SUBMITTED BY: Dick Zais, City Manager Dave Zabel!, Assistant City Manager Chris Waarvick, Director of Public Works Lawrence Watters, Senior Assistant City Attorney CONTACT PERSON /TELEPHONE: Chris Waarvick, 575 -6411 SUMMARY EXPLANATION: A number of residents of the Chestnut Manor Apartments, 27 S. 4 Avenue, have expressed concern over access to long -term on- street parking adjacent to the CMA. This issue began to re- emerge two years ago when the City Council acted on recommendations from organized downtown business interests to amend the on- street parking times to encourage parking turn- over and re- direct business employee parking to long term solutions in public or private parking lots. Parking limits were reduced from 3 hours to 1 and 2 hour limits. The residents of CMA appealed to City Council for relief due to their circumstances; including both health and financial challenges. ® A solution staff identified for the Parking Commission to review was to "carve" out an exception to YMC 9.50.200 (attached) which allows $12 per year on street parking within the broader downtown but with the historical core area unaffected by this YMC. Please see attached map —the green area defines the expanse of yearly permit on- street parking and the smaller red are within is the area these permits are not allowed. This explains the anecdotal reports brought to City Council of individuals receiving $12 /year parking privileges in other downtown locations. At last check with Utility Services in Finance, only two such permits were active at this time. The CMA is currently within the "no permit" red area and would require Council amendment of the YMC for CMA residents to qualify for the permit. (continued.....) BOARD /COMMISSION /COMMITTEE RECOMMENDATION: • The Parking Commission voted to take no action to accommodate the request of the Chestnut Manor Apartment residents. Parking Commission minutes are attached. COUNCIL ACTION: • The City Council's Parking Commission was asked to review the situation and report back to the City Council with a recommendation. A number of discussions have occurred related to this issue both in front of the Commission and City Council over the last 6 to 12 months. The parking Commission most recently voted on July 1, 2010 to take no action to accommodate the parking YMC rule exception requested by CMA residents. Their rationale was to maintain consistency with their mission of encouraging parking turnover, etc. as identified in other downtown business forums. This matter is now before City Council for deliberation and, if so moved, action. Staff offers the following solution for Council consideration: (1) amend 9.50.200 to allow the ° yearly permit parking on Chestnut (north side) and S. 4 Street (east side) only to the extent of the CMA property lines (please attached map); and (2) this exception will run with the Chestnut Manor Apartments in its current use, reverting back in the event the CMA is no longer in existence. All other conditions and requirements of. YMC 9.50.200 would remain unaltered. Call to Order • 4:07pm • New members were voted onto the Parking Commission by the City Council at the June 15 Council meeting. 2. Chestnut Manor Apartments • Joe Morrier moved to rescind the recommendation from the Parking Commission regarding the Chestnut Manor Apartments at June 15 meeting. Mike McMurray 2 " The motion passed unanimously. • Joe Morrier began the discussion of the CMA, and his opposition in granting the CMA special on- street parking permits. Larry Hull restated the CMA's request to include Chestnut Manor Apartments in the area where on- street parking permits are available. A discussion occurred on the special conditions regarding on- street permitted parking. The CMA's request for special exemption was not recommended by the Parking Commission due to lack of a motion to proceed. 3. Parking Requirements for multiple resident buildings • Mike McMurray brought up the discussion of not wanting new residences created without some provision for parking, which puts strain on the public, not the building owner. He explained that now is the time to .resurrect the • idea with City Council because new residences are being created and there needs to be a provision for parking. A discussion occurred regarding the need for provisions to new residential parking - either provide parking or have a contract with existing parking lots that proves you can provide parking for the residents. Mike McMurray moved to ask the City and the City staff to investigate the feasibility of requiring new multi -unit residences to make provision for adequate parking for their residents, with emphasis on the original Central Business District. The objective of this research is to provide the Parking Commission with data from which a - recommendation to City Council can be made. Jack Cannon 2 " The motion was passed unanimously. 4. Use of Parking Lots for Special Events • A discussion occurred on the use of the public parking lots for special • events. • 0 5. Other Concerns • Larry Hull brought up the on- street parking permits for $12 per year. Chris Waarvick reviewed the municipal code regarding on- street parking permits. Mike McMurray moved that the Parking Commission recommend elimination of 9.50.200 with the exemption that existing permits be grandfathered until not renewed. Jack Cannon 2n The motion was passed unanimously. • Mike McMurray moved to rescind the motion of the Barrel House Parking that was discussed at the last Parking Commission meeting on June 6. Jack Cannon 2 The motion passed unanimously. A discussion occurred on the Barrel House Parking Lot. Mike McMurray moved to recommend addition of parking meters to the Barrel House parking lot, to maintain the same setup and operational procedures (% of monthly permits available, cost, and signage) as the other 3 public parking lots, and to have the Committee for Downtown Yakima manage this lot under their current contract and financial arrangement with the City, with the possibility of developing it in the future. Jack Cannon 2nd The motion passed unanimously. • Joe Morrier restated his opinion that the Committee for Downtown Yakima needs to find a way to add to its budget and he believes on- \� street parking meters may be the way to go. A discussion regarding on- street parking occurred. 6. Adjourned • 5:18 • PARKING METER PARKING 9.50.200 Residential parking permits in the central business district. A. Authority. Residential parking permits for the central business district.may be issued by the Yakima city director of finance and budget or her/his designee. Such permits shall apply to the area bounded by.the center line of 6th Street on the . east; the center line of Spruce Street on the south; the west curb line of 6th Avenue on the west and the north curb line of Lincoln Avenue on the north Tess the area described as the core business district in YMC 9.50.080. B. Written Application. Permits may be issued by the director of finance and budget or her /his designee to a resident of the area described in subsection A of this section upon written application of such resident to the director of finance and budget or her/his designee. Such application shall • contain the following information: (1) Name, address, and telephone number of the applicant together with proof of residency at such address; (2) Make, model, and year of one passenger motor vehicle or pickup truck, which shall not exceed eight thousand pounds in gross weight, which is registered to the applicant and for which a. permit is sought; (3) The names of those persons living in the same residential unit as the applicant; (4) A copy of the current vehicle registration; (5) A copy of the applicant's current driver's license; (6) A copy of the applicant's current proof of insurance in the form required by RCW 46.30.030; (7) A "representation that the vehicle is operable and may be legally driven on the public highways of Washington State; and (8) Such other information as the director of finance and budget or her/his designee may deem necessary in complying with the terms of this section. C. Issuance. Upon properapplication, the director of finance and budget or her/his designee may issue a residential parking permit to the applicant upon payment of a twelve dollar nonrefundable fee to cover the cost of administration. Such permit shall expire a year after its issuance and may be renewed annually. The permit shall be in the form of a vehicle windshield sticker issued by the director of finance and budget or her /his designee, containing the make, model, year, and license number of the vehicle to which such permit applies. D. Rules and Regulations. (1) No more than one residential parking permit may be issued to the resident of each residential unit within the area described in subsection A of this section. A residential unit means . a housing unit in which all persons reside as a single group, such as a family, whether in a single or multiple dwelling. (2) The permit granted under this section shall apply only to the area designated in subsection A of this section. Such permit does not reserve a arkin space in such area upon the p g P p public streets. (3) . In order for such permit to be valid, it must be displayed on the left rear window of the vehicle to which it applies. (4) Such permit shall not be transferable. Provided, that a permit which has more than six months remaining may be reissued by the director of finance and budget or her /his designee for its unexpired term to the original applicant upon applicant's showing that the vehicle to which such permit applies has been sold, destroyed, or otherwise transferred or that the applicant has moved to another residential unit within the area described in subsection A and for which no permit is issued. (5) The permit granted under this section shall not apply to areas where parking is not otherwise allowed and the following restrictive parking zones: fifteen - minute, thirty - minute, loading zone, and handicapped zone. In addition, such permit applies only to parking within a quarter of a mile from the applicant's residence listed on the permit. . (6) It is unlawful to: (a) affix a permit issued under this section on a vehicle other than that to which it applies; (b) knowingly provide false information in obtaining such permit. (7) Permits shall not be issued to persons with outstanding /unpaid parking violations and /or traffic infractions. (8) The director of finance and budget is authorized to adopt such further rules and regulations, not inconsistent with rules and regulations of this subsection, as the director deems necessary or advisable to administer the permit system authorized and adopted by this section. '9.49.030 .Downtown Yakima parking commission. 9.49.040 Terms. 9.49.0 50 Organization. 9.49.060 Composition of the commission. 9.49.070 Powers and duties. 9.49.010 Purpose. The downtown Yakima parking commission shall serve in an advisory capacity to the Yakima city council and city manager concerning formulation of policy and plans for development, management and operation of the Yakima downtown parking district. (Ord. 2007 -35 § 1 (part), 2007). 4110 9.49.020 Definitions. The following words ds and terms when used in this chapter shall mean as follows: "Annual parking management plan" means a yearly plan describing the annual budget and the daily management and operations of the parking system. "Downtown parking district boundaries" includes the parking areas as follows: 9th Street to the east, both sides of the street; 7th Avenue to the west, both sides of the street; Lincoln Avenue to the north, both sides of the street; and Walnut Street to the south, both sides of the street - "Parking" includes on- street and off - street parking. (Ord. 2007 -35 § 1 (part), 2007). 9.49.030 Downtown Yakima parkin g commission. There . is hereby established a downtown Yakima parking . commission consisting of eight members, seven voting and one nonvoting position, as provided in YMC 9.49.060. ip Members of the downtown Yakima parking commission shall be appointed by the Yakima city council. (Ord. :2007 -35 § 1 (part), 2007). 9.49.040 Terms. The initial appointments to the commission shall be staggered. Three voting members shall be appointed for three years. Four voting members and the nonvoting member shall be appointed for four years. Thereafter, the terms shall be made for four years. Membership on the commission shall be limited to two full consecutive four -year terms. Reappointment . after two full consecutive terms maybe made after at least a two -year absence. The Yakima city council shall fill vacancies for a new or unexpired term in the same manner as the original appointment. Removal of commission members shall be controlled by YMC 1.30.010. (Ord. 2007 -35 § 1 (part), 2007). 9.49.050 Organization. During January of each year, the commission shall elect from the membership a chairman, vice- chairman and such . other officers as the commission members deem necessa ry to organize and carry on the functions and duties of the commission. The commission shall adopt a time for holding regular monthly meetings, and the commission shall hold regular monthly meetings unless cancelled with notice by the chairman. Special meetings may be called by the chairman to be held at any time pursuant to notice of such meeting given as required by law. (Ord. 2007 -35 § 1 (part), 2007). 9.49.060 Composition of the commission. A. The commission shall always include the following seven voting members: 1. A business, owner representing businesses between 7th Avenue and 1st Avenue. 2. A business owner representing the businesses on Front Street. 3. Two business owners representing businesses between 1st Street and 9th Street. 4. Two property owners within the district boundaries. 5. A resident from within the district boundary. B. The commission shall also include one nonvoting position to be filled by a member of the Yakima city council. C. • Recommendations for membership on the downtown Yakima parking commission shall come from the committee for downtown Yakima (CDY). The Yakima city council will appoint the members of the commission. (Ord. 2007 -35 § 1 (part), 2007). 9.49.070 Powers and duties. The downtown Yakima parking commission is tasked with the oversight of a downtown parking system that will meet the ever - changing needs of the downtown business property owners, residents and users. The commission would address downtown parking issues and make recommendations to council to be approved by resolution. In carrying out these responsibilities, the commission shall review the following: (1) On- street parking regulations, including, but not limited • to, time restrictions, loading zones, no parking zones. (2) Location and type of parking (i.e., parallel, diagonal, etc.). (3) Use of parking technology. (4) Parking fees. (5) Cost of parking infractions. (6) Enforcement of parking regulations. (7) Annual parking management plan. (8) All other issues that might affect the operation of parking within the downtown parking district boundaries. (Ord. 2007 -35 § 1 (part), 2007).
