COUNCIL CHAMBERS — YAKIMA CITY HALL Roll Call Present: Council: Mayor Dave Edler, presiding, Assistant Mayor Micah Cawley, Council Members Kathy Coffey, Rick Ensey, Norm Johnson, Bill Lover and Neil McClure Staff: City Manager Zais, Senior Assistant City Attorney Cutter 2. Executive Session — Property acquisition and Prospective Litigation The Executive session was held and adjourned at 5:36 p.m. 6:00 P.M. — PUBLIC SESSION 1. Roll Call Present: Council: Mayor Dave Edler, presiding, Assistant Mayor Micah Cawley, Council Members Kathy Coffey, Rick Ensey, Norm Johnson, Bill Lover and Neil McClure Staff: City Manager Zais, Senior Assistant City Attorney Cutter and City Clerk Moore 2. Invocation /Pledge of Allegiance Assistant Mayor Cawley gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations • National Day of Prayer Assistant Mayor Cawley read a proclamation proclaiming May 1st as National Day of Prayer. Linda lasella accepted the proclamation. • Law Day Mayor Edler read a proclamation proclaiming the first day of May as "Law Day." Cynthia Martinez, representing the Yakima County Bar Association, accepted the proclamation. City Manager Zais also advised that in May, Cynthia Martinez will assume the role of President of the County Bar Association. • APRIL 15, 2008 Administrative Professionals Council Member Coffey read a proclamation proclaiming April 215` thru 25`h as Administrative Professionals week and April 23r. as Administrative Professionals Day. JoAnne Benson, representing IAAP, accepted the proclamation. B. Special presentations / recognitions • Donation to Yakima Fire Department from. Nob Hill Casino for protective equipment Deputy Fire Chief Dave Willson advised that Nob Hill Casino and a group of citizens raised $2,684 to replace seventeen helmets. Update on Fisher Park Committee Tom Hinman, representing the Parks & Recreation Commission, gave attendance statistics at Fisher Park Golf Course since its opening this year. Attendance is down approximately 17 %. They have run promotions and are trying to raise $5,000 to offer signage for advertising to generate income. Extreme Winter Weather Program update — Dave Hanson Dave Hanson, representing the Homeless Network of Yakima County, recapped the extreme winter weather project. He provided statistics on volunteer services and usage of the shelters by the homeless. The Council was presented a certificate and letter of appreciation for supporting the program. • C. Status report on prior meeting's citizen service requests Mayor Edler said he had been contacted by Don Deccio regarding the condition of Kissel Park. Denise Nichols, Parks and Recreation Manager, advised that the park was heavily used over the weekend -and since daily maintenance does not start until May 1, staff was unable to clean the park immediately after the weekend use. Mayor Edler said that Julie Schilling, West Side Merchants, requested a status on the graffiti case that is pending in the court system regarding acid etched graffiti on windows. City Manager Zais committed to getting a status on the case from the County Prosecutors office. D. Appointments to Boards and Commissions None 4. Consent agenda Mayor Edler referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Item No. 8 was added to the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. CAWLEY MOVED AND McCLURE SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. Council Committee Meeting Reports / Minutes 1. Economic Development — April 2, 2008 2. Intergovernmental Committee — April 7, 2008 3. Budget Committee — April 3, 2008 4. Downtown Futures Committee = March 26, 2008 5. Neighborhood Development Committee — March 19 and 27, 2008 5. Audience Participation Victor DeLong, Vice President of the Farmer's Market, explained their expansion plans. This year is their 10th anniversary. There will be a theme with corresponding events for each month the market is open. Patrick Knittle explained his Eagle Scout project, which is to improve the Harlan Landing area at the Greenway by planting grass and installing irrigation. He needs approximately $300 to complete the project and asked to partner with the City to accomplish it. Council Member McClure challenged the Council members to contribute saying he would match their donations. Carol Salstrand with Yakima Valley Peace Advocates Network said the group is bringing Arlington Northwest to Franklin Park on April 26 and 27. They will be setting up over 3,000 grave markers to honor Americans who have died in the Iraq war. Henry Herron reminded Council that he had addressed them in the past regarding loud car stereos and exhaust. He asked if the complaint form for citizens to log the license number of offenders was progressing. Staff will respond to Mr.Herron's concern. CITY MANAGER'S REPORTS 6. Consideration of a Resolution approving a grant request for funding Assistance for a Washington Wildlife and Recreation Program project to the Recreation and Conservation Funding Board (RCO) for development of a youth soccer complex Darren Joffs and Larry Matson, representing the Yakima Youth Soccer Association (YSSA), presented plans for constructing a soccer complex on City property alongside 1 -82, south of the Wastewater Treatment Plant. Mr. Joffs advised that Washington State has the highest number of youth players per capita in the entire nation and there are over 2,000 members in the Yakima area alone. As a result, the fields are over used. He also emphasized that tournaments would be a great source of tourism revenue and how the new soccer complex would beautify the 1 -82 corridor. They requested Council's support of the concept and endorsement of a grant request for project funding. Larry Mattson, the project manager, explained that the association has been saving money for ten 'years, and, with the grant, will be able to use that money for i C APRIL 15, 2008 land development instead of acquisition. The City Clerk read the resolution by title; JOHNSON MOVED AND CAWLEY SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call,vote. EDLER MOVED AND CAWLEY SECONDED TO HAVE CITY STAFF WORK OUT A LEASE AGREEMENT. The motion carried by unanimous voice vote. RESOLUTION NO. R- 2008 -62, A RESOLUTION authorizing application for funding assistance for a Washington Wildlife and Recreation Program (WWRP) project to the Recreation and Conservation Office (RCO) as provided in Chapter 79A.15 RCW, Acquisition of Habitat Conservation and Outdoor Recreation Lands. 