APRIL 13, 1970 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, Lust, McNeice and City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lust. The minutes of the regular meeting of April 6, 1970, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on Resolution of Intention No. D -1457, to make certain improvements adjacent to Yakima Mall, and City Attorney Andrews explaining that the Mall Association is still working on some legal paper work and requesting that this matter be continued, it was MOVED by Robinson, seconded by McNeice that this Hearing be continued for one week: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. A Damage Claim having been filed with the City Clerk on April 8, 1970, by Lloyd Dorr, 3902 West Walnut, in the amount of $1,976.93, for damages caused by a sewer backup, it was MOVED by Keith, seconded by that said damage claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. An Ordinance appropriating $10,300 from Current Expense to the Planning and Community Development Department, having been read in its entirety on April 6, 1970, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Keith that Ordinance No. 1218 providing for said appropriation, be passed as read: carried, Brown, Keith,; Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1218, AN ORDINANCE appropriating the amount of $10,300 from unappropriated anticipated revenue to the Current Expense Fund to various classifications and accounts in 104- Department of Planning and Community Development. It was MOVED by Robinson, seconded by Brown that Ordinance No. 1219 authorizing . legal proceedings for the condemnation of right -of -way for improvement of South 24th Avenue, be passed as read. City Attorney Andrews explaining that since preparing this Ordinance, it has been brought to his attention that some of the legal description was inadvertently left out, and suggesting . that this Ordinance be amended to include the additional legal description, it was MOVED by Keith, seconded by Robinson that said Ordinance No. 1219 be amended to include the additional legal description as read: carried, Brown, Keith, Lam- bert, Larson, Lust, McNeice and Robinson voting aye by voice vote. It was then brought out that a portion of the previous description as read is in error, and after checking this with Public Works Director John Mayo, City Attorney Andrews suggested that the Ordi- nance be further amended to make the correct changes in the legal description. After due discussion, it was MOVED by Robinson, seconded by Keith that Ordinance No. 1219 be further amended to inc -dude the corrections as read: carried, Brown,. Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. Mayor Larson then called for the roll call vote on the Motion to pass Ordinance No. 1219 as amended: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1219, AN ORDINANCE authorizing and directing the City Attorney of the City,of Yakima to institute and prosecute legal proceedings for the condemnation and acquisition of real property for the widening and improving of a portion of South 24th .Avenue, includ- ing the reconstruction of an existing bridge constituting a portion of South 24th Avenue across Wide Hollow creek, and for the installation of curbs, gutters, sidewalks, drainage facilities and public utility facilities related thereto, for changing the grade of a por- tion of South 24th Avenue, and for acquiring necessary slope and fill easements from abutting land in connection with such widening and improving; providing for the condemna- tion and taking of such real property and declaring the condemnation and taking thereof to be. necessary for a public use required by public interests; directing that compensation for such taking be paid from the Urban Arterial Fund of the City of Yakima; and declaring an emergency. A report having been received from the Planning Commission recommending that.the "General Plan for the City of Yakima" be amended by adding as a supplement thereto, two volumes entitled Land Use Plan for Nob Hill Boulevard and Land Use Plan for Vicinity of Yakima Valley, College, it was MOVED by Robinson, seconded by Lust that May 18, 1970, be fixed as the time for a Hearing on said matter: ca- rried, Brown, Keith, Lambert, Larson, Lust, . McNeice and Robinson voting aye by voice vote. A letter having been received from the Yakima Valley Regional Library expressing apprecia- tion for increased financial support by the City, due to new local sales tax, City Manager McMicken stated that this is presented for information, and although it had been hoped that there would be a like response from other jurisdictions, no others have made like offers of increased financial support to the Yakima Valley Regional Library. City Manager McMicken referred to a letter from Western Marketing Affiliates, Inc., re- questing the renaming of East Lenox Avenue to Ranch Rite Road, which explained that this business is the only one on East Lenox Avenue that would use that as an address, and that the other businesses and residences use either South 1st Street or East Nob Hill Boulevard as addresses. Mr. Charles M. Daniel, President of Western Marketing Affiliates, Inc., being present, explained that the trade mark for their ranch and farm products is Ranch Rite, and that he had contacted all the property owners concerned and there were no objec- tions to this name change. Council members indicating that they would like to be sure that all the property owners are in favor of the requested name, it was MOVED by Robinson, seconded by Brown that this matter be continued for one week in order that all property owners may be informed of a hearing . to be held at that time on this matter, to give them an opportunity to join in the request for this name change if they wish, in writing, or at the meeting: carried, Brown, Keith, Lambert, Larson, -Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken explaining that there is space available to lease in