Notice of the hearing was given more • than twenty days before the hearing in the manner required by RCW 35.79.020 and was given in additional ways as follows: Posting of notice on the property: August 5, 2008 Publishing of notice in the newspaper: August 6, 2008 Mailing of notice to property owners: August 6, 2008 Posting of notice in three public places: August 12, 2008 VI. Environmental- Review. Street vacations . are categorically exempt from SEPA review in accordance with WAC 197- 11- 800(2)(h) and Chapter 6.88 of the Yakima Municipal Code. VII. Transportation Capacity Management Ordinance. This request is an exempt activity under the Transportation Capacity Management Ordinance. VIII. Background. On June 11, 2008, the City Department of : Community and Economic Development received this petition to vacate this 20- foot -wide, and 200 -foot- long section of unimproved alley right -of -way. Public records indicate that, the alley right -of -way proposed for vacation was dedicated to the City on April 3, 1907 by the Central Addition to North Yakima. The petition contains the requisite signatures of two - thirds of the abutting property owners since the petitioners own all the parcels abutting the right -of -way to be vacated. Doug Christen: signed for the two parcels on the west side of the right -of -way to be vacated. Union Gospel Mission CEO Rick Phillips and Secretary Steve Graff signed for the two parcels on the east side of the right-of-way. IX. Zoning and Land Use. The property on both sides of the north/south alley right- of -way is zoned Light Industrial (M -1). A truck towing and service business is located on the west side, and the property on the east and south sides is currently vacant land. X. Development Services Team (DST). A Development Services Team meeting was held on July 2, 2008 to discuss the possible impacts of approving the requested right -of- way vacation. The DST comments included the following observations: (i) Building Permits /Codes: Any future = development of the vacated area requires plan review, permits and inspections before occupancy. (ii) Engineering Division: There are no .utilities in the area of the alley right -of- way vacation request. (iii) Water and Wastewater: There are no water or sewer lines in the area of the alley right -of -way vacation request. (iv) Traffic Engineering: Transportation Concurrency Review will not be required. City policy provides the following:specific,criteriato be considered in determining the- propriety and requisites of street or alley right -of -way vacations: 1. Public Benefit .. and Reasons Supporting the Proposed Vacation and the Limits of the Proposed Vacation. The public-benefit-of the requested {alley=right -of -way vacation would be .to-allow forthe development::of "the :petitioners' properties.without.the. need to observe building setbacks from the unimproved rights -of -way that are not- needed for any public purpose. The property will be placed on the tax rolls and there will be no potential maintenance - costs for the City-in the future, 2., Necessity for the Right - of - Way as Access to Property. The alley right - of- way involved in this request is not needed for access to any property because all abutting properties have access to a public street. i 3. Consistency with the Six Year Transportation Improvement Plan, the Urban Area Comprehensive Plan and other Official City Plans and Policies. The subject alley right -of -way is currently unpaved and unused. It is not included in the City's Six Year Transportation Improvement Plan. There are no plans for improvement of the alley right -of -way in any of the City's plans or policies. 4. Consistency with Existing and Anticipated Development in the Area Based on Zoning, ,Current-Use and Long- RangePlans. The requested alley right -of -way vacation will not adversely affect any existing or anticipated development in the area.. It will instead facilitate future- development of the property. There are no immediate plans for the Union Gospel Mission's vacant parcels to the east and south, and there may be a need to rezone those parcels if their future proposed use does not fit the zoning. 5. Provisions for Relocation of. Existing Utilities or Easements. for Existing Utilities. No existing public or private utilities or other improvements are located within the alley right -of -way area proposed for vacation. 6. Fair Market Appraisal and Compensation to the City. Compensation to the City is not required under Subsection 1(C) of ,City Resolution #R- 2007 -126 because the City has neither purchased, maintained nor made any improvements to the alley right -of- way involved in this vacation request, and no planned or anticipated public purpose exists for maintaining this right -of -way. 110 CONCLUSIONS Based on the above Findings, the Examiner reaches the following Conclusions: 1. The Hearing Examiner has jurisdiction and authority by virtue of Subsection 1.43.080(H) of the Yakima Municipal Code to conduct open record public hearings regarding petitions and resolutions to vacate: public street and alley rights-of-way and to make recommendations to the City Council relative thereto. 2. All public notice requirements for vacation of the alley right -of -way have been completed in accordance with applicable statutory and ordinance requirements. 3. SEPA review was not required because alley right -of -way vacations are categorically exempt from SEPA review. 