7. Consideration of a Resolution authorizing the City Manager to obligate a maximum of $130,000 from the City's Community Development Block Grant program for the-Yakima Food Bank to purchase real property at 313- 315 South Second Street Michael Morales, Community and Economic Development Deputy Director, explained that Council action would entail a commitment of funds subject to a number of conditions being met by the food bank. A timeline of six months has been placed on the funding (to October 15th). The City Clerk read.the resolution by title, JOHNSON MOVED AND COFFEY SECONDED TO ADOPT THE RESOLUTION. R- 2008 -63, A RESOLUTION Authorizing the City Manager to obligate a maximum of $130,000 from the City's Community Development Block Grant program for the Yakima Food Bank to purchase real property at 313 -315 South 2 "d Street in Yakima, Washington. *8. Consideration of Legislation regarding the Yakima Farmer's Market: A. Resolution authorizing execution of a Concession License Agreement between the City of Yakima and the Yakima Farmers' Market RESOLUTION NO. R- 2008 -64, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an exclusive concession license agreement with Yakima Farmers' Market, a non - profit corporation, to facilitate continued operation of a farmers' market at certain times within the City of Yakima. B. Resolution authorizing temporary street closures for the Yakima Farmers' Market RESOLUTION NO. R- 2008 -65, A RESOLUTION authorizing temporary closure of portions of South Third Street between East Yakima Avenue (to the north) and midblock (north of the Post Office driveway) between East Chestnut Avenue and East Walnut Street (to the south) for the Yakima Farmers' Market. rd APRIL 15, 2008 •9. Consideration of Final Contract Payment for Martin Luther King Jr., Boulevard and Lincoln Avenue Grade Separation Phase 1 Project #1818 (Adopt Standard Motion V -B — accept project; and approve final payment) The report from the City Engineer, dated March 11, 2008, with respect to the completion of the work on the Martin Luther King Jr. Blvd and Lincoln Avenue grade separations -Phase I, performed by West Coast Construction Co., Inc., was approved, the work accepted and payment of the final estimates as therein set forth was authorized. *11. Set Date of Public Meeting for May 6, 2008 at 7:00 p.m. for to consider approval of the final plat of Phase I of Scenic Plateau. May 6, 2008 was set as the date of a public meeting to consider the approval of the final plat of Phase I of Scenic Plateau. *12. Consideration of a Resolution authorizing execution of a Professional Services Agreement with HDR Engineering, Inc. to develop the plans, specifications and estimate for the repairs needed on the Nob Hill Boulevard overpass. RESOLUTION NO. R- 2008 -66, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a professional services agreement in an amount not to exceed $124,000 to develop the Plans, Specifications and Estimate for the repairs needed on the Nob Hill Boulevard Overpass. *13. Consideration of a Resolution authorizing execution of a contract amendment with the State of Washington Department of Social and Health Services, Division of Child Support to extend the Healthy Families Yakima program for an additional year RESOLUTION NO. R- 2008 -67, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to amend an Interlocal Agreement with the State of Washington Department of Social and Health Services (DSHS) to allow the City of Yakima to use federal IV -D match funds to operate the "Greater Yakima Valley Healthy Marriage and Responsible Fatherhood Community Demonstration Initiative" child support enforcement demonstration project. .01 APRIL 15, 2008 *14. Consideration of a Resolution authorizing execution of a contract with Lexipol LLC for development and training on a new Police Department Policy and Procedure Manual RESOLUTION NO. R- 2008 -69, A RESOLUTION authorizing and directing the City Manager to enter into a contract with Lexipol LLC for development of a Police Department Policy and Procedure Manual, and for a training module on said manual. ORDINANCES *16. Consideration of legislation amending the Classification and Compensation Plan for certain City employees and legislation amending 2.20.100A; 2.20.10013; 2.20.1000; 2.20.1001); 2.20.110A; 2.20.110B; 2.20.110C, all of the City of Yakima Municipal Code ORDINANCE NO. 2008 -22, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective May 18, 2008; amending Subsections 2.20.100A; 2.20.10013; 2.20.100C; 2.20.100D; 2.20.110A; 2.20.110B; and 2.20.110C all of the City of Yakima Municipal Code *17. First reading of an Ordinance amending the 2008 Budget in the General Fund to purchase firefighter helmets funded by a community donation An Ordinance amending the 2008 budget in the General Fund and appropriating funds to purchase firefighter helmets funded by a community donation, was read by title only, and laid on the table until May 6, 2008 for a second reading. *18. Consideration of Legislation regarding the second annual Washington State Law Enforcement Technology Conference: A. Resolution authorizing the City Manager to execute contracts for the technology conference RESOLUTION NO. R- 2008 -70, A RESOLUTION authorizing the City Manager for the City of Yakima to sign contracts necessary for the City of Yakima to sponsor the second annual Washington State Law Enforcement Technology Conference. • 130 APRIL 15, 2008 B. First Reading of an Ordinance amending the 2008 Budget and making appropriations in the 000 - General Fund, Finance Department (No action required at this meeting; second reading scheduled 5- 6 -08.) An Ordinance amending the 2008 budget and appropriating funds in the 000 - General Fund, Finance Department, was read by title only, and laid on the table until May 6, 2008 for a second reading. 19. Other Business Assistant Mayor Cawley requested staff to develop an estimate of preliminary costs for a summer kick off cruising night and to advise if any legislation is required. Mike Antijunti, representing Boy Scout roop 115 in Selah brought four scouts to the meeting who are working to earn their "Citizenship in Community" merit badge. 20.
