July 1, 2008 ITEM TITLE: Consideration of Council approval of requests regarding the construction of the Eastside Skatepark at Kiwanis Park: A. Request for $25,000 from CDBG Public Facilities B. An Ordinance Amending the 2008 Budget and Creating an Appropriation in the 331 – Parks and Recreation Capital Fund SUBMITTED BY: Chris Waarvick, Director of Public Works Rita DeBord, Finance Director CONTACT PERSONITELEPHONE: Denise Nichols, Parks & Recreation Manager, 575 -6020 SUMMARY EXPLANATION: The City opened bids for the Eastside Skatepark on May 15, 2008. Grindline. Skateparks, Inc. was the low bid. However, the bid came in $45,000 higher than anticipated. To make up for the shortfall, Apple Valley Kiwanis pledged an additional $20,000 toward construction. In addition, staff made a request for $25,000 from the CDBG Public Facilities Fund. A. At the June 11, 2008 Neighborhood Development Committee meeting, , Parks and Recreation made a formal presentation and request for $25,000 from CDBG Public ® Facilities fund. The Committee approved the request (see attached minutes). The request before you today is to approve their recommendation for funding. B. Pass an ordinance to increase the project budget by $100,000. It should be noted that an appropriation is not necessary for the CDBG fund, as the grant was already included 100% in the budget —this is a matter of obligating the available funds for this purpose. The project budget has not been adjusted since the original estimate of $225,000 made in 2005, so the appropriation brings the total project appropriation to the necessary $325,000. WHEREAS, the amount of $100,000 must be appropriated within . the 331 — Parks and Recreation Capital Fund for expenditure during 2008 to provide for construction of a Skatepark, and. WHEREAS, at the time of the adoption of 'the 2008 budget it could not reasonably have been foreseen that the appropriation provided for by this ordinance would be required; and the City Council declares that an emergency exists of the type contemplated by RCW 35.33.091 and that it is in the best interests of the City to make the appropriation herein provided, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1: The amount of $100,000 is hereby appropriated from the Unappropriated Fund Balance in the 331 — Parks and Recreation Capital Fund to the 'following accounts as a 2008 appropriation: Resources: Donations /Contributions - - -- 331 - 331 -428 -2023- 36711 -CNT -- $50,000 Expenditures: Kiwanis Skatepark -- 000 - 000 - 119 - 0000 - 521.40 -410 -- $100,000 Section 2: This ordinance is one making an appropriation and shall take effect immediately upon its passage, approval and publication as provided by law and by the City Charter. City Council Committee Wednesday, June 11, 2008 Council Members in attendance: Kathy Coffey, Bill Lover, and Neil McClure City Staff: Dave Zabell, Bill Cook, Michael Morales, Chris Waarvick, Denise Nichols, Archie Matthews Others: David Severson and Gailon Gentry/Kiwanis Club, Luz Gutierrez/RCDR Agenda Items: 1. Discussion of venue for Annual Action Plan (AAP) public meetings HUD requires two advertised Annual Action Plan Public Meetings to be held per year. Results of the AAP are to be turned in no sooner than November 15th of the current year and no later than December 30th of following the following year. The following suggestions where made: • Archie Matthews suggested that one AAP meeting be held July and the second in September. • To hold one meeting in August, preferably the first, in the council chambers -during the ONDS Committee meeting to accommodate citizens who can attend during the day. The second meeting to be held in September during the evening or weekend at an off -site location to accommodate citizens who can only attend evenings. • To hold the meetings prior to October. To allot time to prepare the report for HUD and submit, to them by November 15. 2. RCDR proposal for micro enterprise assistance RCDR has submitted a proposal for $25,000 from CDBG funding for their micro enterprise program. Small businesses such as RCDR that have five or less employees can be classified for micro enterprise assistance. The request for $25,000 from CDBG funds will be for technical assistance in the micro enterprises program, specifically for businesses within the city limits of Yakima. RCDR will be required to give quarterly updates on the progress of their program to ONDS if their request is approved. The ONDS Committee recommended that the proposal be forwarded to City Council. 