An appropriation ordinance is needed to purchase the equipment being funded by the 11) donation. Staff respectfully requests Council consideration of the attached Appropriation Ordinance accepting Downtown Rotary's donation of $154,834 and making an appropriation in the Parks and Recreation Capital Fund for playground equipment (including tax). • Resolution _ Ordinance X Contract _ Other (Specify) Contract Mail to (name and address): Funding Source Parks and Recreation Capital Budget APPROVED FOR SUBMITTAL: V City Manager STAFF RECOMMENDATION: Staff respectfully requests City Council to Read the attached Ordinance by title only at the May 4, 2010 Business Meeting, and pass the ordinance after second reading at the May 18, 2010 Business Meeting. BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The Parks and Recreation Commission discussed the new playground system for Kiwanis Park during its November 18, 2009 meeting and recommends approval to the full City Council. COUNCIL ACTION: • ms/ /Playground Appropr Ord Agenda.doc 0 ORDINANCE NO. 2010- AN ORDINANCE amending the 2010 budget for the City of Yakima; and making appropriations of $154,884 within the 33.1 - Parks and Recreation Capital Fund for expenditure during 2010 to purchase playground equipment for Kiwanis Park. WHEREAS, the amount of $154,884 must be appropriated within the 331 - Parks and Recreation Capital Fund for expenditure during 2010 to purchase playground equipment for Kiwanis Park, and WHEREAS, the expenditure is being funded by a donation from the Downtown Rotary Club in the amount of $154,834 which was made for the purpose of purchasing playground equipment for Kiwanis Park, and WHEREAS, at the time of the .adoption of the 2010 budget it could not reasonably have been foreseen that the appropriation provided for by this ordinance would be required; and the City Council declares that an emergency exists of the type contemplated by RCW 35.33.091 and that it is in the best interests of the City to make the appropriation herein provided, now, therefore, . BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1: The amount of $154,884 is hereby appropriated from the Unappropriated F und Balance in the 331 - Parks and Recreation Capital Fund to the following accounts as a 2010 appropriation: Resources: Donations -Upper Kiwanis Park 331- 331 - 428 - 2212 - 36711 -CNT -- $154,884 Expenditures: . Upper Kiwanis Park Improvement Project - -- 331 - 331 - 428 - 2212 - 59476 -650 -- $154,884 Section 2: This ordinance is one making an appropriation and shall take effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