4. A traffic analysis report under the Transportation Capacity Management Ordinance is not required for the requested right -of -way vacation. This request for public alley right -of -way vacation does not conflict with any planned street improvement projects or other plans or projects of the City of Yakima. 7. The five criteria governing the approval of public alley right-of-way vacations have all been satisfied. 8. Fair market compensation to the .City, is: not required in this situation by- City Resolution R- 2007 -126. 9. The vacated alley right -of -way will become a part of the petitioners'. properties by ' virtue of RCW 35.79:040 which provides that property within the portion of the alley to be vacated shall belong . to the owners of the property abutting each side .of the vacated - area, with one -half of the vacated area belonging to the owners on each side of the vacated area. RECOMMENDATION • The Hearing Examiner recommends to the Yakima City Council that the north/south 20- foot -wide alley right -of -way south of Oak Avenue between 1313 Gordon Road and 1300 North 1 Street as described in Petition #08 -07 and R/W VAC #2 -08 SHOULD BE VACATED with the result that title to the vacated alley right -of -way shall be vested in the abutting property owners, one -half to each in accordance to RCW 35.79.040, and that the vacated alley right -of- -way shall be zoned the same as the abutting property, which is Light Industrial (M -1). Planner • SUMMARY OF RECOMMENDATION: The City of Yakima Planning Division recommends approval of this vac ation request subject to conditions. From the view of the site, the matters contained in the application, Development Services Team comments and a review of the Yakima Urban Area Comprehensive Plan, the Yakima Urban 111 Area Zoning Ordinance, and RCW 35.79 staff makes the following: • FINDINGS Petitioner: Hordan Planning Services, on behalf of Doug Christen & Union Gospel Mission Request: Right -of-Way Vacation of the platted north- south alley located south of Oak Avenue between Gordon Road and the vacated portion of North Front Street to allow the adjacent property owners to use the vacated right -of- way as private property. UAZO R/W Vac #2 -08 INDEX BACKGROUND: 4110 On June 11, 2008, The Department of Community & Economic Development received a petition from Hordan Planning Services, on behalf of Doug Christen & Union Gospel Mission, for the vacation of a platted alley right -of -way. The proponents have requested this vacation in order to use the vacated right -of -way as private property. The City of Yakima has no future plans for development of this unimproved right -of -way. The City of Yakima's records indicate that the right -of -way for this alley vacation was originally dedicated to the City of Yakima by the Central Addition to North Yakima, on April 3, 1907. The proposed right -of -way to be vacated is of no public benefit because it has never-been used by the public for a thoroughfare. The right -of -way does not contain public or private:: utilities. All adjoining parcels have direct access to Gordon Road and Oak Avenue. The proponents feel the public will benefit from this vacation as this will place the property on the tax role and permit the adjoining property owners to use the vacated right -of -way as private property. The petitions were submitted with the necessary signatures to satisfy the requirement for consideration, of the proposed vacation. Of the four abutting parcels to the alley right -of -way, applicant, Doug Christen signed for parcel number(s) 181313 -11444 and 181313 - 11443; and those signing for the Union Gospel Mission were Steve Graff, Secretary, and Rick Phillips, CEO Union Gospel Mission for parcel number(s) 181313 - 11441 and 181313 - 11004. The petition for the vacation of this portion of alley right-of-way .public: hearing goes before the Hearing Examiner on September 25, 2008. The date for a hearing before City Council to consider the recommendation of the Hearing Examiner has yet to be determined. Hearing Examiner Authority: The Yakima Municipal Code states in Chapter 1.43.080(11), that the Hearing Examiner shall conduct public hearings on petitions and resolutions to vacate streets and public rights -of -way pursuant to RCW Chapter 35.79. Decisions of the examiner on such matters shall constitute a recommendation to the City Council. Urban Area Comprehensive Plan: The City of Yakima, 1997 Comprehensive Plan designates the area surrounding this vacation request as .Central Business District Support and Light Industrial and, as such, supports the underlying zoning of Light Industrial (M -1). The following goals, policies, and objectives apply to this petition request: Objective Cl: Work with business owners to stabilize and revitalize existing commercial. facilities. Goal I1: Provide ample opportunities for industrial development at locations with suitable access and adequate municipal services. Urban Area Zoning Ordinance: Technically, street and alley rights -of -way are un- zoned. However, upon vacation they become zoned the same as the immediate contiguous properties. In this case, the contiguous zoning on DOC. 2 Christen and UG Mission INDEX UAZO R/W Vac #2 -08 # A_� • both sides of the subject alley is M -1 Light Industrial, which is a zoning classification that permits the existing truck shop on the west side as a Class (1) land use. The parcels on the east and south