ITEM TITLE: Set date of February 3, 2009 for an Open Record Public Hearing to consider the
recommendation of the Hearing Examiner to approve the vacation of two portions of public right -
of -way in the vicinity of 207 East "S" Street

SUMMARY EXPLANATION: Hordan Planning Services, on behalf of Dean Owens, has
submitted a petition for the right -of -way vacation of the following portions of right -of -way, which
are in the vicinity of 207 East "S" Street:
• That portion of the 13 -foot right -of -way lying westerly of Lot 7, Block 3, of Hines
Subdivision; and,
• That portion "S" Street Tying northerly of Lots 5 and 6, Block 6, and southerly of Lots 7
and 8, Block 3, and extended west to the west boundary of Hines Subdivision, as
recorded in Volume "B" of Plats, Page 32, Records of Yakima County, Washington.
• On December 11, 2008, the Hearing Examiner held an open record public hearing to consider
this vacation petition. On December 26, 2008, the Hearing Examiner issued his
recommendation for the approval of this petition. You are now being requested to set
February 3, 2009 as the hearing date for City Council consideration of the Hearing Examiner's
recommendation.

Examiner issued his recommendation for the approval of this right -of -way vacation.
