Call to Order
Chair Liddicoatcalled the meeting to order at 3:02p.m.

Staff Announcements–Planning Manager Calhoun announced the following:
Land use fees will increase by 3.5% beginningJanuary 1, 2024
The latest data available, as of November 2023, 323 new dwellings have been granted
permits,and certificates of occupancy have been issued to 354 new dwellings. This
marks the first time that the number of certificates of occupancy has exceeded the
number of permits issued since recording began.
November 8, 2023,Meeting Minutes–It was motioned by Commissioner Placeand seconded
by Commissioner Monickto approve the meeting minutes of November 8,2023,as presented.
The motion carried unanimously.
ADU Pre-Approved Plans–Calhoun explained how one of the Housing Implementation Plan
strategies was to look at ADU pre-approved plans. An ADU RFQPprocess was undergone and
the only response submitted was from James Guerrero Architects based out of Lakewood,
Washington. They met all requirements based on their submittal as assessed by the purchasing
department. He answered questions the commissioners had. Chair Liddicoat commented about
the lack of local firms' responses to the RFP and the high cost of the ADUs submitted. He believed
the RFP might have been the issue for the lack of local response. The commission discussed
what could be done to elicit more responses. Calhoun advised the commissionthey could
restructure the RFQ process and try again. Chair Liddicoat suggested including the commission
in the restructuring.
Text Amendments –Mixed Use/Downtown Development –Calhoun reviewed the examples
of various cities in the packet and requested feedback from the commission on including similar
language in the code.The commission discussed adding a landscaping requirement. Chair
Liddicoat added he likedthe terminology the City of Richland has regarding fencing.
Commissioner Hughes-Michel said she liked the idea of parking being on the side or in the back
that the City of Kennewick required. Calhoun informed the commission that he would seek
landscaping recommendations from the Tree Board.Chair Liddicoat also suggested a definition
of what a landscaping buffer is.

Adjourn–A motion to adjourn toJanuary 10, 2024,was passed with aunanimous vote. The
meeting adjourned at approximately 3:45p.m.

Subdivision Update

1. Bond In-Lieu
The first approval in the Preliminary Short Plat/Long Plat process includes a decision
with various requirements such as frontage improvements and utility connections. Before
the Final Short Plat/Long Plat can be signed off by the City Engineer and Subdivision
Administrator, those requirements have to be completed or bonded for.
There are currently two locations within the Subdivision Ordinance that discuss this
process, which are not consistent. The following changes remove ambiguity in the
interpretation of multiple code sections by providing consistency and clarification by
outlining the process and review criteria in a single section.
14.05.200 Allowance of bond in lieu of actual construction of
improvements prior to approval of short plat or final plat.
A. The subdivision or short subdivision applicant may request, as an alternative to actual construction of
any required improvements, provide that they be allowed to provide a surety bond or other secure
method providing for and securing to the city the actual construction of required improvements within a
specified period of time and expressed in a bond or other appropriate instrument establishing such
security. Any bond or other method of securing actual construction of required improvements authorized
and approved pursuant to subsection B herein shall specify the improvements covered and the schedule
for completion.
B. In cases of subdivision or short subdivision, the request for bond or other method of securing actual
construction of required improvements shall be subject to approval by the city engineer and city attorney
prior to approval of the final plat by the administrator and cannot be appealed. In cases of short
subdivisions, the bond or other method of securing actual construction of required improvements shall be
subject to approval by the city engineer and city attorney prior to approval of the final short plat by the
administrator and cannot be appealed. The decision to approve or deny the request for the bond or
other method of securing actual construction of required improvements by the city engineer and city
attorney cannot be appealed. In no case shall the amount of the bond or other method of securing actual
construction of required improvements be less than one hundred ten fifteen percent of the estimated
actual cost of the improvements based upon the approved civil engineering design of the required
improvements.
14.20.130 Preliminary platAllowance of bond in lieu of actual
improvements prior to approval of final plat.
A. As an alternative to construction of required improvements prior to final plat approval, the
subdivision applicant may request to obtain provide that they be allowed to provide a surety bond or
other secure method acceptable to the city council engineer and city attorney pursuant to YMC 14.05.200.
.The request shall be approved or denied in accordance with YMC 14.05.200. which provides for and
secures to the city the actual construction of the improvements.
B. The value of the bond or security shall be one hundred ten percent of the estimated cost of the
improvements. The estimated cost shall be based upon the approved civil engineering design of the
required improvements.
C. An application for use of a surety bond or other method of security shall be made to the city engineer
and shall describe the method of security to be provided and the estimated cost of the required
improvements. The application, including the estimated cost of improvements and the general terms of
the security agreement, shall be subject to review and approval by the city engineer and the city attorney,
who shall notify the subdivision applicant of tentative approval or rejection of the application within
fourteen days after its filing and cannot be appealed.
D. After tentative approval of an application has been given by the city engineer and the city attorney as
provided in subsection C of this section, the subdivision applicant shall submit the bond or other method
of security to the city engineer for final review and approval.

In 2023 we saw a significant increase across the board for Certificate of Occupancy issuance.
This was also the first year since we began tracking both statistics where there were more C-of-
O’s than issued building permits.

5.Submitted Planning Applications
The drop inapplication numbers can be attributed to a policy change implemented in January
2023. Toward the end of 2022, staff departures left the Planning Division with one Senior
Planner and the Planning Manager. In order to maintain adequate processing times for
submitted applications, Class 1 Home Occupations were approved at the Business License
workflow step instead of being logged in and processed as a separate Type 1 review. To
maintain necessary approval criteria, a form letter was developed that includes all the necessary
conditions applicable to Home Occupations which is sent out after the Business License is
approved.