sides are currently vacant land. RCW 35.79: This chapter of state law stipulates the state's requirements for the process of vacating street rights -of -way. All requirements of this chapter that can be accomplished prior to the public hearing have been fulfilled. State law provides that the property within the portion of the alley to be vacated shall belong to the owners of the lots abutting each side of the vacated area, with one- half to the owners on each side of the vacated area. (RCW § 35.79.040) ZONING AND LAND USE: The property being vacated is considered public right -of -way and surrounding properties are zoned M -1 Light Industrial and used as commercial operations. DEVELOPMENT SERVICE TEAM REVIEW: On July. 2, 2008 a Development Service Team meeting was held to, discuss the possible impacts of this vacation. The following is a summary of,the comments received during that meeting. Water and Wastewater: No water or sewer lines located in the alley. 411 Building Permits /Codes: Any future development requires plan review, permit and inspections before occupancy. Engineering: No utilities in the alley. Traffic Engineering: Transportation Concurrency Review will not be required. PUBLIC USE OF THE RIGHT -OF -WAY: The subject right -of -way for this vacation is currently an un -paved alley with no curb, gutter or sidewalk. The proposed alley vacation does not serve any public purpose for access as all adjacent businesses have direct access upon a public street. As a result, the termination of this right -of -way will not impede or impact traffic within the area. CRITERIA FOR VACATION OF RIGHT-OF-WAYS City policy provides specific guidelines for right -of -way vacations. These guidelines include five criteria that must be met in the granting of vacation petitions. They are as follows: 1) The petition must explain the public benefit of the project, the reasoning of the proposed vacation and the limits of the vacation. The applicant states that the purpose of the alley vacation is to allow for the adjacent property owners to use the right -of -way as private property. The public benefit of this vacation includes • DOC. 3 Christen and UG Mission INDEX UAZO R/W Vac #2 -08 placing the property on the tax role. 2) The vacation of right-of-way does not deny any sole access to any property. This vacation request does not deny sole access to any property. 3) Petitions should be consistent with the six year Transportation Improvement Plan, Urban Area Comprehensive Plan and other official city plans and policies The current Transportation Improvement Plan (TIP) does not indicate any planned improvements to this right -of -way. 4) Vacation requests should be appropriate with existing and anticipated development in the area, based on zoning, current use and -long range plans. There is no anticipated development that would be :adversely . affected by this vacation. The zoning and long range plans for this area can also be considered in compliance with this request as infill is encouraged inside the city limits. The truck repair shop to the west is established as a Class (1) use in the M -1 zoning district. The vacant lots to the east and south side of the proposed alley vacation are also zoned M -1. Both lots are owned by the Union Gospel Mission. The UGM has no immediate plans for those properties. It should be noted that the UGM may be required to rezone their lots if future use of does not fit with the current zoning. 5) Existing utilities (public and franchised) should be relocated at the developer's expense • or an adequate easement provided. Where appropriate, if existing utilities are deemed unnecessary, this requirement may be waived. There are no public or private utilities in the unimproved right -of -way. Thus, the applicant is requesting this requirement be waived. FAIR MARKET APPRAISAL AND COMPENSATION TO THE CITE' City resolution R-2007-126 specifies the requirements under which compensation must be paid to the City for vacation of public streets and alleys. Compensation to the City is not necessary for this vacation. No compensation shall be required to be paid to the City on a vacation of a right -of -way which the City has not purchased, maintained, nor made any improvements to, and no planned or anticipated public purpose exists for the maintaining the right-of-way. R- 2007 -126 § 1(C) TRANSPORTATION CAPACITY MANAGEMENT ORDINANCE This project is an exempt activity under the Transportation Capacity Management Ordinance. ENVIRONMENTAL REVIEW Street vacations are categorically exempt from SEPA review. This is in accordance with WAC 197.11.800(2)(h) and YMC 6.88. Petition signatures for this vacation were obtained from the necessary two thirds of the property owners fronting this vacation. _ The applicants, as- owners of the -four abutting parcels, are joined in this petition. 2. The subject portion of unimproved alley right -of -way was dedicated to the City of Yakima by the Central Addition to North Yakima, recorded on April 3, 1907. 3. The proposal is consistent with the goals and objectives of the Urban Area Comprehensive Plan. • 4. This P roject is an exempt activity under the Transportation Capacity Management 5. Street vacations are categorically exempt from State Environmental Policy Act (SEPA) review. 6. The current Transportation Improvement Plan (TIP) does not indicate any planned use of the subject right -of -way. 7. If this request is approved, the vacated right -of -way shall be zoned M -1, Light Industrial. 