A RESOLUTION authorizing application for funding assistance for a Local Park Maintenance
(LPM) project to the Recreation and Conservation Office (RCO).
WHEREAS, the City of Yakima is the owner of Kissel Park located at 3000 W. Mead
Avenue; and
WHEREAS, Kissel Park is home to 12 outdoor tennis courts that are utilized by the public,
for recreation, competitions and USTA lessons; and
WHEREAS, the City of Yakima Parks and Recreation Division maintains the tennis courts
as part of its park maintenance responsibilities; and
WHEREAS, the City of Yakima Parks and Recreation Division resurfaced three of the
courts tennis courts in 2020 and 2021, but due to budget constraints the remaining nine courts
have not been resurfaced; and
WHEREAS,the Yakima City Council and Yakima Parks and Recreation Commission have
approved a comprehensive plan that includes the resurfacing of tennis courts as needed; and
WHEREAS, under the provisions of the LPM, state grant assistance is requested to aid in
financing the cost of the deferred maintenance; and
WHEREAS, the City Council of the City of Yakima considers it in the best public interest
to improve the current public park property, and that such improvement will promote the general
health, safety and welfare; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The City Manager is authorized to make formal application to the Recreation and
Conservation Office for grant assistance;
2. Any grant assistance received will be used for direct costs associated with implementation
of the project referenced above;
3. The City of Yakima acknowledges that the grant assistance, if approved, will be paid on a
reimbursement basis, meaning the City of Yakima will only request payment from the
Recreation and Conservation Office after eligible and allowable costs have been incurred
and payment remitted to the city's vendors, and that the Recreation and Conservation
Office will hold retainage until the project is deemed complete;
4. The City of Yakima acknowledges that any improvements to Kissel Park through grant
assistance from the Recreation and Conservation Funding Board must be reasonably
maintained and made available to the general public at reasonable hours and times of the
year according to the type of area or facility unless other restrictions have been agreed to

with respect to the above Project for which we seek grant funding assistance managed through the
Recreation and Conservation Office (Office).
WHEREAS grant assistance is requested by our organization to aid in financing the cost of the
Project referenced above;
NOW,THEREFORE, BE IT RESOLVED that:
1. Our organization has applied for or intends to apply for funding assistance managed by the
Office for the above "Project."

The above persons are considered an"authorized representative(s)/agent(s)"for purposes of the
documents indicated. Our organization shall comply with a request from the RCO to provide
updated documentation of authorized signers,if needed.
3. Our organization acknowledges and warrants, after conferring with its legal counsel, that its
authorized representative(s)/agent(s) have full legal authority to act and sign on behalf of the
organization for their assigned role/document.
4. Grant assistance is contingent on a signed Agreement. Entering into any Agreement with
the Office is purely voluntary on our part.
5. Our organization understands that grant policies and requirements vary depending on the
grant program applied to,the grant program and source of funding in the Agreement,the
characteristics of the project,and the characteristics of our organization.
6. Any grant assistance received will be used for only direct eligible and allowable costs that are
reasonable and necessary to implement the project(s)referenced above.
7. Our organization acknowledges that the grant will only be used for maintenance of local park
property owned by our organization.
8. This resolution/authorization is deemed to be part of the formal grant application to the Office.
9. Our organization warrants and certifies that this resolution/authorization was properly and
lawfully adopted following the requirements of our organization and applicable laws and
policies and that our organization has full legal authority to commit our organization to the
warranties,certifications,promises,and obligations set forth herein.

application.

ITEM TITLE: Resolution authorizing application for funding assistance for a Local
Parks Maintenance project to the Recreation and Conservation
Office (RCO)for resurfacing the tennis courts at Kissel Park

SUMMARY EXPLANATION:
The Recreation and Conservation Office (RCO)for the State of Washington has created a new
grant opportunity to fund deferred park maintenance projects. The grant will fund up to $100,000
of deferred park maintenance needs per jurisdiction. As part of the application process, the
Yakima City Council is required to approve the grant application prior to submission. The grant
does not require matching funds like the other RCO grant programs and the process will be
extremely competitive. We anticipate that the cost for the project will be $90,000.
The grant application will be for the crack filling, re-coating, installing new net posts and repainting
the tennis court lines on nine tennis courts at Kissel Park. Park Maintenance was able to crack fill,
re-coat, install new net posts and repaint the tennis court lines on three of the twelve courts at
Kissel Park in the past, but the remaining nine courts also need to be improved.
