RESOLUTION NO. R-2015-133
authorizing the City manager to execute and administer an amendment
revising the agreement between the Humane Society of Central
Washington and the City of Yakima for animal control services and
acquisition of a vehicle to enhance such services.
WHEREAS, the City of Yakima ("City") and the Humane Society of Central Washington
("Humane Society") have previously entered into an Agreement for Animal Control Services dated
October 23, 2014 as approved pursuant to City Resolution No. 2014-127 (hereafter "Agreement"),
which Agreement sets forth the obligations and duties of each party for the provision of animal
control services by Humane Society to City; and
WHEREAS, the parties desire to amend such Agreement to set forth provisions regarding
the acquisition and operation by Humane Society of a vehicle to facilitate and enhance the
provision of animal control services, and to accomplish the goals set forth below; and
WHEREAS, acquisition and operation of such vehicle by Humane Society will promote
the efficiency and effectiveness of animal control services within the City, to wit:
(a) Acquisition and operation a suitable vehicle will reduce barriers to basic animal
care for low-income families, the elderly, disabled, and those who lack
transportation
(b) Increase access to low-cost spay and neuter services at Humane Society
facilities by creating a pick-up and delivery service sufficient to carry 12 to 18
portable kennels per day.
(c) Provide education to the public regarding the importance of spaying and
neutering their animals for the sake of the animal and to protect public health,
thereby reducing the number of abandoned and neglected animals in City
neighborhoods.
(d) Provide the community with a low-cost mobile clinic to provide animals with
basic, proactive, preventative health care. Such services will include
vaccinations for distemper, parvo, bordatalla and rabies to protect animals and
the public from disease, as well as prevention of the transmission of other
potential zoonosis conditions.
(e) Offer micro -chipping of owned animals, so lost pets can be quickly returned to
their owners.

Providing reliable transportation of local, abandoned animals to partner
organizations where adoptions are facilitated, creating space for the intake of
new animals at Humane Society facilities.
Creating a mobile presence at adoption and community events to further
promote spay and neuter services at Humane Society facilities and provide

(h) Providing an emergency response vehicle for natural disasters, animal cruelty
and hoarding investigations,
and
WHEREAS, the parties have negotiated an Amendment to the Agreement, which
amendment is attached hereto as Exhibit "A" and incorporated herein by this reference, and
WHEREAS, Humane Society has identified a vehicle meeting the criteria necessary and
appropriate to provide the above services, which vehicle is a Sprinter Cargo Van Model 2500,
M2CA170, all as further described in the Invoice attached as Exhibit "A" to the attached
Amendment; and
WHEREAS, the City desires to contribute and pay up to $45,000 to Humane Society to
help defray the total purchase price of such vehicle, which funds are available for expenditure in
City's Law & Justice Capital Fund, and
WHEREAS, the City Council finds and determines that such contribution, and the resulting
operation of such vehicle, will promote and enhance the animal control services provided by
Humane Society pursuant to the Agreement between the parties, thus promoting efficient and
effective animal control, public education and public health within the City of Yakima, and the
general health, safety and welfare; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The City Council hereby approves the Amendment to the Agreement for
Animal Control Services, which amendment is set forth as Exhibit "A" to this Resolution.
Section 2. The City Manager is hereby authorized to execute and administer the
Amendment to the Agreement for Animal Control Services approved in Section 1 above, and to
use any available and appropriate funds, up to $45,000 00, from the City's Law & Justice Capital
Fund for the performance thereof, or other appropriate fund; now, therefore,
ADOPTED BY THE CITY COUNCIL this 3rd day of November, 2015.

AMENDMENT TO:
ANIMAL CONTROL AGREEMENT
By and Between
CITY OF YAKIMA
And
HUMANE SOCIETY OF CENTRAL WASHINGTON
(2015 Agreement)
This Amendment amends the Animal Control Agreement (hereafter "Agreement") by and
between the City of Yakima ("City") and Humane Society of Central Washington ("Humane
Society"), previously entered into by the parties on October 23, 2014 pursuant to City Resolution
No. 2014-127 dated October 21, 2014, for the uses and purposes hereinafter set forth.
I. RECITALS
WHEREAS, the parties have previously entered into the Agreement as described above,

Yakima, now, therefore
IN CONSIDERATION of the mutual covenants, conditions and benefits herein, the parties agree
as follows
Section 1. The Agreement previously executed by and between the parties is
amended to add new subsection 1(k) which provides as follows
(k) The Humane Society shall acquire, own, operate and insure a vehicle
suitable to provide mobile animal control services for the benefit of City as set
forth below:

Section 3 of the Agreement is hereby amended to add a new paragraph
Upon Humane Society's identification of a vehicle suitable to provide the services
set forth in Section 1(k) above, and after City's approval of such vehicle, City
shall remit and pay to Humane Society up to $45,000.00 to be applied by
Humane Society solely to defray the purchase price of such approved vehicle.
Such vehicle shall be owned and insured by Humane Society and operated in
accordance with standards and procedures governing use of Humane Society's
vehicles. For purposes of this Agreement, Humane Society has selected the
vehicle as described in the Invoice attached hereto as Exhibit "A." City shall
remit and pay up to $45,000.00 to Humane Society on or before November 15,
2015 to help defray the purchase price of such vehicle. Humane Society shall be
solely responsible for any and all costs of acquisition, licensing, operation and
insuring of such vehicle over and above the amounts paid and remitted herein by
City.

