HomeMy WebLinkAbout10/23/1973 Business Meeting '4 • October 23, 1973 The City Council met in session at 1:30 P.M. on.this date in the Conference Room at Yakima City Hall. • Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Howard C. Cole, Betty Edmondson,. Ralph Holbrook, Don Schussler and Bill Whitaker. Also present were City Manager Craig McMicken, City Attorney Fred Andrews, Director of Community Development Jay Otto, Administrative Assistant Dick Zais, City Clerk Iris Litzenberger, Russell Miller, Marilyn. Hudson and Stan Darling representing the press. Mayor Broad reported that one member of the news media•suggested having a news with news media and Council members.-possibly-between the study session and the Council Meeting a month: Council members gave their opinions and suggestions as to various times this might be held. After discussion Mayor Broad suggested that he talk with other members,of the news media to get further ideas. Councilman Edmondson suggested that the Council` indicate that they welcome the suggestion regarding the news - conference and that there is just the matter of working out the details. Council members concurred with the suggestion. City Manager McMicken referred the matter of consideration of an additional Assistant Attorney to City Attorney Fred Andrews who explained that this has to do partly with the need of the appointment of an arraignment officer-'. This position has been held in recent years by a member of•the Police personnel. The previous, arraignment officer has retired and the one filling in is about to retire. The Police Department needs this personnel • and prefers not to supply another officer for this duty.' City Attorney Andrews reported that this officer should really be an attorney representing the City in court on these arraignments and' that he can be used the rest of the time to help with other legal work in the Attorney's office. Council members concurring that another assistant attorney is needed, it was MOVED by Whitaker, seconded by Schussler that the Council approve this additional assistant attorney: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. City Manager McMicken referred to a copy of the letter which puts the city into court regarding the suit of Marshall- Wilson against the City on the matter of an outside utility hookup. It was MOVED by Schussler, seconded'by'Holbrook that the,Council's earlier.decisio) on the Play Pen.be affirmed with the intention that the City Attorney defend the City's - .position: carried,•Broad, Brown;, Cole, Schussler5and Whitaker voting aye by voice vote. Holbrook and Edmondson voting nay. • It was moved by-Cole, seconded by Brown, that the Council go into executive session at - 2:15.P.M.: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting' aye by voice vote. • • At 3:00 P.M. the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole,.`Edmondson, Holbrook, Schussler and Whitaker,-City Manager McMicken and City AttorneyAndrews- present on roll call. The Invocation was.given by Councilman Edmondson. The minutes of the .previous regular meeting of October 15., 1973, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor- declared said minutes approved.as'recorded. This being the time set. for the Hearing on the Rezone Application filed by Noel Investment Company, requesting rezone of property located. = 1515 Summitview Avenue from R -3, Multiple Family Zone to B -2, Local Business Zone, Director of Community Development, Jay Otto, being present, reviewed the Planning Staff•Report ;and•Planning Commission Minutes on this subject dated September 19 and October 2, 1973, respectively. He reviewed the proposed construction of a warehouse and rental office facility for this area, reporting-that no objections were received from in the adjacent apartment house •and recommended approval of the request.. After due discussion., it was MOVED by Brown, seconded by Whitaker that Ordinance No. 1576, accepting the'recommendation of the Planning Commission and rezoning said property, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye on roll call.. ORDINANCE NO. 1576, AN ORDINANCE accepting the.recommendation of the Planning Commission and rezoning certain property situated at 1515 Summitview Avenue in the City of Yakima, Washington, from.R- 3,.Multiple Family Zone•to B- 2.Local Business