SUBMITTED BY: Bill Cook, Director, and Community & Economic Development CONTACT PERSON/TELEPHONE: Bruce Benson, Acting Planning Manager SUMMARY EXPLANATION: Pacific Power and Light is installing an underground power line to service the Creekside West development, located at S 40 Avenue and Washington Avenue, and adjacent properties. They are requesting an underground easement for this installation. The property in question is jointly owned by the City of Yakima and Yakima County. Should you choose to pass the attached resolution which authorizes the City Manager to sign this easement it will then be presented to the Yakima County Commissioners for their consideration and adoption. R -2008- A RESOLUTION Authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a power line utility easement in favor of Pacific Power & Light Company. WHEREAS, Creekside West, a new business park, is under development at the corner of S 40 and W Washington Avenues; and WHEREAS, electrical power is a requisite need for this business park; and WHEREAS, the City of Yakima and Yakima County are the owners of the land over which a power line easement is needed; and WHEREAS, the Yakima City Council recognizes the benefits provided by new development to the citizens of Yakima, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager and City Clerk of the City of Yakima are hereby authorized and directed to execute a power line utility easement in favor or Pacific Power & Light Co. over and across city owned property at S. 40 and W Washington Avenues. Attention: Bruce Benson 129 N 2 St. Yakima, WA 98901 Dear Mr. Benson, Enclosed you should find the Pacific Power Right of Way (2 pages) and attached Exhibit "A" sketch (1 page) and also two 11" X 17" Pacific Power work order sketches. The enlarged sketches have been included for detail enhancement for the City's review and are not intended to be a part of the recorded easement. Pacific Power is requesting that the City of Yakima, grant to Pacific Power, an easement 12 feet in width along the route shown on Exhibit "A" and highlighted in yellow marker on the Pacific Power job sketches. Pacific Power's intent is to be on privately owned property behind road right of way lines. Pacific will keep easement and • utilities as close as possible to right of way lines. For the portion of right of way route that is not adjacent to roadways Pacific Power is following along the "non construction flight zone line" (from 48 Avenue southeast to Washington Avenue). If the Yakima City Council approves granting the Right of Way, which Pacific Power needs in order to provide electrical service to Wide Hollow Development's commericial development, please ask the appropriate city authority to sign the document and state their title on Notary Page. Please print this individual's name below the line on which he signs as well as in the body of the notary representative verbage. Pacific Power will need to have the original document signed and returned to Pacific Power at the return address stated above. Pacific will have the easement recorded.
