Cook, Director of Community and Economic Development Department CONTACT PERSON/TELEPHONE: William R Cook / 509- 575 -6113 SUMMARY EXPLANATION: Background Historically the City of Yakima has followed a process in place with Yakima County, and has accepted and approved "Master Plans" for residential single family, duplex and townhomes. A "Master Plan" is an application to build an exact duplicate of a previously reviewed (under the same edition of the International Building Code) and approved building plan with all 411 professional license seals current at the time of resubmittal. The designation of a "Master Plan" entitles the applicant to a reduction in their plan review fee. Ordinance 2005 -06 establishes the plan review fee for a building at 65% of the building permit fee. For a "master plan" review this number is reduced to 10% of the building permit fee. Proposed amendment to Chapter 11.04 Recently the Department of Community and Economic Development received a request from Glen Durall, representing Appletree Construction, requesting the City extend the "Master Plan" program to multifamily development projects (i.e. greater than a duplex). Yes, the amount of staff time to review an identical plan is less, but in the case of multifamily projects, is still more than a single family or duplex plan. For example, multifamily residential projects trigger: • A requirement for sprinklers which in tum requires verification of adequate fire flow, fire apparatus access and fire hydrant location; • Americans with Disabilities Act (ADA) accessibility is triggered for multifamily projects; • Projects larger than a duplex should be reviewed at a City Design Services Team (DST) meeting involving all City departments and private utilities; • The Airport Safety Overlay (ASO) is triggered for buildings over 35 feet in height. - - - - Prior to the October 1, 2008 Council Economic Development Committee meeting, I spoke to Glen Durall by phone and in person to reach an agreement on a recommendation from both of us to set the plan review fee for multifamily projects at 20% of the building permit fee. Unfortunately this agreement did not come out in the Committee meeting, and based on the information available to them, the Committee recommended a fee of 10%; the same as currently applied to smaller, less complex "Master Plan" applications. The Ordinance before you has 10% for the fee for a "Master Plan" for multifamily projects, reflecting the Council Economic Development Committee recommendation. However, we ask that Council consider the full impact of the distinction between a single family, duplex or townhome residential structure and a more complex multifamily structure, and approve a 20% fee for these multifamily projects. • • ORDINANCE NO. 2008- AN ORDINANCE of the City of Yakima, Washington relating to building codes and related regulation; adding new section 11.04.060 to Chapter 11.04 of the Yakima Municipal Code that defines the term "Master Plan "; clarifies its application to single- family, duplex, townhouse and multi- family construction; specifies the calculation of fees and the duration of master plans; and, provides requirements for the validity of the plans. WHEREAS, pursuant to RCW 19.27.040, the City of Yakima is authorized to amend certain provisions of the State Building Code so long as the minimum performance standards of the State Building Code and the objectives of RCW 19.27.020 are not diminished; and WHEREAS, the City of Yakima has previously adopted the International Building Code as adopted and maintained by the State Building Code Council with certain additions, deletions and exceptions; and WHEREAS, the City of Yakima Community and Economic Development Department accepts single family building plans to be submitted as a Master Plan for purposes of calculating plan review fees; and WHEREAS, the Department has received a request to extend this practice to multi- family housing projects of not more than a six unit structure; and WHEREAS a set of plans are accepted as a Master Plan when an applicant submits for plan review, the exact same design previously reviewed and approved by the City of Yakima and the applicant submits a copy of the City of Yakima's previously stamped approved plans, with a new site plan and meets all of the other conditions listed below. If all of these conditions are met, the applicant is entitled to a reduced plan review fee as described below, and WHEREAS, the proposed changes will formalize the process and provide greater clarity on submission requirements and fees; Now, Therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 11.04.060 is hereby enacted as a new Section of Chapter 11.04 of the City of Yakima Municipal Code to read as follows: "11.04.060. Master Plan Documents. A. Definition. A Master Plan is a set of residential building plans previously reviewed and approved by the City of Yakima, which the applicant intends to reuse exactly as reviewed and approved. 410 B. Single Family, Duplex and Townhouse. For single family, duplex or townhouse construction, 65% of the building permit fee is charged for plan review of a master set of plans. Thereafter, each time the single family, duplex or townhouse • plan is reused, the plan review fee shall be 10% of the building permit fee. C. Multi- family. For multi- family construction not exceeding a six unit structure, 65% of the building permit fee is charged for plan review of a master set of plans. Thereafter, each time the multi - family plan is reused, the plan review fee shall be 10% of the building permit fee. D. Duration and Validity of Master Plan. A Master Plan remains valid for a reduced plan review fee as described above until a new building code is adopted by the State of Washington. At that time, all current Master Plans shall become void but can be resubmitted for review under the new code at full plan review fee to establish a new Master Plan. Any Architect or Engineer signed or stamped plans must have a current professional license as of the date submitted for reuse as a Master Plan. E . Only the Plan Review fee is reduced under the Master Plan program. All other __ permit fees including building; plumbing, mechanical, the same." Section 2. This Ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and by the City Charter. They are 6- 1, 2, and 3 bedroom units; center entry way with a unit on the left and the right with a • common wall separating them; on the first floor, 2nd and 3rd floors. The buildings are groups of 6 plexes i.e, 6- 1 bed units 6- 2 bed units or 6- 3 bed units. Building "A ", "C" and "D" are exactly the same, in the first phase. Building "B" is 4- 1 bedroom 6 plexes, and so on. The point of this is the "Master" review fee subject. Apparently "mastering" only applies up to and including 4 plexes. This letter is a request to include typical 6 plexes at the Castle Creek Apartment project to be included in the "Master" category. Paying full review fees on a total of 26- 1 bed 6 plexes, 20- 2 bed 6 plexes, and 11- 3 bed 6 plexes seems unnecessary. Your involvement is needed Bill. Will you please give this subject and request serious evaluation. The reviews of the first 6- plexes may be completed very soon.
