For Meeting of: November 3, 2015 ITEM TITLE: Ordinance amending YMC 9.50.085, Parking in the Right of Way to clarify the conditions for enforcement SUBMITTED BY: Joan Davenport, Community Development Director SUMMARY EXPLANATION: Generated by citizen complaints about traffic safety, City Code Enforcement sent a courtesy notice on September 1, 2015 to a number of auto dealers located on South First Street that were parking vehicles for sale on the street right of way between the sidewalk and curb, in violation of Yakima Municipal Code Section 9.50.085. In response to comments received from property owners about this section of the Municipal, the code was modified. Although this portion of the Municipal Code is based on the Model Traffic Code of the RCW 46.61.570, the City of Yakima may make modifications as necessary to these standards. The modifications provide some flexibility for property owners, protect traffic safety and pedestrians, as well as remove the current limitation that these rules only apply east of the BNSF railroad tracks. The Built Environment Committee reviewed this situation on September 17, 2015 and recommended this approach to the City Council. ATTACHMENTS: Description Upload Date Type D Ordinance Amending YMC 9.50..085, Parking lin ROW 10/2212015 Ordinance ORDINANCE NO. 2015 - AN ORDINANCE Of the City of Yakima related to traffic and parking, and amending Section 9.50.085 of the Yakima Municipal Code. WHEREAS, the City Council has received a recommendation from the Council Built Environment Committee and the Community Development Department to modify the parking restrictions related to vehicle parking between the sidewalk and the street; and WHEREAS, this revision was developed with citizen input after a courtesy notice to property owners was issued on September 1, 2015 ; and WHEREAS, this section of the Yakima Municipal Code is based on the requirements of the Model Traffic Code Revised Code of Washington Title 46.61.570, Rules of the Road, which the City of Yakima as a First Class city has the authority to modify as necessary; and WHEREAS, the Yakima City Council, having received the recommendation of the Community Development Department, and having considered all comments, directs this modification to the Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 9.25.020 of the Yakima Municipal Code is hereby amended to read as follows: Yakima Municipal Code Section 9.50.085 Stopping, standing, or parking within ten feet of the curb prohibited in specified places. (1) Except when necessary to avoid conflicts with other traffic, or in compliance with law or the directions of a police officer or official traffic - control device, or when permitted under Chapter 8.66 of the Yakima Municipal Code. No person shall stop, stand or park a vehicle: (a) On any part of a sidewalk at any time, or (b) Within the Vision Clear View Triangle defined in YMC 15.05.040, at any time, or (c) Between any sidewalk and the curb or edge of the paved roadway between 10 PM and 7 AM. (d) Within thc ar extending tcn feet from thc curb line or edge of roadway where no sidewalk is present. (2) This prohibition shall apply to thc arcs cast of thc Burlington Northcrn Railroad tracks. Section 2. Effective Date. This ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and by the City Charter.
