ITEM TITLE: Request from Yakima Air Terminal Board for Assistance Regarding 2008 and
2009 Stormwater Utility Bill

SUMMARY EXPLANATION: The Yakima Air Terminal Board has formally requested
assistance from the City of Yakima and Yakima County with respect to payment of their
second half of 2008 and first half of 2009 Stormwater Utility bills. Per the attached letter, the
Board is requesting the City and County each pay one half of the aforementioned bills. The
Board cites a financial hardship as well as new information from the Federal Aviation
Administration (FAA) regarding diversion of Airport funds as the basis of their request.
Fiscally, the Board's request for the outstanding 2008 balance and one half of the 2009 bill is
e l approximately $9,200 and $14,600 respectively, to be shared by the City and County.

Dear Commissioners and City Council:
As you are aware in 2008 the City established stormwater utility rates and began billing the Yakima Air
Terminal (YAT), along with all other properties, public and private throughout the City.
• The Airport Board and staff have been working closely with City staff to determine if in fact the airport is
required to pay stormwater fees or if it is exempt. • We recognize that the matter is complex and as such
will take time to evaluate and reach a final conclusion. .
Currently the 2009 YAT budget does not provide for the stormwater utility bill. Additionally, due to a
loss of other tenants and business activity at the YAT, revenues are not sufficient to absorb these
stormwater utility costs into our operating budget. The Airport has paid half of the 2008 stormwater bill .
and does not have remaining cash balance to pay the second half of the 2008 amount or the 2009 bill.
Given our current budgetary constraints, the YAT Board is requesting that the City and County pay the
• balance of the 2008 stormwater bill and the first half of 2009. If granted, this relief would allow the YAT
to avoid significant budget reductions and allow us time to work with the City as to the applicability of
these rates with respect to the Airport.
