Councilman Robinson, acting as Chairman, asked for nominations for an Acting Mayor, since Mayor Larson and Assistant Mayor . Brazier were absent from this meeting. It was MOVED by Lambert, seconded by Lynch that Councilman Robinson be elected Acting Mayor for this meeting: carried, Brown, Lambert, Lynch and Robinson voting aye by voice vote.. Brazier, Kurbitz and Larson absent. Acting Mayor Robinson, Councilmen Brown, Lambert and Lynch, and Acting City Manager Andrews were present on roll call. Councilmen Brazier, Kurbitz and Larson were absent on roll call. City Manager Smith and Mayor Larson were excused at the Council meeting on October. 17, 1966 It was MOVED by Brown, seconded by Lynch that Councilmen Brazier and Kurbitz be excused . from this meeting: carried, Brown, Lambert, Lynch and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of October 17, 1966, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Acting Mayor Robinson declared said minutes approved as recorded. An Ordinance appropriating $31,420 from the Cumulative Reserve Fund for Domestic Water Supply Development in the 1966 Budget for Water -Sewer Fund, for installation of a 16 -inch domestic water supply main on Washington Avenue for transmission of water from the Air- port well to the City's distribution system, having been read in its entirety at the regu- lar meeting on October 17, 1966, and being read by Title only at this meeting, it was MOVED by Lynch, seconded by Brown that Ordinance No. 841 providing for said appropriation, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. ORDINANCE NO. 841, AN ORDINANCE appropriating the amount of $31,420 from unappropriated monies in the Cumulative Reserve Fund for Domestic Water Supply Development to Account 520 - 930, Other Structures and Improvements, of the Capital Outlay classification, in the 1966 appropriation for 520, Water - Sewer Fund. This being the time fixed for the Hearing on Petition No. 479, as filed by Mr. and Mrs. Earl J. Olson and Mr. and Mrs. Edward L. Daniel, requesting annexation of .property located at the northwest corner of Englewood Avenue and 58th Avenue, it was MOVED by Lambert,• seconded by Lynch that Ordinance No. 842 providing for said annexation be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. ORDINANCE NO. 842, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -1, One- Family Zone. . This being the time fixed for the Hearing on Petition No. 484, as filed by Mr. and Mrs. Pete Calza, requesting annexation of property located at the southwest corner of Laurel and North 6th Avenue, it was MOVED by Brown, seconded by Lynch that Ordinance No. 843 pro- viding for said annexation, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. ORDINANCE NO. 843, AN ORDINANCE providing for the annexation by the City of Yakima of cer- tain property contiguous to the City of Yakima and zoning the same as R -2, Two - Family Zone. This being the time fixed for the Hearing on Petition No. 486, as filed by Mr. and Mrs. Albert Bales, requesting annexation of property located between Mead Avenue and Loren Ave- nue, and West of South 18th Avenue, it was MOVED by Lynch, seconded by Brown that Ordinance No. 844 providing for said annexation, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. ORDINANCE NO. 844, AN ORDINANCE providing for the annexation by the City of Yakima of cer- tain property contiguous to the City of Yakima and zoning the same as R -2, Two - Family Zone. Acting Mayor Robinson extended the Council's welcome to Sister Marie Emile and approximatel 20 students in her City Government Class at St. Joseph's Academy, and invited them to stay after the regular meeting to ask questions of Council members. This being the time fixed for the Hearing on Petition No. 487, as filed by Bruce Rose and Others, requesting annexation of property between Nob Hill Boulevard and Mead Avenue, and First Street and the West right -of -way of the Union Pacific Railroad, it was MOVED by Brown, seconded by Lambert that Ordinance No. 845 providing for said annexation, be passed as read. Mr. Riley Williams, property.owner within the area to be annexed, stated that he objects to being annexed to the City and that he wishes this fact to be so stated in the minutes. Mr. Allen Fortier, Attorney, stated that he is representing the Morton Supply Company, who also wishes to go on record as objecting to being included in the annexation. Council members indicated that since this was the first indication of any objection and the Planning Commission has recommended this annexation, and that the Petition No. 487 was signed by property owners with 93% of the assessed valuation of this property, when the law requires only 75% of the assessed valuation in favor of annexation, they do not feel that it would be good to delete these two parcels of land as requested by the two property owners objecting. After due discussion, Acting Mayor Robinson asked for the roll call vote on the Motion to pass Ordinance No. 845 as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. ORDINANCE NO. 845, AN ORDINANCE providing for the annexation by the City of Yakima of cer- tain property contiguous to the City of Yakima and zoning said property. In accordance with action taken at the regular meeting of October 17, 1966, it was MOVED by Lynch, seconded by Lambert that Ordinance No. 846, relating to L.I.D. No. 960, and. creating L.I.D. No. 960 -1, North 56th Avenue and Others Paving, and amending Ordinance No. 831 creating said District, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. Acting Mayor Robinson explained that Ordinance No. 846 amends Ordinance No. 831 by deleting Alley Block 24 and a portion of Garrett Street, which were proud oat in writing, and by changing other section - because Petition No. 434 was filed before the rate of interest was changed on L.I.D. bonds; improvement under Petition No. 434 is to be covered by L.I.D. No. 960 -1 and will carry the interest rate of 4 %; all other Petitions will be covered by L.I.D. No. 960 and bear the interest rate of 5%. . 220 OCTOBER 24, 1966 ORDINANCE NO. $46, AN ORDINANCE relating to Local Improvement Districts and amending Ordinance No. 831, passed. September 12, 1966, entitled "AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; estab- lishing a Local Improvement District, providing for the method of payment thereof, and III creating a special fund ". MOVED by Lambert, seconded by Brown that Resolution No. D -1013 vacating an easement for a water main across a portion of the Lewis -Terry Garden Tracts, requested by the Northern Pacific Railway Company, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. Frank Stein, Director of Public Works, explained that although there may be an old wooden line that hasn't been used for years within this easement, the City of Yakima has never had a water main within this easement and he does not anticipate any need for this easement strip in the future. RESOLUTION NO. D -1013, A RESOLUTION vacating an easement for a water main across Lots 2, 3 and 4.of The Lewis -Terry Garden Tracts in the County of Yakima, Washington. MOVED by Lambert, seconded by Brown that Resolution No. D -1014 transferring $500 within the City Hall 1966 Budget, to provide for a relief telephone operator and other temporary or relief help around City Hall for the balance of 1966, be passed as read: carried, Brown, Lambert, Lynch and Robinson voting aye on roll call. Brazier, Kurbitz and Larson absent. RESOLUTION NO. D -1014, A RESOLUTION transferring the amount of $500 within the 1966 approp- riation for 10$ - City Hall. . Acting City Manager Andrews stated that the campaign for Initiative No. 266, (Sales Tax Sharing by Cities) which is on the November $, 1966 ballot, is now under way and that stickers, signs and pins are available. There being no further business to come before the Council, it was MOVED by Lynch, seconded by Brown that we do now adjourn at the hour of 4:00 P.M.: carried, Brown, Lambert, Lynch and Robinson voting aye by voice vote.
