TO: Honorable Mayor, Members of City Council, and City Manager FROM: Scott Schafer, Wastewater Division Manager SUBJECT: Response to citizen complaint regarding stormwater runoff at 4108 Donald Drive BACKGROUND Mr. and Mrs. Andrew Mervos of 4108 Donald Drive, with the assistance of their neighbor John PucoineUi, submitted a complaint at the November 17 Council meeting regarding the periodic discharge of stormwater runoff following heavy rainfall or snowmelt onto their property. The property owner has experienced a significant amount of sediment deposited onto the property from the runoff which has required cleanup. INVESTIGATION AND FINDINGS The subdivision which incorporates the subject property was platted and developed in Yakima County and subsequently annexed into the City, A thorough review of the public roadway and storm drainage system serving the subdivision reveals that design and construction of the roadways are inadequate to address stormwater runoff during intense evants, specifiCa||y, the roadways lack sufficient "orVvvniOg" and adequate stormwater facilities. Rather than approaching the County and subsequently the City, it appears that the previous property owner mitigated these deficiencies by creating a makeshift dam across the driveway: The driveway cut had deteriorated to the point of disrepair and has recently been replaced. The crown of a road directs surface water into the gutters on either side of the roadway where it is then channeled into the catch-basins. As constructed, during heavy runoff events, stormwater from Fellows Drive 'sheet flows" down its steep grade scouring the edge of the property of 1013 Fellows Drive and picking up signifiant sediment. The runoff then sheet flows across Donald [)rive to the South curb line. At this point, the South gutter of Donald Drive is conveying a considerable quantity of runoff and sediment, to the point that it overtops the driveway serving the subject propert. In addition to the crowning iseue, the subdivieioh lacks sufficient stormwater catchment . facilities - not enough catch-basins were incorporated within the road design. As oonstructed, there are only two catch-basins at the bottom of the hill of Fellows Drive. This particular section of roadway is well over a 1.000 feet in length at grades exceeding 14 percent. Two catch-basins exist within Donald Drive east �f 4108 Donald Drive; hovvever, due to the construction and/or design deficiencies present, stormwater runoff rarely reaches the North catch-basin and flows reaching the South catch-basin consist of what remins after the driveway at the 4108 location has been overtopped. . While not a public safety hazard, the current situation represents a liability to the City. The runoff generated by the public streets within the subdivision is not adequately controlled (do to poor design and /or oversight at the time of construction) and may result in damage claims from property owners, as such; the City has a responsibility to address the problem. SOLUTION AND DISCUSSION Staff has identified an engineering solution that will mitigate the aforementioned deficiencies and protect both of the properties experiencing impacts during runoff events. The estimated expense to divert stormwater runoff from these properties ranges between $10,000 and $15,000 and may involve piping, placement of catch - basins and minor paving or concrete work. As this is a stormwater issue, the Stormwater Utility is an appropriate resource through which to address this matter. However, the inclusion of projects of this nature would represent an expansion of the existing Stormwater Program (SWP) and would have an impact on future stormwater utility rates. As a reminder, when establishing the SWP the City Council created a "minimally compliant program" with respect to the NPDES and UIC regulatory requirements. An additional element authorized as part of the SWP is a limited capital program to address safety concerns; broken grates and curbing, which are causing safety hazards to the public as well as addressing localized flooding. However, issues of the type impacting the properties at 4108 Donald Drive and 1013 Fellows Drive do not fall neatly into either category. RECOMMENDATION Staff respectively requests a minor expansion of the SWP program through Council authorization of Stormwater Program Capital Funds to mitigate stormwater impacts at both 4108 Donald Drive and 1013 Fellows Drive and to address similar situations encountered, provided the SWP regulatory and safety program components are not adversely impacted. Staff will keep the City Council alerted to similar issues that arise in the future, and steps taken to address them. A detailed analysis of the City's experience on these types of problems will be presented as part of any future rate discussion.
