Roll Call All Council members were present. 2. Executive Session — Property acquisition Executive Session was held and adjourned at 5:40 p.m. 6:00 P.M. — PUBLIC SESSION 1. Roll Call All Council members were present; Staff included City Manager Zais, City Attorney Paolella, and Deputy City Clerk Watkins 2. Invocation /Pledge of Allegiance Assistant Mayor Cawley gave an invocation followed by the Pledge of Allegiance 3. Open Discussion for the Good of the Order A. Proclamations - None B. Special presentations / recognitions - None C. Status report on prior meeting's citizen service requests - None D. Appointments to Boards and Commissions Bill Wheeler — Air Terminal Board Alan Adolf — Bicycle /Pedestrian Advisory Committee Jeff Louman /Barbara Cline — Board of Appeals Melanie Gilmore — Charter Civil Service Commission Bob Mason — Community Review Board Julie Smith — Renewal Community Commercial Revitalization Maureen Adkison — Parks and Recreation Angie Girard — Public Facilities District Scott Irons — Historic Preservation Commission Council announced the need for more volunteers for remaining vacancies on the Community Review Board, the Parks & Recreation Commission, and the Historic Preservation Commission. Also noted the creation of a seven - member Southeast Community Center Advisory Board which will require volunteers. 4. Consent agenda ACTION: Items 8, 11, and 12 were added to the Consent Agenda. Public Hearing and consideration of an Ordinance to establish the Yakima Revenue Development Area for the Washington State Local Infrastructure Financing Tool (LIFT) program ACTION: Public hearing was held. Lynne Kittelson and Dr. James Dodge spoke. Ordinance passed. ORDINANCE NO. 2008 -28 VOTE: Unanimous 7. Public Hearing to consider the results of the Washington State Auditor's Office performance audit report on providing public records to citizens ACTION: Public hearing was held. Christopher Cortines from the State Attorney General's office, gave a presentation. Jodi Stephens, Public Records Officer, was recognized for her efforts. No citizens came forward to speak. Report accepted. VOTE: Unanimous CITY MANAGER'S REPORTS *8. 2007 Annual Report of the City of Yakima Fire Department ACTION: Report accepted 9. Staff report regarding proposed debt financing for 2008 Engineering, and Streets /Traffic projects and financing for a new Fire Department ladder truck ACTION: Report approved VOTE: Unanimous 10. Consideration of a Resolution authorizing execution of an architectural services agreement with LCA Architects to conduct a feasibility study addressing the need and advisability of replacement of the existing Yakima Police Department substation ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -91 VOTE: Unanimous *11. Consideration of a Resolution authorizing an amendment to the contract with Berger Abam regarding the Grade Separation Project ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -92 *12. Consideration of a Resolution authorizing execution of a professional services agreement with Surdex Corporation to provide LiDAR data acquisition and processing for high accuracy mapping and modeling applications ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -93 *13. Consideration of approval of first quarter 2008 Finance reports: A. Revenue and Expenditure Report B. Accounts Receivable C. Treasury Report ACTION: Reports accepted *14. Consideration of a Resolution authorizing execution of a Release and Settlement Agreement to resolve and settle the claim for damages filed by Crystal Dodge ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -94 2 *15. Consideration of a Resolution authorizing execution of an addendum to an agreement with Central Washington Occupational Medicine for the provision of drug and alcohol testing and physical examination services for Transit employees ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -95 *16. Consideration of an application from Lake Aspen Enterprises /Borton CA Storage for a right -of -way use permit to place screening in the City right -of -way at 1725 River Road and 1800 River Road ACTION: Application accepted *17. Consideration of a Resolution authorizing execution of a contract amendment with KRAFT CONSULTING to extend the Healthy Families Yakima program for an additional year ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -96 *18. Consideration of a Resolution transferring a surplus used police vehicle to Prosser Memorial Hospital ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -97 *19. Consideration of Final Contract Payment for the General 308 Irrigation System Phase III, Stage 1 improvements ACTION: Final payment was approved *20. Consideration of a Resolution authorizing acquisition of right -of -way under the Transportation Enhancement Grant Program for the William O. Douglas Trail Connections project ACTION: Resolution adopted. RESOLUTION NO. R- 2008 -98 *21. Set date of Public Hearing for July 1, 2008 for the Wellington Phase 4 Final Plat ACTION: July 1, 2008 was set as the date of public hearing. *22. Set Dates of Public Hearings for July 1 and July 15, 2008 at 7:00 p.m. to consider: A. Adoption of the Six -Year Transportation Improvement Program for 2009- 2014, and to amend the Metropolitan Transportation Plan B. Amend the Yakima Urban Area Comprehensive Plan Capital Facilities Element C. Amend the Yakima Urban Area Comprehensive Plan to identify the City REET Expenditure Plan ACTION: July 1 and July 15, 2008 were set as dates of public hearings ORDINANCES 23. Consideration of recommendations to amend the posted speed limits on various arterial streets and an Ordinance amending Section 9.50.370 of the Yakima Municipal Code ACTION: Ordinance passed. ORDINANCE NO. 2008 -29 VOTE: 6 -1, Cawley voting nay 3 24. Consideration of an Ordinances relating to public safety and morals: A. Repealing Chapter 6.11 entitled, "Criminal Street Gangs and Gang- related activities," of the City of Yakima Municipal Code ACTION: Ordinance passed ORDINANCE NO. 2008 -30 VOTE: Unanimous B. Adopting portions of the newly adopted Washington State Criminal Street Gangs law effective June 12, 2008; adopting Section 306 of the Engrossed Second Substitute House Bill 2712; imposing mandatory minimum sentences for misdemeanor and gross- misdemeanor criminal street gang - related offenses; and creating a new Chapter 6.11 of the City of Yakima Municipal Code ACTION: Ordinance passed ORDINANCE NO. 2008 -31 VOTE: Unanimous *25. Consideration of an Ordinance authorizing the City to lease to Noel Communications, Inc. access to and space within the conduit system located under Yakima Avenue (ordinance available Monday, 6/9/08) ACTION: Ordinance passed ORDINANCE NO. 2008 -32 VOTE: Unanimous 26. Other Business • Assistant Mayor Cawley reminded the public of the Summer Kick Off Cruise on June 21S • Council Member McClure promoted the Arboretum's Garden Tour to be held this weekend. • City Manager Zais reminded Council of the AWC meeting to be held in Yakima next week celebrating its 75 year. • City Manager Zais announced that City Attorney Paolella has been appointed to the Eastern Washington Growth Management Hearings Board by Governor Gregoire effective July 1, 2008. 27.
