RE: Council meeting complaint - Emesto Gonzalez

Mr. Gonzalez attended the city council meeting on May 6 and spoke during
audience participation with a complaint about him receiving a Notice and Order
for parking on the front lawn. This ordinance was effective on August 5, 2007
with enforcement starting at that time. On August 15, 2007, Mr. Gonzalez .
received a friendly letter advising him of the new ordinance and to please cease
using the front lawn area for parking of vehicles.
All investigations are complaint driven from the public. This practice never
• ceased and with more complaints called on this property, a Notice of Non-
Compliance was sent out on April 21, 2008 to cease use of the front yard for
parking with an abatement date of April 30, 2008. Mr. Gonzalez communicated to
the code compliance officer that he was going to attend the city council meeting.
At this time we extended the abatement deadline to May 6th until after the council
meeting.
The complaint was referred to the Public Safety meeting on May 7, 2008 in which
this subject was discussed. After the basic information was shared with the
council members along with questions, the council members voted 2 -1 to leave
the ordinance as it is written and for Mr. Gonzalez to abide by the requirements.
With this decision from the Public Safety committee, Mr. Gonzalez will be notified
with another notice that will give him the opportunity to appeal to the hearing
examiner for his case as outlined in the ordinance. If this condition is not abated,
the next step of the ordinance to address this public nuisance is to issue a
citation as a civil infraction punishable by a fine of up to $250.00 and heard in
municipal court.
