner shall reimburse the City on demand, within a time frame specified by the City for all costs incurred, including reasonable attorney's fees in the event that an action to collect such costs must be instituted. 6. It is the intent of this Agreement to insure the proper maintenance of stormwater management facilities by the Landowner; provided, however, that this Agreement shall not be deemed to create or affect any additional liability of any party for damage alleged to result from or be caused by stormwater management. 7. The Landowner, its executors, administrators, assigns, and any other successors in interest, shall indemnify and hold the City and its agents and its employees harmless for any and all damages, accidents, casualties, occurrences, or claims which might arise or be asserted against the City from the construction, presence, existence, or maintenance of the stormwater management facilities by the Landowner or the City. 8. In the event a claim is asserted against the City, its agents, or employees, the City shall notify the Landowner and the Landowner shall defend at his own expense any suit based on such claim. If any judgment or claims against the City, its agents, or its employees shall be allowed, the Landowner shall pay all costs and expenses in connection therewith. 9. This Agreement shall be recorded among the land records of Yakima County, Washington, and shall constitute a covenant running with the land, and shall be binding on the Landowner, its administrators, executors, assigns, heirs, and any other successors in interest. STORMWATER OPERATION & MAINTENANCE PLAN SECTION 1 - Required Inspection & Maintenance The storm water system at Washington Fruit and Produce Company, Phase 1 — Cherry Line Facility primary method for storm water management will be sheet flow of water across the pavement. Stormwater will be collected in catch basins and piped into infiltration trenches. Stormwater from the building will be collected at the roof drains and piped into an infiltration trench. Access roads will sheet flow stormwater across the pavement, and be collected into shallow roadside swales or allowed to disperse out onto the existing open soil for natural infiltration. The parking area and loading slab stormwater will be pre- treated using a CDS 2015- 4 and disposed of through an infiltration trench. A complete and thorough system inspection using the inspection and maintenance forms shall be completed on the following schedule: 1. Monthly from November through April 2. Once in late summer (preferably September) 3. After any major storm events that produce more than 1" of rainfall in 24 hours. Inspection Forms and Maintenance Report To use the Inspection and Maintenance form, found in Attachment "A ", identify the system components that compose your storm water system. Photocopy the applicable Inspection and Maintenance forms and the Inspection Cover Sheet. Inspect each system design feature to determine if any of the conditions are present. Add comments or problems found or action taken. If the current condition of the drainage system feature matches the description on the Inspection and Maintenance form, place a checkmark in the appropriate column. The system design features that have been checked will need maintenance if you determine a problem exists. To use the Maintenance Report form, first complete any maintenance activities that were required for you storm water system. Second, after you have maintained your storm water system, fill out a Maintenance Report. Describe the maintenance activities, including descriptions of the type of work, completion dates, contractors used, time needed, and costs. Documenting the maintenance performed on a storm water system will be useful in planning future maintenance activities. Safety Information 1. Inspections The inspector should have the proper safety equipment (heavy duty gloves, boots, first aid kits, for example) and training before conducting any inspections. If the storm water system inspection reveals a safety problem, then you may have to modify the site activities to reduce or eliminate the safety risk. The following is a list of safety precautions an inspector should be aware of when conducting storm water system inspections. Never enter a confined space unless you have proper Occupational Health and Safety Administration (OSHA) training. Do not enter any confined space until the atmosphere has been checked and proper safety equipment is worn and /or erected. If the structural strength of a pipe or conduit is questionable, you should not enter the pipe or conduit at all. Check the ventilation in the storm water system before using any type of ignitable materials. Some storm water systems may be sealed and have poor ventilation, posing a safety risk to the inspector if the vapor comes in contact with an open flame Wear gloves if any mechanical parts or structural components are going to be handled. Wearing gloves not only reduces the risk of getting cuts and abrasions, but also reduces the exposure of pollutants to the skin. Lift manhole covers or other structural covers (trash racks, access covers, etc.) carefully. These items can be very heavy and can be slippery if wet. Also, learn the correct way to lift heavy items to avoid back injury. Check the water depth of the system before you take a step in the water. The water may be deeper than you think or there may be steep slopes below the water line. Check for poison ivy, poison oak, or other poisonous plants when inspecting ponds or other large storm water systems. Inform the individual who will perform maintenance on the system that these plants are present. 2. Maintenance All maintenance work needs to be done in accordance with OSHA regulations. Maintenance personnel will have the proper safety equipment (heavy duty gloves, steeltoed boots, first aid kits, for example) and training before performing any maintenance on a storm water system. The following is a list of safety precautions maintenance personnel should be aware of when they perform maintenance on storm water systems: Equipment should be operated safely and in accordance with manufacturers specifications. Equipment operators should be aware of site personnel at all times to avoid causing injury to others. Utility companies should be contacted before excavating a site. Underground utility wires may be present. Excavated areas that cannot be fined in at the end of the day should be covered or clearly marked to alert site employees of the potential risk. Areas where removed sediment or wastes will be disposed should be identified prior to cleaning the storm water system. Use shovels, trowels or a high- suction vacuum to remove wastes. Sediment or waste should not be cleaned out with bare hands. The sediment or waste may be hazardous. Place the sediment or waste in an area where it cannot be washed into a storm drain or water body. Gloves should be worn if any mechanical parts or structural components are going to be handled. Wearing gloves not only reduces the risk of getting cuts and abrasions, but also reduces the exposure of pollutants to the skin. SECTION 2 - Best Management Practices Best Management Practices (BMPs) for the Washington Fruit — Phase 1 Cherry line Facility The following Best Management Practices (BMPs) will keep pollutants out of the storm water runoff at the Washington Fruit and Produce Company, Phase 1 — Cherry Line Facility. These BMPs are also known as source controls and were selected from the Stormwater Management Manuel for Eastern Washington ensuring these source controls are followed is the responsibility of the Fruit Packers Supply. These BMPs include the following: • The private parking lot will be swept by a vacuum street sweeper. • Lawn chemicals, such as fertilizers and pesticides, will be used in accordance with manufacturer's recommendations and will be used only when less toxic ways to control insects or weeds are not effective. • Dirt, grass, and other materials will be kept out of the street so they do not wash into a storm drain when it rains. Materials stored outdoors will be covered. • Leaves and other yard debris will be kept out of the street to avoid clogging storm drains. SECTION 3 - Responsible Organization The property owner, their heirs or successors shall be responsible for the operation and maintenance of on -site drainage facilities. The maintenance schedule shall be kept on record by the owner.
