HomeMy WebLinkAbout05/18/2010 10 Naches Parkway Denial for Usage Appeal - Friday Night Live BUSINESS OF THE CITY COUNCIL -. , • YAKIMA, WASHINGTON AGENDA STATEMENT Item No. For Meeting of May 18, 2010 ITEM TITLE: Consideration of Appeal of Denial for Usage of the Naches Parkway South of Yakima Avenue SUBMITTED BY: Chris Waarvick, Public Works Director Ken Wilkinson, Parks & Recreation Manager CONTACT PERSON/TELEPHONE: Ken Wilkinson, Parks & Recreation Manager (575 -6020) SUMMARY EXPLANATION: The attached letter from Attorney Don Boyd, representing Friday Night Live, requests that Council consider an appeal of the denial of usage of the Naches Parkway south of Yakima Avenue for their homeless nutrition program. Staff considers this program an important and worthy activity provided by Friday Night Live, a non - profit corporation. This activity has been going on since 2008 as the attached documents show. However, issues emerged in 2009 that demonstrated that the intense usage of this • narrow parkway made alternative accommodations and changes necessary. Even in the letter from the proponents, one can see the wonderful success of the program (500 - 600 people each Friday evening) challenges this narrow space bounded by urban traffic on each side. Additionally the proponents were parking up to 8 - 9 vehicles and trailers on the parkway to bring supplies and food to this very worthy program. • We began getting calls last fall about the intensity of this usage and whether it was appropriate. The Parks Division Manager has been working with the proponents since that time to find an alternative site. This appeal to the City Council is somewhat mystifying to staff because it appears as though the proponents have agreed to the usage of Miller Park as an alternative site (see attached approved permit for Miller Park with a beginning date of June 4, 2010.) The proponent correctly observes that initially one of our front desk staff approved the 2010 application for the permit for the parkway. The Parks Manager, however, had at the same time been in contact with the proponents describing why this site was no longer appropriate and was working with them to find a new ";site. To resolve the misunderstanding, the Division Manager sent to the proponents a letter reversing the permission granted in error. Friday Night Live requests that it be included in the City Council Agenda for the meeting on Tuesday, May 18, 2010 to address this request. Friday Night Live began operations several years ago as.a Christian outreach program to feed the homeless and hungry in Yakima. It began its operations by serving meals to the homeless and hungry in the park area on South Naches Avenue between East Chestnut and East Walnut Streets. Friday Night Live obtained the necessary park permits for its use of the area for the past few years. I attach a copy of the 2009 Park Permit Application that received approval (Attachment 1). Friday Night Live has enjoyed great acceptance of its program during its tenure from both the local community and the residents of the area, as shown on the attached article from the Yakima Herald — Republic. (Attachment 2). • In April 2010, Friday Night Live submitted its Application for Park Permit for the 2010 year. This Application was initially approved. (Attachment 3). 1101 After approval, Friday Night Live was notified that the 2010 Application was • Ms. Deborah Moore and Mr. Ken Wilkinson May 12, 2010 Page2of2 . • denied. (Attachment 4). Friday Night Live requests explanation of the denial and also reconsideration of the denial. • The activities of Friday Night Live are strongly supported by residents of the area and by the homeless citizens of Yakima. The location of its operations is important for its continued positive influence in Yakima, and specifically to the specific neighborhood in which its activities have been conducted. Friday Night Live serves between 500 and 600 meals at each event. These meals and the community message expressed at the event are important to • the persons being served. Comments received by Friday Night Live from the neighbors and persons served show that Friday Night Live is making changes that improve all of Yakima, and the specific neighborhood. A Public Records Request is being submitted in conjunction with this correspondence requesting copies of all records relating to the denial of its 2010 Application for Park Permit. I am in favor of the council issuing a permit for Friday Night Live to feed the homeless at the downtown Naches Park in front of Saint Michaels. Even though they are homeless people, they still are citizens of this country and they need help. The people volunteering for Friday Night Live have given selflessly to assist in the feeding, clothing and rehabilitation of the many people who are in the streets. They clean up after their group, they bring their own tables and they actually alleviate a lot of ruckus that the police would have to fuss with. THis is an econimically scary time in our great nation - and I can;t help but think "But for the grace of God, therego I." The group that gets fed includes children, handicapped people, women, veterans and yes... a lot of alcoholics and drug users. It is a service to some that would have previously been in a care facility- but there is no funding. I feel that perhaps some more fortunate businessmen do not want to have the homeless downtown because it is bad for their businesses and the apartments and hotels they want to profit on. One might wonder where this concern for downtown was when we were trying to keep business here in uptown, but didn't want to lower lease prices or allow free parking. Mayor Coffey and Council Members Ensey, Edler, Ettl, Adkison, and Lover Yesterday it came to my attention that the permit given to Friday Night Live (FNL), a group who has been meeting weekly since October 2008 to feed the hungry and homeless in Yakima, has been revoked Currently, the group meets at St. Michael's Episcopal Church on Naches Avenue where they have been given permission from St. Michael's to utilize their property to distribute the meals. Despite having to move locations several times over the last year, this mission continue to raise the funds through local churches and businesses to feed Yakima's hungry and homeless each week. Yakima will be hosting the Luis Palau CityFest on July 17 — 18 at the State Fair Park. A typical Luis Palau CityFest attracts upwards of 50,000+ people in celebration and proclamation. Not only is the CityFest a weekend event, but it has also brought Yakima the Season of Service which is designed to take the message of self sacrifice and serving others out into the entire community This weekend event specifically celebrates all that was and will continue to be accomplished during the Season of Service Friday Night Live is one of these mission projects. What the volunteers do at Friday Night Live is not a glamorous volunteer experience There is monotonous fundraising, setup, cleanup and general planning that takes place each and every week. In addition, many of the people who come to FNL are not the sort of people you would chose to sit next to on the bus if given the choice. Many have no access to showers or other personal hygiene items and that is often apparent in their odor and appearance However, none of that has stopped those who are called to this mission In addition to the adult volunteers, we have several children from our church's youth group that volunteer at FNL once a month, my twelve year old daughter, Alyssa, is one of those volunteers. One story in particular she came home with was after the youth group had gone downtown one Sunday morning to give breakfast burritos to the homeless. When they first arrived on Naches Avenue, it appeared as if no one was there Then as they began to pull the food and coffee from the vehicle, slowly men, women, and children (having just woken up) began to emerge from their cars. I respectfully ask that you reconsider the revocation of the permit to Friday Night Live.
