A RESOLUTION amending CDBG Recipient agreement between the City of Yakima and
City of Yakima Public Works, A Division of the City of Yakima.
WHEREAS, the City of Yakima authorized an Agreement with the City of Yakima Public
Works for Community Development Block Grants (CDBG) funds that were made available
through the United States Department of Housing and Urban Development (HUD) on
December 12, 2023 (R-2023-177); and
WHEREAS, the City of Yakima Office of Neighborhood &Development Services (ONDS)
obligated $260,000 funds to improve the Heating, Ventilation, and Air Conditioning (HVAC)
systems at Henry Beauchamp Jr Community Center and Washington Fruit Community Center;
and
WHEREAS, the Washington Fruit Community Center requires additional fund amount of
$126,280.03 for HVAC costs where the lowest bid was higher than expected due to increasing
costs in materials and equipment; and
WHEREAS, the City Council finds that it is in the best interests of the City of Yakima and
its residents to authorize the increase of the total amount from $260,000 to $386,280.03 in
CDBG money to fund the HVAC improvements at Henry Beauchamp Jr Community Center and
Washington Fruit Community Center, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute an Amendment to Agreement with
City of Yakima Public Works, in the total amount of Three Hundred Eighty-Six Thousand Two
Hundred Eighty Dollars and Three Cents ($386,280.03) in Community Development Block
Grant funds to improve the HVAC systems at the Henry Beauchamp Jr Community Center and
Washington Fruit Community Center. A copy of the agreement and scope of work is attached
hereto.

AMENDMENT TO CDBG RECIPIENT AGREEMENT BETWEEN THE CITY OF YAKIMA AND
CITY OF YAKIMA PUBLIC WORKS, A DIVISION OF THE CITY OF YAKIMA
THIS AMENDMENT TO THE AGREEMENT is entered into this 19 day of am_ , 2024,
by and between the City of Yakima (hereinafter referred to as the "Grantee") and City of Yakima
Public Works, a division of the City of Yakima seeking to utilize CDBG-CV funds for allowable
services(hereinafter referred to as the "Recipient").
RECITALS:
WHEREAS, the City of Yakima authorized an Agreement with the City of Yakima Public
Works for Community Development Block Grants (CDBG) funds that were made available
through the United States Department of Housing and Urban Development (HUD) on
December 12, 2023 (R-2023-177); and
WHEREAS, the City of Yakima Office of Neighborhood Development (ONDS) obligated
$260,000 funds to improve the Heating, Ventilation, and Air Conditioning (HVAC) systems at
Henry Beauchamp Jr Community Center and Washington Fruit Community Center; and
WHEREAS, the Washington Fruit Community Center requires additional fund amount of

NOW, THEREFORE, it is agreed between the parties hereto as follows:
Section 1: Amendment to the December 12, 2023 Agreement
Section 1: Section 3: Budget, shall be amended to read as follows:
3. BUDGET:
Funding in an amount not to exceed Three Hundred Eighty-Six Thousand Two Hundred
Eighty Dollars and Three Cents ($386,280.03) will be reimbursed for items related to the
Scope of Service.
All funds shall be disbursed as part of the program.
Section 2: All other contractual terms remain. Aside from the specific amendments listed in
Section 1, all other terms, conditions, requirements, and obligations outlined and agreed to in
the Agreement Between the City of Yakima and City of Yakima Public Works, A Division of the
City of Yakima, dated December 12, 2023, remain in full force and effect and are not altered or
amended unless specifically set forth herein.

Any provision of this Agreement which imposes an obligation after termination or expiration
of this Agreement shall survive the term or expiration of this agreement and shall be binding
on the parties to this Agreement.

Scope of Work
Henry Beauchamp Jr Community Center Scope of Work
Remove the old 4-ton rooftop packaged unit, dispose of it and replace with one new 4-ton rooftop
packaged unit.
Work to include curbing, an economizer, high and low voltage electrical, gas piping, permits and
crane to remove old unit and set new unit on the roof.
All work is to be done in accordance with the Manufacturer's Instructions, Industry Standards, and
Specifications as presented by the City of Yakima.
Washington Fruit Community Center Scope of Work
Replace and modify the existing heating, ventilating, and air-conditioning (HVAC) systems on the
roof of the Washington Fruit Community Center, installing new roofing on the Community Center,
as well as other related work all in accordance with the Specifications as prepared by the City
Engineer of the City of Yakima.

SUMMARY EXPLANATION:
The City of Yakima authorized an Agreement with the City of Yakima Public Works for
Community Development Block Grants (CDBG)funds that were made available through the
United States Department of Housing and Urban Development (HUD)on December 12, 2023
(R-2023-177). The Office of Neighborhood & Development Services obligated $260,000 funds
to improve the Heating, Ventilation, and Air Conditioning systems at Henry Beauchamp Jr
Community Center and Washington Fruit Community Center. The agreement includes an
amendment to increase the fund amount by$126,280.03 for the WFCC HVAC costs that came
in at a higher than expected bid amount due to increasing costs in materials and equipment. The
amended agreement has been attached for City Council review.