3. Request for funding regarding Kiwanis Skate Park The City, of Yakima Parks and Recreation Department has granted Grindline the bid to build the Skate Park at Kiwanis Park. The architect's estimated cost for construction is $325,000. The Parks and Recreation Department has raised $280,105, leaving an unfunded balance of approximately $45,000. Kiwanis Club representatives David Severson and Gailon Gentry presented the committee with a donation in the amount of $20,000 for the project. Parks and Recreation is requesting a $25,000 grant from funds to cover the balance. Construction will take approximately 100 days and can begin as soon as all of the funds are in place. The Committee recommended that the request for funding be forwarded to City Council. 4. )First quarter financial update for CDBG and HOME funds This is an item that will be presented to the committee on a monthly basis. Currently extra funds are available due to loans from prior years that have been paid in 2008. On an annual basis, ONDS must demonstrate to HUD that they can fulfill their obligations and spend the funds in a timely manner. Most years ONDS receives notice that their budget for the following year is going to be reduced by 8% to 15 %. Over the past five years the budget cuts have been 5% to 9 %. ONDS attempts to, carry funds over to the following year to counterbalance the anticipated decreases. HUD monitors how much money is carried over. 5. bead -based paint abatement application The grant application to Dupont was submitted. A response has not been received. The request was to be able to expand the Exterior Paint Program. The amount of the potential award is unknown at this time. Other organizations have received as much as $100,000. 6. Pacific Power fluorescent light replacement information A letter was sent to Pacific Power explaining ONDS programs and applying for a grant for materials to replace lighting in the homes of the senior and/or disabled programs. OIC Director Chris Link has previously managed grants from Pacific Power. KIWANIS PARK - Conduct a wetlands assessment of Kiwanis Park. This pond could be very contaminated from the former area in connection with incinerating garbage at the incinerator - smokestack for several decades. It is also a haven for mosquitoes which like still water. The covering of this pond with an attached drainage ditch would remove both of these possible contaminants. I am working on an article about Lyme disease and other health issues connected to chiggers, reptiles, spiders, etc. With people visiting new areas, they can be infected and return to our valley with health problems previously unknown. I move that this pond be covered. It will be unavailable to birds and humans! It can be made available for an extra ball field I understand would be useful to the local kids to use to play the old game I knew as "workup" we played with a ball made of a sock stuffed with rags and a piece of 2 X 4 for bat, 75 years ago. We were poor! CHESTNUT -BARGE AREA INCLUDING THE A.E. LARSON MANSION, ROSEDELL. The other paragraph deals with the calming of traffic in the Barge - Chestnut area. I had a call from a long time acquaintance that the neighbors in the area of Rosedell, the mansion built by A.E. Larson are disturbed that the newest owners want to establish a bed and breakfast at this beautiful location. An attempt to do this was made 'a few years ago and that owner had to let the place go back and there has been a terrible history of ownership. I did a video on Rosedell for YCTV which showed it at its best and I went to the neighborhood meeting. I spoke for that owner to be allowed to have retreats and other quiet activities there. There is no limit on panting on the north side and it is within traveling distance with little gas problems. Local retreats would be a perfect outlet because these folks appreciate the beauty of Yakima. This mansion costs a lot to maintain and issues similar to Birchfield Manor will calm the city council's fear of drinking parties and vandalim. Anyone coming as a guest will have the money to pay their way and appreciate the opportunity to stay 6/30/2008 Page 2 of 2 at Rosedell. If this issue comes up, feel free to call me and I will repeat my support for making Rosedell available for bed and breakfast and retreats. It has four bedrooms with each a bath on the third floor which were unbelievably well kept for a building erected in 1905 - now over 100 years old. Let's support this effort, if it is brought to the council's attention. KIWANIS PARK SKATEPARK FUNDING The final comments are for the funding of the skate park at the corner of Maple and Fair Avenue. By all means let's get this funded and built! I am happy those who appreciate the old buildings, such as the incinerator and smokestack, see that this is kept as is and room is there for the local people to have lawn, swings, picnic tables, etc. With other people using this neat little park, perhaps the type of skaters we have heard about near 40th and Englewood will not behave and appreciate a high quality skatepark we have heard is planned.