SUMMARY EXPLANATION:
The City of Yakima and the Humane Society of Central Washington have previously entered into an
agreement whereby the Humane Society provides animal control services for the City of Yakima. The parties
desire to amend the agreement to provide a mechanism whereby the Humane Society will purchase, own and
operate a vehicle suitable to provide mobile animal vaccination, spay and neuter services, thereby enhancing
and promoting the animal control services provided by the Humane Society. Under the terms of the
proposed Amendment, the City will contribute up to $45,000 to the Humane Society to be used to help
defray the Humane Society's costs of acquisition. Funds are available from the City's Law & Justice Capital
Fund.

Good morning Tony...
First and foremost, we all wish to thank you for your assistance with this important project. To put it
quite simply, we could not have achieved this level of success without the city's support.
Our Task for has completed its business and after considerable research and consultation have selected the best
vehicle for our unique needs. As you can see, YHS will be covering a portion of the acquisition costs and the
cost of the wrap and local custom fabrication to convert the vehicle to multiple uses.
At our task force meeting last Thursday, Kathy asked that we submit our invoice to you.
I am including a our invoice, a copy of our budget which shows the total cost of the finished project vehicle,
our share of those costs, and a brief that further explains why we need the vehicle and how it will serve
the citizens of Yakima.
Steve Hahn's Auto Group has located the model we need with the right equipment and has it on hold for
us pending payment...so there is some urgency in getting this paid.
Please let me know should you require further information...

VAN ACQUISITION TASK FORCE
BACKGROUND:
Pet overpopulation contributes to issues that have a negative impact on our community. Stray dogs,
feral cat colonies, sick and injured animals and animal neglect cases are the result of inadequate
resources. Significant, sustainable change cannot occur until we are able to provide solutions for the
major factors that have created our current situation — educational/awareness deficiencies, income
limitations and the inability to access necessary, basic veterinary services. Our objective must be to
remove those barriers. We need to increase awareness regarding the importance and scope of
responsible pet ownership and improve animal health with vaccinations, spay/neuter surgeries and
microchips, and provide accessibility to those critical services. Yakima Humane will bridge the
information gap by providing outreach and education. Yakima Humane will provide affordable services
for spay/neuter surgeries, vaccinations and microchip services to our low income population with a
stationary, full time clinic located in downtown Yakima. The remaining obstacle is transportation. We
need to reach out and deliver services where they are needed most, in our neighborhoods.
GOALS:
Acquire a suitable vehicle that can be adapted for multiple functions to deliver services to our
community, as effectively and efficiently as possible.
MOBILE SERVICES:
A new vehicle would have the potential to improve and save the lives of many animals in Yakima, and
reduce the number of unattended animals in our community by...
1. Reducing barriers to basic animal care for low-income families, the elderly, disabled and those who
lack transportation
2. Increasing access to low cost spay and neuter services at the new Yakima Humane clinic by creating a
pick-up and delivery service sufficient to carry 12-18 portable kennels per day
3. Educating the public regarding the importance of spaying and neutering their animals for the sake of
the animal and to protect public health, thereby reducing the number of abandoned and neglected
animals in our neighborhoods
4. Providing our community with a low-cost mobile clinic to provide animals with basic, proactive,
preventative healthcare. Those services would include vaccinations for distemper, parvo, bordetalla and
rabies to protect animals and our public from disease, as well as prevent the transmission of other
potential zoonosis conditions
5. Offering microchipping of owned animals, so lost pets can be quickly returned to their owners
6. Providing reliable transportation of local, abandoned animals to partner organizations where
adoptions are facilitated, creating space for the intake of new animals. The Yakima Humane shelter is
often at capacity.
7. Creating a mobile presence at adoption and community events to further promote spay and neuter
services at our clinic and provide other animal welfare care and education as needed
8. Providing an emergency response vehicle for natural disasters, animal cruelty and hoarding
investigations.
The Yakima Humane low cost, high quality, high volume Spay & Neuter Clinic and the Mobile Unit will
work together to reach out to our neighborhoods and a connect with a segment of our population that
is currently underserved. It is a very reliable solution for reducing the number of homeless animals on
our streets and in our shelter. To be successful, we need to make it easy and affordable for our
community members to access pet spay & neuter surgeries and basic preventative health care services.
VEHICLE SELECTION CRITERIA:
We need a cargo van that has maximum cargo space (length & height) and one that can be easily
converted for multiple uses and applications. Space is important. We will need to carry up to 20 portable
kennels at one time. Likewise, headroom is important for veterinarians and assistants who will be using
the space to provide medical services. Conversions for outreach, educational opportunities and off-site
adoption events will be necessary. Future potential could include use as a mobile response unit for
natural disasters or animal medical emergencies.
The best choice is a diesel powered van that can endure extended use over many years, is fuel efficient
and has a reputation for requiring minimum service and maintenance. The van usage could as much as
30 to 35 thousand miles annually. A vehicle capable of running trouble free for over 250,000 miles
would be ideal.
The cargo van must have safety features and be able to securely carry our passengers in as much
comfort as possible.
Research has identified two vehicles that would meet our requirements:
