Knotts purchased a parcel of land, Parent Parcel No. 181319 - 14001, located at 321 North 84 Avenue, Yakima, that is included in Final Assessment Roll for L.I.D. 1057, and that he has subsequently subdivided said Parent Parcel into eight (8) new parcels. He has requested, pursuant to Chapter 35.44 RCW, and more specifically RCW 35.44.410, "Segregation of Assessments ", that the City prepare a segregation of assessments for the new parcels created by his property subdivision. RCW 35.44.410 sets forth the conditions for such an action. A copy of RCW 35.44.410 is included with the Resolution for reference. Knotts to the City of Yakima in the total amount of $231.00 pursuant to RCW 35.44.410 (which consists of $80.00, an administrative fee of $100.00, and the Auditor's Office recording fee of $51.00), and delivery of a certified copy of . the Resolution to the City Finance Director. le BOARD /COMMISSION /COMMITTEE RECOMMENDATION: COUNCIL ACTION: • RESOLUTION NO. R -2008- A RESOLUTION ordering a segregation of the special assessments in Local Improvement District No. 1057 pursuant to RCW 35.44.410 against a parcel of land that was designated as Parcel No. 181319 -14001 and is included in Local Improvement District (L.I.D.) No. 1057. WHEREAS, the City passed by Ordinance No. 2006 -12, the Final Assessment Roll for Local Improvement District No. 1057 (L.I.D.), and established the Special Assessments for each of the parcels included within said L.I.D., which document was recorded under Auditor File No. 7577187, on August 17, 2007, and WHEREAS, Mr. Gilbert E. Knotts purchased Parcel No. 181319 -14001 from James C. Noel, who was the owner of record for the Special Assessments on said Parcel, which parcel has a street address of 321 North 84 Avenue, Yakima, Washington, 98908, and WHEREAS, Mr. Knotts has since subdivided the parcel into eight (8) parcels by Short Plat recorded under Auditor's File No. 7566953, Records of Yakima County, Washington, and further re- divided a portion of said Short Plat by Short Plat Exemption Numbers 15 -07 and 46- 07, and 0 WHEREAS, Mr. Knotts has requested that the remaining balance of the Special A ssessment against said Parcel No. 181319 -14001 be divided among the newly created parcels to wit: 181319- 14461, 181319- 14463, 181319- 14464, 181319 - 14465, 181319- 14469, 181319- 14471, 181319- 14472, 181319- 14473, and WHEREAS, the City may, by authority granted under Chapter 35.44 RCW, entitled "Local Improvements— Assessments and Reassessments ", and more specifically RCW 35.44.410, "Segregation of Assessments ", upon request from a landowner whose . property is included in the Final Assessment Roll, order a Segregation of Assessment for a subdivided parcel; and WHEREAS, if the annual L.I.D. assessments for Parcel No. 181319 -14001 are fully current in the annual assessment payments, then the City Engineer has determined that it is in the best interest of the City to grant the requested Segregation of Assessments, and has prepared an Amended Final Assessment Roll for L.I.D. No. 1057 to include the revised assessed amounts for the original Parent Parcel No. 181319 -14001 segregated into the aforementioned new Parcels, and said Amended Final Assessment Roll is attached hereto as Exhibit "A "; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Pursuant to RCW 35.44.410, after the City Finance Director has received a certified copy of this Resolution along with payment by Gilbert E. Knotts in the total amount of $231.00 • (which consists of $80.00, an administrative fee of $100.00, and the Auditor's Office recording fee of $51.00), then the City Finance Director or her designate in the Finance Department is ordered to make segregation on the original assessment roll as directed in this Resolution and as set forth in the Amended Assessment Roll attached as Exhibit "A ", and the City then grants e the requested Segregation of Assessments for Parent Parcel No. 181319 -14001 as set forth herein, and the Amended Assessment Roll as set forth in Exhibit "A" be hereby adopted for Local Improvement District No. 1057. This short plat was recorded in volume 1231 of plats, page 557 -561 records of Yakima County. This reassessment can be accompiished using part of the statute of Chapter 35.44 RCW, which is entitled "local improvements- assessments and reassessments ". It is requested that the existing local improvement district 1057 assessment on parent parcel 181319- 14001 be reassessed equally across the eight newly created parcels. Segregation of assessments Whenever any land against: which there has been levied any special assessment by any city or town shall have been sold in part or subdivided, the legislative authority of that city or town shall have the power to order a se- gregation of the assessment. Any person desiring to have such a special assessment against a tract of land segregated to apply to smaller parts thereof shall apply to the city or town which levied the assessment. If the legislative authority thereof determines that a segregation should be made, it shall by resolution order the city or town treasurer to make segregation on the original assessment roll as directed in the resolution. The segregation shall be made as nearly as possible on the same basis as the original assessment was levied, and the total of the segregated parts of the assessment shall equal the assessment before segregation. The resolution shall describe the Original tract, the amount and dale of the original assessment, and shall define the boundaries of the divided parts and the amount of the assessment chargeable to each part. A certified copy of the resolution shall be delivered to the city or town treasurer who shall proceed to make the segregation ordered upon being tendered a fee of ten dollars for each tract of land for which a segregation is to be made. In addition to such charge the legislative authority of the city or town may re- quire as a condition to the order of segregation that the person seeking it pay the city or town the reasonable en• ginctiriilg and clerical costs incident to mzik1ng the segregation.