Zone. Damage Claims having been filed with the City'Clerk on: • a. October 16, 1973, by Michael D. Mecca, Route 8, Box 538, Yakima, in the amount. of $235.74, for personal injuries in connection with a fall -at the Washington swimming pool; b. October 18, 1973, by Robert C. Martin, 4602 Phaeton Place, Yakima, in the amount of $10.00, for property damage by a City refuse truck; c. October 19, 1973, by Jack U. Franklin, 814 East Spruce Street,.Yakima; in the amount of approximately $100.00 for property. damage in connection with an arrest being made by City Police, • it was MOVED by Schussler, seconded by Cole that said Damage Claims be referred to the City Manager for study and recommendation: carried, Broad, Brown, Cole, Edmondson, Holbroo and Schussler.voting aye by voice vote'. Referring to the proposed Ordinance prohibiting ;_parking on a portion of North 40th Avenue between Lincoln and Englewood; City Manager :McMi /cken explained action taken by the Council last year ina approving therfour lanes for 40th Avenue ''and reported that the paving is now-completed, but that the parking needs to be regulated before the striping for four ■ 41 " "' : - OCTOBE23,, 1973 lanes is.done. ORDINANCE NO. 1577, AN ORDINANCE'relat'in to traffic control; regulating parking; amending . section 9.75.040 of° the Cityof 'Yakima 'Municipal - Code;:. and .declaring: an emergency... City Manager McMicken referredto'the proposed Ordinance fixing.and levying the amount of ad valorem•taxes for explaining changes made in accordance with information received on this date from the County Assessor's Office.. He reviewed'the;various. purposes for which the tax revenues are made. It was - MOVED by Holbrook, seconded,by Brown that. Ordinance No. 1578, fixing and levying - said taxes for :1974, be passed: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler. - and - Whitaker voting'aye on roll call. ORDINANCE NO. 1578, AN ORDINANCE'fixing and the amount of ad valorem taxes necessary to balance estimated revenue with estimated expenditure 'for.the 1974,Budget for the City of Yakima. ' Mr. Lee Semon, being present, reportedto the Council on the Downtown,Advisory Redevelopment Commission request for professional assistance in developing an off - street parking' program. f He.reviewed the objectives of 'DARC in creating an L.I.D. for.off- street, parking in downtown Yakima and requested that a consultant be hired to help with setting up boundaries and assessments for the L.I.D. There was discussion by the Council in- regard to assistance from,the consultant regarding where parking should be placed. Mr. Semon further stated that the consultant would. work,with,the,Central Business .District Plan. Mr. Mike Mercy, also of DARC, being present, spoke to.the.matter of coordinating efforts by._the- ,consultant . and DARC in reference to where parking:'shouldt . be located. City•Manager•McMicken referred • to a report received from Jacobson and:'Associates, Consulting,Engineers, with whom the f Commission:has been in contact, and recommended the engagement of this firm for professional services needed in connection with forming the L.I.D. He.reported.that'parking revenues are being set aside for the purpose of hiring needed additional consultants. After due discussion, it was MOVED by Cole, seconded by Whitaker that:the request -from DARC for the engagement o.f professional services by Jacobson and Associates beauthorized, and that. - the City_ Staff be authorized to interview for additional professional services. as required: carried, Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting aye by voice vote. .City Manager- McMicken, referred to a failure in the heating system at Tire Station #2, reports- .ing that the old pipes would incur too much repair work and recommended the installation of a new furnace for the Alarm Center. It was MOVED by Edmondson, seconded. by Schussler that Resolution No. D -3029 `authorizing the purchase and installation of said •furnace without calling - forbids, be passed: carried,Broad, Brown, Cole, Edmondson, Holbrook, Schussler and Whitaker voting.aye on roll'call. ' RESOLUTION 'NO, D- 30:2.9., A'RESOLUTION authorizing.the.purchase and installation of•a furnace for the Yakima Fire Department Alarm without calling for •bids..: . • City Manager McMicken referred the proposed transfer of :;:Cahalan Park to.Parks Director,. Bill Hutsinpiller, who reviewed the present plans for conveying that park to the Town of. Union Gap. He'reported on the recommendations and approval indicated from::both.the,.Parks Commission.and Lions Club in'response to-this proposal. City Attorney Andrews on his review :of the deed'and the requirement. for the'conveyance plans to go . through Superior Court. City Manager McMicken reviewed'his.report - No: - 188,• concerning Landscaping. of Private Develop,- ment and referred the matter to'Director :ofiCommunity Development,.Jay Otto, who spoke. to the matter of several commercial properties now lacking adequate'landscaping. He reviewed the steps being taken by the Planning Commission for the., formation of a new zoning Ordinance to include a Precise Plan of. Design.with' provisions for implementation of landscaping. There was discussion by the Council of possible alternatives. in the event the landscaping. . . requirements are not•complied with. It was noted that this report is for information at this time and that,,ac.tion will not be taken` until after consideration of the Zoning. Ordinance. • Councilman Whitaker absent after 4:10.. City Manager.McMicken..requesting authorization for out -of -state travel for the following: a. Newell Pock, Chief Building Inspector,.to.travel.to Jacksonville, Florida to attend the annual conference of the Southern - Building Code Congress as President ' of the ;International `Conference of Building Officials, October 25, 1973, through November 2, 1973; ' .. • b. Fritz Jaeger, City Engineer, to travel t,o.P,ortland, Oregon, to meet with Burlington Northern P acific c . - Eng''ineering Staffs regarding final railroad billings on the Lincoln - "B' Street and Yakima Avenue projects and also to review agreements for the Walnut and "D" Street crossings,, October 17, and 18', 1973'; c. Lou Roeder::, Inspection Department, - to travel to Santa Cruz, California,, to . attend the 44th Annual. Internat - ional Association o.f.Plumbing and Mechanical Officials Conference, October 27, 1973,.through November 4, 1973, it was MOVED by Schussler, seconded'By Brown that said travel be approved and expenses paid: carried, Broad, Brown, Cole, Edmondson, Holbrook and Schussler voting aye by voice vote. It was noted that the trip for. Newell Pock will involve no City expense. I ® 42 . OCTOBER 23, 1973. OCTOBER 24, 1973 - OCTOBER 26, 1973 City. Manager McMicken referred to the item Agenda concerning plans for a Metropolitan Workshop on November 9, 1973, with the County and Chamber of Commerce. He explained the proposal for the engagement of Mr'. Bob Ellis of Seattle by phone to answer questions submitted by a selected panel. There was discussion by' the Council regarding several methods for conducting the workshop. Mr: McMicken indicated it would provide for a discussion of the Metropolitan Municipal Corporation act as it applies to Yakima. There was no formal action taken by the Council at this time. It_was MOVED by Cole, seconded Edmondson that`Mayor Broad be directed to write a letter of appreciation to Hoover and Lewis and Schools'for their.participation in connection with the litter control program being on this month: carried, Broad, Brown, Cole, Edmondson, Holbrook, and Schussler voting aye by voice vote. Councilman Holbrook requesting permission to be excused from the regular Council Meeting of October 29th and Councilman Cole requesting permission - to be excused from the Adjourned Regular Meeting of October 27th and the regular meeting on October 29, 1973, it was MOVED by Brown, seconded by Edmondson that Councilmen Holbrook and Cole be excused on those dates carried, Broad, Brown, Cole, Edmondson, Holbrook, and Schussler voting aye by voice vote. Councilmen present at the meeting were Mayor. Bert Broad, Wray Brown, Betty L. Edmondson, Ralph Holbrook, Don Schussler and Bill Whitaker. Councilman Howard C. Cole absent. Also present were George Solomon, Tony DiTommaso, Art Eichler, City Manager McMicken, Glen Koelling and Jack Daniel. - A general discussion took place regarding the method of refuse collection by private haulers, some aspects of public refuse collection, particularly relating to the M.B.R. System', and trends in.the industry in other parts of the count "r.y. No action was taken at this - tame.
