A RESOLUTION accepting Change Order No. 1 to City contract 2023-065 with Prospect
Construction, Inc. for Project WP2631 Primary Clarifier Rehabilitation.
WHEREAS, Prospect Construction, Inc. was selected as the contractor and City entered
into an Agreement for the rehabilitation of two of the four primary clarifiers at the wastewater
treatment plant in the amount of$3,787,978.00; and
WHEREAS, the number of original contract working days requires extension due to a
change in manufacturer's lead time for clarifier mechanical components following the City and
Prospect entering into the contract; and
WHEREAS, the addition of 49 working days through the change order will allow the
wastewater treatment plant to remain in compliance with State regulations for primary clarifier
capacity during construction; and
WHEREAS, the total cost is $119,656.35 for the extension of 49 working days associated
with Change Order No. 1; and
WHEREAS, the City Council finds that it is the best interest of the City of Yakima and its
residents to proceed with approval of Change Order No. 1; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute Change Order No. 1 between the City
of Yakima and Prospect Construction, Inc. for additional working days required for Project No.
WP2631 Primary Clarifier Rehabilitation at the Wastewater Treatment Plant.

The following changes are hereby made to the Contract Documents:
ITEM 1: Additional Contract Days
•
The Contractor shall keep one clarifier available for emergency service at any given time.
The lump sum cost for this work is• $119,656.35
Justification: The additional work is at the request of the Owner. During design, equipment procurement
timelines were established and verified which lead to a phased approach during construction to complete
the necessary refurbishments with limited downtime of the clarifiers. The project was phased according
to lead times of available equipment and anticipated weather windows into Phase I and Phase II of
construction. Following contract award, it became apparent that some equipment for Phase I is now, not
available during the Phase I anticipated timeline. Equipment delivery delays will increase downtime of
the clarifiers, leaving an extended period of time where the plant would lack redundant operating back-
up clarifiers. During the initial review of the Contractor's schedule and based on equipment
procurement and delivery dates,the Owner decided that they do not want both Primary Clarifiers out of
service for an extended period of time. As a result,the Contractor modified the construction schedule to
mitigate downtime of the clarifiers. This adds approximately 49 days to the construction schedule and
installation of temporary equipment.
Working Days: 49 working days are added to the Substantial and Physical Completion Contract Times.
CHANGE TO CONTRACT PRICE
Original Contract Amount(without tax): $3,787,978.00
Current Contract Amount, as adjusted by previous change orders. $3,787,978.00
The Contract Amount due to this Change Order will be increased by: $119,656.35
The new Contract Amount(without tax) due to this Change Order will be• $3,907,634.35
CHANGE TO CONTRACT TIME
The Substantial Completion Contract Time will be increased by 49 working days, for a total of
129 working days.
The Physical Completion Contract Time will be increased by 49 working days, for a total of
139 working days.

This document will become a supplement to the Contract and all provisions in the Contract will apply
hereto. The Contractor acknowledges and agrees that by executing this change order he foregoes all
rights and privileges of acquiring any additional compensation for any known or unknown claims of any
type or nature, to include but not be limited to, any additional work, delays, extended office overhead,
design omissions, changed site conditions, or any oral directions as of the date of the execution of this
change order. Other than as outlined in this change order, all other terms and conditions of the original
contract remain unchanged.

SUMMARY EXPLANATION:
The City of Yakima entered into Contract 2023-065 with Prospect Construction, I nc. for the
rehabilitation of two of the wastewater treatment plant's four primary clarifiers. Following contract
award, the manufacturer of the clarifier mechanical components extended the lead time and
delivery dates for the mechanical components. The delay in component delivery dates requires
modification of the construction schedule to meet the State requirements for maintaining
adequate primary clarifier capacity throughout construction.
The attached Change Order No. 1 provides for the addition of 49 working days to the contract at
a total cost of $119,656.35.
