ITEM TITLE: Resolution authorizing a Memorandum of Understanding with
AFSCME Local 1122 Municipal Employees for reallocation of Class
Code 6221 Corrections Officer

SUMMARY EXPLANATION:
Reallocation of the Correction Officer classification is necessary due to some changes to the duties and
responsibilities. Please see the attached resolution and MOU for more detailed explanation.

It is recommended by City Management, the Civil Service Chief Examiner, and AFSCME Local 1122 for
Municipal Employees that the resolution and MOU be approved.

RESOLUTION NO. R -2015-
A RESOLUTION authorizing the City Manager to execute a Memorandum of
Understanding between the American Federation of State, County and
Municipal Employees (AFSCME) Municipal reallocating the Corrections
Officer classification (6221)
WHEREAS, the City and the Union acknowledge that this issue has been negotiated
in accordance with RCW 41.56, for the purpose of promoting fair and equitable treatment of
employees of the City of Yakima; and
WHEREAS, the City and the Union recognize the Chief Examiner has the
responsibility to devise a salary structure which complies with the Yakima City Charter; and
WHEREAS, the City Council has determined that it is in the best interest of the City
of Yakima to approve the Chief Examiner's recommendation to reallocate the Corrections
Officer job classification (6221), now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager of the City of Yakima is hereby authorized and directed to execute
the attached Memorandum of Understanding between the City of Yakima and AFSCME
Local 1122 Municipal reallocating the Corrections Officer Classification (6221).

MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF YAKIMA AND MEMBERS OF
AFSCME Municipal LOCAL 1122
THIS MEMORANDUM OF UNDERSTANDING ( "MOU ") is made and
entered into by and between Council 2, Washington State Council of County and
City Employees representing Local 1122 American Federation of State County
and Municipal Employees representing Municipal Employees with the City of
Yakima, AFL -CIO hereinafter called the "Union" and the City of Yakima,
Washington, hereinafter called the "City ".
WHEREAS, This MOU memorializes the agreement between the City and
the Union regarding the issue described below, and the parties acknowledge that
this issue has been negotiated in accordance with RCW 41.56, for the purpose of
promoting fair and equitable treatment of employees of the City of Yakima.
WHEREAS the City and Union agree that the provisions as set forth in this
MOU supersede any conflicting provisions in the Collective Bargaining
Agreement (CBA) covering the period January 1, 2014 to December 31, 2017 for
Municipal Employees.
WHEREAS, the City and the Union recognize the Chief Examiner has the
responsibility to devise a salary structure which complies with the Yakima City
Charter which deems in Article XV, Section 4:
"A pay and classification plan with job descriptions providing
equal pay for equal work shall be devised by the chief examiner
with the cooperation and approval of the civil service commission
which shall be submitted in ordinance form to the City Council
for passage. "
WHEREAS, in performing the duties of her job on behalf of the Charter
Civil Service Commission, the Chief Examiner has recognized the need to
reallocate the position of Correction Officer based on the responsibilities and
authority of the position.
WHEREAS this has become an imminent and critical issue of public
safety due to the inability to recruit and retain Corrections Officers.
WHEREAS the position is represented by a Collective Bargaining
Agreement.
WHEREAS, the parties have agreed to memorialize their agreement on
this issue in the form of this MOU.
NOW, THEREFORE, it is agreed by and between the City and the Union
that the position of Corrections Officer will be reallocated from pay code 15.5 to
17.5 and submitted to the Yakima City Council for approval in pay ordinance form
as required by the City Charter. The reallocation is proposed to Council to be
effective January 1, 2016.