the Weather Bureau Building at Yakima Municipal Airport and that the Broadway= Ahtanum Community Center desires to lease said space, it was MOVED by Robinson, seconded by McNeice that 1. (continued) APRIL 13, 1970 . • Resolution No. D -1472 authorizing the execution of a lease agreement with Broadway - Ahtanum Community Center for space in the Airport Weather Bureau Building., be passed as read: carried,,._ Keith, Lambert, Larson,. Lust,. McNeice and Robinson voting aye on roll call. Discussion brought out that this space has been vacant for some time, and although it would be preferable to have an aircraft oriented business, the lease has been prepared so that the tenancy created is a month to month tenancy, subject to thirty day notice in writing by either party, which would make it possible to rent to an aerial oriented business, should one desire to rent this space in the future. RESOLUTION NO. D- 1472, A RESOLUTION authorizing and directing. the. City Manager and the City Clerk of.the City of Yakima to execute a lease agreement with Broadway- Ahtanum Community Center for space in the Weather Building at the Yakima Municipal Airport. City Manager McMicken referred to the request for outside City domestic sewer service, by Harvey M. Paulson, Wallace E..McCarger. and Others, and explained that this request is for sewer service for McCarger's West Side Tracts, a Plat containing 43 lots. He further ex- plained that the City -=s statement of policy regarding utility service outside the corporate • limits of the City of Yakima states that properties contiguous to existing city limits should annex prior to receiving service and that Mr. Paulson and the other individuals in- volved in this request have stated that they no objection to annexation and the only reason that this matter has been brought on as a utility request is that the Planning Staf -f is presently attempting to promote a larger annexation in this general area. City Manager McMicken stating that an outside hookup agreement has been signed by the appli- cants -and recommending that this request be approved, it was MOVED by Lambert, seconded by Brown that this outside utility service allowed:. carried, Brown,- Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken referred to his Report #78, 1970 Street Maintenance Program,and.the attached by the Department of. Public Works, concerning the seal coating program for the coming summer. He stated that these reports are submitted for information only and no action by the City Council is necessary as funds are already budgeted for this yearly pro- gram. City Manager McMicken stated that the Annual Report of Water,- Sewer•Utility Department and the attached Recapitulation are submitted for information only and no action on this matter .is required. City Manager McMicken gave a report on the new developments in property taxes and reviewed the Washington State Research Council report on this matter. • Councilman Robinson excused after 4:30 P.M. City Manager McMicken stated that the Yakima City Creamery, Inc., wishes to add two stalls to their car wash and would need to erect part of thisstructure over a City utility ease - ment, which street was vacated some time ago for Davis High School. He reported that all departments involved have been contacted and there seems-to be no objection to allowing this request, but it was suggested that in case at some future time, there would be a change in this area and a need to use a portion of this vacated street to repair or put in some utility,.that a revocable permit be issued to this effect. After due discussion, it was MOVED by Keith, seconded by McNeice that this request by Yakima City Creamery, Inc., to erect a structure over City Utility easement be granted upon the authorization of the preparation of a revocable permit for the construction over said vacation: carried, Keith, Lambert, Larson, Lust, and McNeice voting aye by voice vote. Brown voting nay by voice vote. Robinson absent. \ City Manager McMicken stated that. Fire Chief Jules Shockley reports that the Rating .C Bureau intends to begin a re- rating of the City's fire defenses. He further stated that 0' the last rating was done in 1951,-with a supplemental in 1959, which rated Yakima a third - .class City at that time. Councilman Lust excused at 5:00 P.M. City Manager McMicken referred to a letter received from the Yakima County Conference of Governments requesting an increase in the City's contribution to the budget for 1970 in an amount based on $ .10 per capita. Councilman Lambert spoke in favor of the additional funds and stated that through the Conference of Governments, there has been a greater cooperation with the County"in many matters. Council members discussed the matter of $.10 per capita for the balance of since a portion of the budget year has already elapsed, and indicated that they are in favor of this request, with the amount to be figured for the balance of 1970. After due discussion, it was MOVED by Lambert, seconded by Keith that the matter of increasing the City's contribution to the Yakima County Conference of Governments on.a $ .10 per capita basis for the b4,1,ance of 1970 be approved, and that at the time of preparing the'1971 budget, this matter on for further study in connec- tion with appropriating the funds for this contribution: carried, Brown,. Keith,: Lambert, Larson and McNeice voting aye by voice vote. .Lust and Robinson absent. City Manager McMicken requesting out -of -State travel for James Eakin, Airport Manager, to a meeting in Vegas, Nevada, May 11 to 15, 1970, it was MOVED by Lambert, seconded by Brown that said travel be allowed with expenses paid:. carried, Brown,. Keith,•Lambert, Larson and McNeice voting aye by voice vote. Lust and Robinson absent. Councilman Lambert asking to be excused from the next two Council meetings of April 20 and 27, 1970, it was MOVED by McNeice, seconded by Keith that Councilman Lambert be excused: carried, Brown,.
