R-2024-001 A RESOLUTION revoking Resolution R-2023-173 to fix the time for a public hearing before the Hearing Examiner on January 11, 2024, on a petition (Petition No. 23- 04) to vacate right-of-way at N. 4th St. between E. Lincoln Ave. and E. Martin Luther King Jr. Blvd. WHEREAS, pursuant to RCW 35.79.010, the petition (Petition No. 23-04, RWV#001-23) filed with the City Clerk was scheduled by Resolution R-2023-173 for a public hearing before the Hearing Examiner on January 11, 2024; and WHEREAS, the Hearing Examiner, Gary Cuillier, has a conflict of interest and is unable to conduct the hearing; and WHEREAS, the Hearing Examiner Pro Tem, Pat Spurgin, is unavailable to conduct the hearing on January 11, 2024, and may not be available until after March of 2024; and WHEREAS, the city Planning Division anticipates bringing to City Council a contract with another person or entity to provide hearing examiner services for the above-referenced Petition on or before February 6, 2024; and WHEREAS, the City Planning Division, upon executed contract for hearing examiner services for the above-referenced Petition, will draft a new Resolution setting the date for Hearing Examiner consideration, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The above-referenced Resolution R-2023-173 is hereby revoked. For Meeting of: January 2, 2024 ITEM TITLE: Resolution revoking the set date of January 11, 2024, for an open record public hearing before the City of Yakima Hearing Examiner to vacate a portion of N 4th St between MLK Jr Blvd and Lincoln Ave SUBMITTED BY: Joan Davenport, Community Development Director *Eric Crowell, Senior Planner SUMMARY EXPLANATION: On December 12, 2023, Council adopted Resolution R-2023-173 to establish a date of January 11, 2024 for an open record public hearing before the City of Yakima Hearing Examiner to vacate a portion of N 4th St between MLK Jr Blvd and E Lincoln Ave. Due to conflicts, the hearing cannot be held on this date by the Hearing Examiner or Hearing Examiner Pro Tem. The Planning Division anticipates bringing to City Council a contract with another person or entity to provide hearing examiner services for Petition No 23-04. Upon executed contract of hearing examiner services, a new Resolution will be drafted setting the date for Hearing Examiner consideration.
