Discussion regarding the Cosen house (201 S Bch St) The Committee requested that Archie Matthews develop a draft of all options that are available regarding the Cosen house and the financial costs associated with each option. The report is to be presented at the January ONDS Committee meeting and a decision will be made at that time. 2. Discuss response to HUD EDI & Section 108 Monitoring Report Findings: 1. The City of Yakima's EDI Grant and Section 108 loans for 2005 through 2007 • were not reported in the Consolidated Annual Performance and Evaluation Report. Corrective Action: The City of Yakima will report to the CPD Field Office no later than December 15, 2008. 2. The City of Yakima's files did not show documentation required by HUD on jobs created. Corrective Action: City of Yakima will provide documentation required regarding jobs created to the CPD Field Office no later than December 15, 2008. 3. The City of Yakima has not maintained a record that represents the level of public benefit. Corrective ' Action: Submit in writing to the CPD Field Office, by no later than December 15, 2008, the number of full time equivalent, permanent jobs created by the assistance to the Hilton Garden and the Sports Center Restaurant. 3. Discuss Response to HUD HOME monitoring report HUD monitors conducted the ONDS annual monitoring in- September 2008. The following findings, concerns, and corrective actions taken are written in the draft letter to be sent to HUD: Findings: 1. Written agreements with individual homebuyers assisted with HOME funds. . Corrective action: The City is implementing a written agreement with individual homebuyers under the Homebuyer Assistance Program and with homeowners of units assisted with HOME rehabilitation funds that meet the requirements set forth in 24 CFR 92.504. 2. Written agreements addressing primary residency and affordability period. Corrective action: The City is implementing a written agreement to ensure that the requirement in 24 CFR Part 92.254(a) and 92.254(a)(4) are met and is to be included in all homes assisted with HOME funds as of December 15, 2008 3. Documentation of rehabilitation specifications addressed in bid specifications and inspection forms assuring rehabilitation standards and code compliance. Corrective action: The City will incorporate into the bid specifications written rehabilitation standards for each HOME funded rehabilitation activity, as well as documentation recording final inspections of HOME projects. 4. Rehabilitation activities that resulted in an investment of less than $1,000 per unit as per regulation requirement 92.205(c) Corrective Action: City immediately began to work with the regional HUD office in identifying and reimbursing Yakima's local HOME trust account as evidenced by enclosed documentation. Concerns: 1. Procedure to perform Subsidy Layering Reviews of HOME activities. Corrective action: The City of Yakima has added to its Neighborhood Development Services office procedures in reviewing proposed HOME projects the need for subsidy layering analysis to be completed as per described in CPD notice 98 -01 2. Participation Plan and definition of "Substantial Amendment ". Corrective action: The City is reviewing its Public Participation Plan and will • incorporate for future clarification "Substantial Amendment ", although the Consolidated Plan Amendment Policy does explain in detail that "Funding Allocations require an amendment when the disbursement is greater than 10% of the original allocation or 5% of the annual budget." 3. HOME assisted units not inspected prior to project completion. Corrective action: The City is implementing written "Initial Inspection" formsand "Final Inspection" forms. 4. Documentation of CHDO qualification. Corrective action: The City does require annual certification of qualified CHDO's or certification prior to the organization being funded as a CHDO..