8. No properties will be denied sole access to the public street system by vacating the right - of -way. All public and private uses within the block have frontage on a public street. 9. The petition for vacation of public right -of -way does not conflict with any planned street improvement projects or other plans or projects of the City of Yakima. 10. The intended use of the property, once vacated, will benefit the general public. 11. There are no public or private utilities located in the proposed right -of -way vacation: 12. Qwest Communications has buried plant (a large 400X copper backbone cable) that runs along the east side of Front Street and turns west at Oak Avenue, continuing in public right of way on the south side of Oak Avenue. There is a junction splice at the southwest comer of Oak Avenue and Gordon Road where the backbone cable continues north: From that splice another 200X cable runs back to the east and then south along the west side of the alley in question. This cable serves the property of Douglas Christen, where a business is located. In the interest of protecting this cable, Qwest objects to the vacation of this alley unless the following conditions are met: • 1. The petitioners (U.G. Mission & Doug Christen) must contact me at 457 -7313 to discuss this issue. 2. Qwest will require relocation of this cable and associated plant at the cost of the petitioners unless the petitioners agree to provide an easement that will allow ingress and egress to our facilities. Engineering plans as appropriate to indicate how the curb, gutter and - other physical features will be treated after vacation is enacted. Engineering plans are not appropriate, as the properties will be fenced into the accruing parcels. No curbs and /or gutters are needed. 6. A traffic analysis prepared by a Certified Engineer is required (this requirement may be waived). • Waiver requested, this vacation of right -of -way will have no impact on traffic. The right -of -way is unused and unimproved. DOC. INDEX 2. The applicant must submit a written narrative declaring how the proposed right-of-way vacat ion meets the criteria for approving petitions for right -of -way vacations as summarized below. a. The petition to vacate the right of way must explain the public benefits of the protect. the reasons for the proposed vacation and the limits of the vacation. The proposed right -of -way to be vacated is of no public benefit because it has never been used by the public for a thoroughfare. The right -of -way has never been improved with a roadway of any kind. The right -of -way is only twenty feet wide and approximately 200 feet in length. This right -of -way does not contain public or private utilities. Public benefit of this vacation includes placing the property on the tax role and permitting the adjoining property owners to use the right -of -way as private property. b. The vacation of any right -of -way cannot deny sole access to any property. No properties will be denied any legal access as a result of the proposed right-of-way vacation. All parcels that adjoin the proposed right -of -way vacation have direct access from other roadways in the immediate area. Specifically, all lots have direct frontage to the public streets of Gordon Road and Oak Avenue. c. Petitions should be consistent with the Six -Year Transportation Improvement Plan. the Urban Area Comprehensive and other official City Plans and policies. The existing right -of -way is unimproved and is not proposed to be developed as part of the Six -Year Transportation Improvement Plan, the City of Yakima's Comprehensive Plan or any other official City plan. d. Vacation of right -of -ways should be appropriate with existing and anticipated development in the area. based upon zoning, current use and Ionic range plans. 1111 The vacation is appropriate with existing development because both sides of the right -of -way are currently developed. On the west side is a vehicle towing and truck service. On the east side is the Union Gospel Mission. It should be noted, that the Union Gospel Mission has already fenced the 10 -foot portion of the unimproved right-of- way into their adjoining parcel. Property to the south is also owned by the Union Gospel Mission and does not contain any structures. Any anticipated development of this property can be served by the Union Gospel Mission's current facility, which lies to the east (from North 1. Street) and by Gordon Road which lies to the west. Gordon Road is a full width right -of -way that could ultimately be improved to serve anticipated development, whereas, this application vacates a partial (20 -foot wide) right -of -way. e. Existing and franchised utilities' located In the right-of-way to vacated should be relocated at the expense of the developer or an adequate easement provided. If it Is determined that such existing utilities do not need to be relocated, this requirement may be waived. There are no public or private utilities in the unimproved right -of -way. Following the DST meeting on Wednesday, June 2, 2008 it was determined that an easement will be required m the alley due to the fact that Qwest Communications has a buried cable in the alley. A public utility easement must be put in place. The easement will be established by the utility company and will specify the width needed to maintain their buried utility line.
