due to lack of a. quorum, no special meeting was held on this date.

The City Council met in special:session pursuant•to duenotice at.1:30 P.M.., November 6, .
1972, in the Conference Room at Yakima City Hall.. •
Councilmen present at the meeting were Mayor Bert Broad, Lenore Lambert, Jim
Lust, °.Walter Robinson,- Don Schussler and Bill Whitaker. , Also present were'City•Manager
McMicken, C-ity,Attorney- Andrews and Administrative Assistant Jim,Flint.
The Council commenced an initial study of the preliminary budget,.and made plans for
further reviews of the budget, including an all -day meeting to be held•Friday, November
10, 1972, at the Holiday Inn in Yakima. The City Manager filed with the City Council
information,previously requested by the Council pertaining to •labor.negotiations and the
union requests... -
The City Manager reported to the Council on meetings held the previous'week'with the '
Yakima Convention and Cultural Center Task..Force, and briefly discussed the work of various
'committees of the Task.Force.
The meeting, adjourned at'three•o'clock P..M.• -

. The Council then met in regular session at the hour of 3:00 P.M., Mayor Broad pre-
siding, Councilmen Brown, Lambert, Lust, Robinson, Schussler and Whitaker, City Manager
McMicken.and City•Attorney Andrews present on roll call..
The Invocation was given by City'Attorney Fred Andrews. .
The minutes of the special and regular_meetings :of October 30, 1972,•having been duly
certified accurate by two Councilmen., :and ,no one present wishing to have said minutes
read publicly; Mayor Broad declared said minutes. approved as recorded.

Petitions•No. -763, 764 and 765; having been filed with the'City Clerk on November 3, 1972,
by Wm. D. Rehfield, 'requesting improvement of property by construction'of a water main,
sewer, and curbs,. gutters and surfacing of.street on• Perry. :Street. =.west of 3rd .
it was MOVED by Robinson, seconded by Schussler that said petitions, for the creation of ,
Local . -•Improvement:.Districts,•be r-eferred•to•,the City Manager and Staff for study and •
• recommendation: carried, Broad,. Brown, Lambert,-Lust, Robinson,'Schussler•and Whitaker
voting aye by voice vote.
Petition No. 766, having been filed with the City Clerk on November 3, 1972, by Douglas
A. .and ;Feral:.P , Fellows and - :Chester R:. Kay Sonnabend; requesting - vacation -of a portion
of public right -of way including the Edgecliff•Manor cul -de -sac; it was 'MOVED by Robinson,
seconded by that Resolution . No. D -1953 fixing the time of hearing for December 11,

RESOLUTION NO. D- 1953,- A RESOLUTION fixing the time and place for hearing on a petition
' for vacation of :a-portion of•public.right of way.
• An Ordinance appropriating $57,389 in various funds to pay salaries and fringe benefits
•
. , for employees hired under the E.. E. A_Feder,al•grant.program,having been read in its
• entirety at this meeting, was laid on the table for one week or until November 13, 1972.
City Manager McMicken gave an explanation of this Ordinance, stating that these are PEP
employees for this -.year -that .were not :contemplated in the 19,72 budgets and .that -they. have
been-paid-by available, funds :within those budgets; but .that :a. new appropriationri2s now-
needed in the amounts shown in the Ordinance. .

ad valorem taxes for the 1973 budget and amending Ordinance No. 1446, passed October 2,

the amount of millage on the city property tax. assessments, since there are additional

In accordance with the Yakima.City Charter and State Statute,'City'Manager-McMicken••sub.-
mitted the ..preliminary , budge.t for the : City • of . yak ima ; ,f.or the. year .,197:3 , and reported• that

due notice will be given fixing the time for public hearing on the matter of the 1973
Budget for the hour of 3:00 o'clock P.M. on Friday, December 1, 1972, as required by
Statute. In a formal statement, Mr.. McMicken reported that the increase in this year's
budget is necessary in view of salary increases and more employees. He further stated
that because' of expected-Federal Revenue Sharing money, it will be .possible to again par-
ticipate in the plan'of setting aside $1 out of $2 in sales. tax for a capital improv:
ment fund, and that the Convention and Cultural Center and Shop- Warehouse facility may be
funded through Federal Revenue Sharing. Mr. McMicken reviewed the proposed City employee
wage increases for the last three months of 1972 and 1973 and stated that the Budget
increase includes'construction of two new fire stations, 2 swimming pools, and such things
as utilities and supplies. After due discussion, it was MOVED by Robinson, seconded by
- Lambert that the record show the filing of the 1973 Preliminary Budget: carried, Broad,
Brown, Lambert, Lust,. Robinson, Schussler and Whitaker voting aye by voice vote.
City Manager McMicken reviewed his-report No. 159 concerning the Englewood Reservoir
Landscaping and stated that he had filed a copy of this report with Mrs. Plath, the origi-
nal owner of the property. Mr. McMicken further reviewed the alternatives proposed by
Mrs. Plath to the original Landscape Plan and the deletions she desires. There was
. discussion as to surfacing, the top.of the Reservoir with Cermascape. After due discussion
it was MOVED by Robinson, seconded by Schussler that this matter be referred back to the
Staff for one week pending a report from Mr. McMicken on Mrs. Plath's agreement to the
proposed plan: carried,•.Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker
voting aye by voice vote.
It was MOVED by'Brown,.seconded by Whitaker. that Resolution No. D -1954, authorizing the
execution of a Jail Agreement Modification with Yakima County be passed as read: carried,
Broad_, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call.
City Manager McMicken explained the background of this agreement, stating that in 1966
the City had an agreement for $1.60 per day per prisoner and one again in 1971 for $2.25.
He further stated that earlier in the year the Sheriff had wanted an agreement for $5 and
that the city has been charged $2.75 instead of $2.25 since earlier this year, but that
the City will be credited with back pay. After due discussion, it was MOVED by Brown,
seconded by Whitaker that Resolution No. D -1954, authorizing execution of a Jail Modifi-
cation agreement for $3.50 per day per prisoner be passed as read: carried, Broad, Brown,
.Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D -1954, A RESOLUTION authorizing and directing,.the City Manager and City
Clerk of the City of Yakima to execute a Jail Agreement - Modification with Yakima'County,
Washington.
It was MOVED by Brown, seconded by'Schussler No,. D-1955, authorizing
application to the State of Washington Traffic Safety Commission for a grant to purchase
two portable radar units be passed as read: carried, Broad,.Brown,.Lambert, Lust, and
Schussler voting aye on roll call; Robinson and Whitaker voting nay on roll call. City
Manager McMicken explained that Police Department is requesting these portable units
for speed measurements in•'areas where it is especially difficult with a mobile unit, at
a total cost of $2300, which would be funded through State and Federal Funding. Mr.
McMicken further referred to a letter of request and recommendation for these units from
.Police Chief,•Jack LaRue and.stated that the proposed purchase has the endorsement of the
local Traffic Commission.- Councilman Robinson expressed his feeling' that these would not
accomplish what hoped for in a safety measure.
RESOLUTION NO: D -1955, A RESOLUTION authorizing and directing the City Manager of the City
of Yakima to apply to.the -State of Washington Traffic Safety Commission for a grant to
purchase portable radar units.

City Manager McMicken referring to the matter of authorization to accept a grant of real
property from the State.of Washington, explained that this property that is being deeded
to the City of.Yakima is in conformance with a Governor's Deed from the State of Washingto
and in connection with 12, Naches to Jacobson and SR 12 (PSH 5), Gleed Vicinity - D -347
He further-explained:-that the recording fee for the deed is $10, the proper signatures are
requested and the Deed is to be approved as to form and returned -to the Highway Commission
After due discussion, it was MOVED by Robinson, seconded by Lust that Resolution No.
D -1956; authorizing the acceptance of said grant of real•'pro,perty from the State of
Washington, be passed as read: carried, Broad, Brown, Lambert,.Lust, Robinson, Schussler
and Whitaker voting aye on roll call.

City'Manager McMicken referred to the matter of authorization'to pay for extra 'work for
remodeling the City .Council Chambers,' without calling for bids and described the extra
work that was done. After due discussion, it was MOVED by Robinson, seconded by Whitaker
that Resolution No. D -1957, authorizing payment. for said work, be passed as read: carried
Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D- 1957; A RESOLUTION authorizing payment without calling for bids for extra
work performed.in connection with remodeling the Council Chambers in Yakima City Hall.
It was MOVED by Lust, seconded by Robinson that Resolution No. D -1958, authorizing payment
for City Hall without' calling for bids be passed as read: carried, Broad,
Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting aye on roll call. City
Manager' McMicken stated that these are signs being done by a Seattle architect and several
revisions have been made, necessitating a delay in their arrival.
RESOLUTION NO D -1958, A'RESOLUTION'authorizing payment for City Hall Directory signs
without calling 'for bids.
City Manager McMicken referred to the matter of authorization to purchase right of way
property for 40th' Avenue improvements and reported that offers to sell have been received
from Ella May Wade in the amount of $25 and Saint Timothy's Parish in•the amount of
$5,161.50. After due discussion, it was MOVED by Robinson, seconded by Lust that Resolu-

RESOLUTION NO. D -1959, A RESOLUTION authorizing the purchase of right of way property for
40th Avenue improvements.
Mayor Broad reported 'a noticeable rise on either side of the railroad crossings on•Lincoln
and B Streets and asked Public Works Director, Dave Vargas, for an explanation. Mr. Varga..
explained possible causes of these rises and indicated that they would like - .to wait for
the materials used in the track project to settle before doing further work on.them.

it was MOVED by Robinson, seconded by Lambert that the report of the City Treasurer dated
• October 31, 1972, regarding the investments of the City•of Yakima, be accepted and
approved: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting
aye by voice vote.
Mayor Broad made brief comments as to the need for a public.address system in.the Council
Chambers, as requested previously at a cost of approximately $1,100-$1,200, since there
have been complaints from some people sitting in the back of the Chambers at Council
meetings. No formal action was taken by the Council at this time.
There being no further business to come before the Council, it was MOVED by Lust, seconded
by Whitaker that we do now adjourn at the hour of 4:20 P.M.:.... Broad, Brown,
Lambert, Lust, Robinson, Schussler and Whitaker voting aye by voice vote.

The City Council met in special session pursuant' to due notice at 9:00 o'clock.A.M.,
November 10, 1972, at the Holiday Inn, Yakima, Washington.
Councilman present were Mayor Bert Broad, Wray Brown, Lenore- Lambert,_ Jim Lust, Walter
Robinson, Don Schussler and Bill Whitaker. Also present was City Manager Craig McMicken.
The purpose of the meeting was to review the 1973 Preliminary Budget with the City,
. Manager and City Department Heads. •
The meeting adjourned'•at 9:00 o'clock P.M.
