For Meeting of: February 2, 2016 ITEM TITLE: Resolution to forego the formal Comprehensive Plan Amendment process through 2017 SUBMITTED BY: Joan Davenport AICP, Community Development Director Valerie Smith, AICP, Senior Planner (509) 575 -6042 SUMMARY EXPLANATION: As required by Chapter 36.70A RCW, the City of Yakima is required under the Washington State Growth Management Act to develop a comprehensive land use plan, map, goals and policies, and accompanying development regulations. Additionally, to facilitate potential individual requests to amend the City's Comprehensive Plan, YMC 16.10.030 requires the Yakima City Council to consider annually whether to open or forego the individual Comprehensive Plan Amendment process. The Council should therefore determine whether there are known or compelling reasons to open the individual Comprehensive Plan Amendment process for formal docketing in 2016, and if so, direct staff to prepare a resolution to formally open the process. The accompanying resolution gives direction to both staff and the Planning Commission to accept individual citizen requests for Comprehensive Plan Amendments to be considered in 2016 and 2017 that may be incorporated into the Comprehensive Plan Update and not formally docketed. ITEM BUDGETED: STRATEGIC PRIORITY: Improve the Built Environment APPROVED FOR SUBMITTAL: Interim City Manager STAFF RECOMMENDATION: The City of Yakima Planning Division recommends that Council consider foregoing opening the formal 2016 and 2017 comprehensive plan amendment processes, and adopt the accompanying resolution and direct staff to prepare an informational packet to be released in February for citizens to submit a "request for consideration" to be included in the Comprehensive Plan Update Process, targeted for completion in June of 2017. BOARD /COMMITTEE RECOMMENDATION: The Yakima Planning Commission requests that the City Council open a process that encourages private property owners and land owners to bring forth their requests to be considered during the Comprehensive Plan Update Process. Beginning in February of 2016 with a deadline of April 30, 2016, individual requests may be submitted for consideration during the 2016 -2017 update by action of the City Council; as a result, the Planning Commission recommends to Council that this process take the place of the formal annual Comprehensive Plan Amendment process for the years 2016 and 2017. Summary: Beginning in 2015, the City of Yakima embarked on the process of updating the Yakima Urban Area Comprehensive Plan 2025 document, as required by the Growth Management Act (RCW 36.70A (4a)). The updated plan is due to be submitted to the Washington State Department of Commerce on or before June 30, 2017. Planning Division staff is working with the consultant firm, BERK and their team, whom prepared a work program to meet this deadline. Transpo Group is assisting the City to prepare the companion Transportation Plan. As we review our City's current and future needs, the updated plan will include goals and policies that direct how the City will accommodate its allocated population within a 20 -year planning horizon. The last update of the City's Plan was completed in 2006, and effectively amended in 2007, 2008, 2009, 2010, 2011, 2012, 2014, and 2015. Typically proposals for annual amendments to the Yakima Urban Area Comprehensive Plan 2025 and amendments to the Yakima Urban Area Zoning Ordinance (YUAZO) follow the City's established process for Comprehensive Plan Annual Amendments per YMC § 15.23 and YMC Title 16. Annual amendments to the Plan are time - consuming and generally driven by citizen requests. The City Council at their last meeting in February 2015, opened the annual docketing process to accept citizen driven map amendments, with the understanding that the 2025 Plan they were amending was scheduled to be updated. There were nine CPAs docketed that proposed alterations to the future land use map and zoning map which are specifically related to the Yakima Urban Area Comprehensive Plan 2025. At their January 13 2016 meeting, the YPC discussed and considered options which were presented to them by Planning Division staff, and came to the following conclusions and recommendation which was requested to be forwarded on to City Council for their review and consideration: The Yakima Planning Commission recommends to City Council to open a process that encourages private property owners and land owners to bring forth their requests to be considered in the Comprehensive Plan Update Process. The Planning Division will prepare an informational packet to give to those whom are interested in submitting a request for consideration. Emphasis will be given that this is not a formal docketing process, and no fee will be charged to the individual. However, no formal decision will be given by the City of Yakima, all requests deemed compliant with the City's Comprehensive Plan Update will be rolled into the Update Process and not effective until the adoption of the Update Comprehensive Plan targeted for June 2017. "Note: In accordance with RCW 36.70A.130, the City is limited to considering comprehensive plan amendments no more frequently than once per year, and concurrently, so that the cumulative effect of the various proposals can be ascertained. 2 RESOLUTION NO. R -2016- A RESOLUTION authorizing the City's Planning Division staff and Yakima Planning Commission to implement a process to accept individual citizen requests for consideration in the Comprehensive Plan Update Program to be completed in June of 2017; pursuant to the Washington State Growth Management Act (GMA) RCW 36.70A.130 & RCW 36.70A.140. WHEREAS, YMC 16.10.030 requires the Yakima City Council to consider whether to open or forego opening the annual Comprehensive Plan Amendment Process; and limiting those amendments to no more frequently than once per year as required by ROW 36.70A.130; and, WHEREAS, the City of Yakima is undergoing its State Mandated Update of its Comprehensive Plan (RCW 36.70A.130), which was opened in 2015, will be conducted in 2016, and completed in 2017. This Update project will plan for a 2040 Horizon, and includes public participation, compliance criteria checklist, and environmental review; and, WHEREAS, the GMA requires cities to identify procedures and provide for early and continuous public participation in the development and updating of comprehensive plans pursuant to RCW 36.70A.140; and, WHEREAS, the Public Participation Guide was adopted by City Council in May of 2015 (R- 2015 -071) which identifies opportunities for public outreach, and numerous meetings for the receiving of important public input throughout the Update. The Yakima Planning Commission, with assistance from the Planning Division Staff is responsible for implementing the Public Participation Guide, and conducting the necessary public participation opportunities; and WHEREAS, On January 13 2016 the City of Yakima Planning Commission reviewed, discussed, and voted to recommend foregoing the formal docketing process for Comprehensive Plan Amendments for the years 2016 and 2017, and replace the formal process with a request for consideration process to be completed with the Update; and, WHEREAS, the City Council has determined that it is in the best interest of the City to forego opening the formal docketing process for the years 2016 and 2017, and instead, to accept individual citizen's request for consideration until April 30, 2016, to facilitate and assist the City of Yakima in the Comprehensive Plan Update project; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City's Planning Division and Yakima Planning Commission are hereby authorized to implement the 2016 and 2017 individual citizen's request for consideration process for the Comprehensive Plan Update Program to be completed in June of 2017; ADOPTED BY THE CITY COUNCIL this 2n day of February, 2016. 1 ATTEST: Avina Gutierrez, Mayor Sonya Claar Tee, City Clerk 2
