A RESOLUTION ratifying the City Manager's execution of an amendment to Grant
Agreement R 22 56104 035 for residential utility customer accounts
affected by the COVID pandemic.
WHEREAS, in 2022, the Washington State Department of Commerce Energy
Division opened a grant funding opportunity in the amount of $100,000,000.00 awarded by
the United States Department of Treasury; and
WHEREAS, the purpose of the grant is to provide funding for public and private
utilities to address residential customer arrearages compounded by the COVID pandemic
and the related downturn that were accrued between March 1, 2020 and December 31,
2021; and
WHEREAS, the City of Yakima entered into Grant Agreement 22-56104-035 with
the Washington State Department of Commerce on December 6, 2022 for $450,927.95;
and
WHEREAS, the City of Yakima was awarded an additional $53,298.98 in grant
funding, amending the original grant award; and
WHEREAS, the City Manager signed and accepted the increased award and now
is seeking ratification of his signature; and
WHEREAS, the City Council of the City of Yakima finds it was in the best interest of
the residents and the City to accept the increased grant funding to help residential
customers pay past due utility bills, and that ratification of the grant agreement to increase
the funding that could be used to pay those arrearages is in the best interest of the City;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager's execution of the amendment to Grant Agreement R 22 56104 035
attached hereto and incorporated herein in the amount of $53,298.98 to provide additional
funds to address COVID-related arrearages of utilities customers in the City of Yakima is
ratified by the City Council.

The purpose of this contract is to provide funding for public and private water, sewer, garbage, electric, and natural gas utilities to
address low-income customer arrearages compounded by the COVID-19 pandemic and the related economic downturn that were
accrued between March 1, 2020, and December 31, 2021.
COMMERCE, defined as the Department of Commerce, and the Contractor, as defined above, acknowledge and accept the terms
of this Contract As Amended and attachments and have executed this Contract Amendment on the date below to start as of the date
and year referenced above. The rights and obligations of both parties to this Contract As Amended are governed by this Contract
Amendment and the following other documents incorporated by reference: Contractor Terms and Conditions including Attachment
"A" — Scope of Work, Attachment "B" — Budget. A copy of this Contract Amendment shall be attached to and made a part of the
original Contract between COMMERCE and the Contractor. Any reference in the original Contract to the "Contract" shall mean
the "Contract as Amended".

From time to time, Washington State Department of Commerce (we, us or Company) may be
required by law to provide to you certain written notices or disclosures. Described below are the

Getting paper copies

Consequences of changing your mind

paper notices or disclosures. Further, you will no longer be able to use the DocuSign system to
receive required notices and consents electronically from us or to sign electronically documents

Unless you tell us otherwise in accordance with the procedures described herein, we will provide
electronically to you through the DocuSign system all required notices, disclosures,
authorizations, acknowledgements, and other documents that are required to be provided or made
