SUMMARY EXPLANATION: -
Noel Properties submitted a petition for the right -of -way vacation of that portion of the 10 foot
wide alley located west of Naches Avenue between LaSalle Street and south of Rainier Street,
and a right-of-way vacation of an undeveloped portion of LaSalle Street west of Naches
Avenue. This vacation is being requested to allow the adjacent property owners to use the
411 vacated right -of -way as private property.
On December 17, 2008, the Hearing Examiner held and Open Record Public Hearing to
consider the vacation petition. On January 5, 2009, the Hearing Examiner issued his
recommendation for the approval of this petition. You are herein requested to accept the
Hearing Examiner's recommendation to approve the requested vacations.

Introduction. The chronology of the hearing process relative to this request to vacate
two portions of public rights -of -way can be summarized as follows:
1) The Hearing Examiner conducted a hearing on December 17, 2008. Assistant
Planner Alice Klein presented her staff report favoring the requested right -of -way
vacation. The applicant's representative, attorney Bryan Myre, testified in favor of the
request. No one testified or submitted written comments in opposition to this petition for
vacation of these public rights -of -way.
2) This right -of -way vacation recommendation has . been submitted within ten
business days of the hearing.
Summary of Recommendation. The Hearing Examiner recommends that the City
Council approve this request to vacate certain public rights -of -way subject to conditions.

Basis for Recommendation. Based upon a view of the site without anyone else
present on December 16, 2008; the staff report, exhibits, testimony and evidence
presented at an open record public hearing on December 17, 2008; and a review of the
Yakima Urban Area Comprehensive Plan, the Yakima Urban Area Zoning Ordinance,
Chapter 35.79 of the Revised Code of Washington and the City of Yakima's street
vacation policies; the Hearing Examiner makes the following:
FINDINGS
I. Petitioner/Property Owner. The petitioner /property owner is Noel Properties,
LLC, 1001 South 1 Street, Yakima, Washington.
II. Representatives of Petitioner/Property Owner. Justin Noel signed the petition
and application on behalf of Noel Properties, LLC, and Bryan Myre testified at the
hearing on behalf of Noel Properties, LLC.
III. Location. The rights -of -way involved in this request are in the following locations:
(1) The first requested vacation area is an unimproved platted north/south 10 -foot-
wide alley right -of -way about 275 feet long located west of South Naches Avenue
between Rainier Street on the north and LaSalle Street on the south. Assessor's tax
parcel numbers 191330- 12482, 12432, 12431, 12430 and 12429 abut the alley right -of-
way on the east and Assessor's tax parcel number 191330 -12005 abuts the alley right -of-
way on the west.

(2) The second requested vacation area is the unimproved east/west dead -end
portion of LaSalle Street west of South Naches Avenue. This 60- foot -wide street right -
of -way is about 133 feet long. Assessor's tax parcel number 191330 -12429 abuts the
street right -of -way on the north, Assessor's tax parcel number 191330 -12464 abuts it on
the south, Assessor's tax parcel numbers 191330 -12005 and 12014 abut it on the west
and South Naches Avenue abuts it on the east.
IV. Legal Description. The legal descriptions of the rights -of -way involved in this
request are:
(1) The 10 foot alley on the West side of Block "G" of SOUTH PARK
ADDITION to NORTH YAKIMA W.T. (now Yakima, Washington) as recorded in
Volume "B" of Plats, page 2, records of Yakima County, Washington, from the South
line of Lot 1 to a point 25 feet North of the South line of Lot 6 thereof.
(2) That portion of LaSalle Street lying between Lot 1, Block "G" and Lot 8,
Block "J" of SOUTH PARK ADDITION to NORTH YAKIMA W.T. (now Yakima,
Washington) as recorded in Volume "B" of Plats, page 2, records of Yakima County,
Washington; AND extending to the West line of said Plat.
V. Notices. The Yakima City Council set December 17, 2008, as the date for the public
hearing regarding this request for vacation of rights -of -way. That date was established by
Resolution No. R- 2008 -159 which was adopted on November 18, 2008, in accordance
with RCW 35.79.010. Notice of the hearing was given more than twenty days before the
hearing in the manner required by RCW 35.79.020 and was given in additional ways as
follows:
Posting of notice on the property: November 13, 2008
Posting of notice in three public places: November 20, 2008
Publishing of notice in newspaper: November 20, 2008
Mailing of notice to property owners within 500 feet: November 20, 2008

VI. Environmental Review. Street/alley vacations are categorically exempt from
SEPA review in accordance with WAC 197- 11- 800(2)(h) and Chapter 6.88 of the
Yakima Municipal Code.
VII. Transportation Capacity Management Ordinance. This request is an
exempt activity under the Transportation Capacity Management Ordinance.
VIII. Background. On October 17, 2008, the City Department of Community and
Economic Development received this petition to vacate two portions of platted rights -of-
way. Public records indicate that the rights -of -way proposed for vacation were dedicated
to the City in October, 1888 by the South Park Addition to North Yakima W.T. The
abutting properties located north, south, east and west of the rights -of -way proposed for
vacation had alleys that were previously vacated. Surrounding properties prevent any
future extension of the alley or street. The petition contains the requisite signatures of
two- thirds of the abutting property owners since petitioner Noel Properties, LLC owns all
the abutting parcels.
IX. Zoning and Land Use. The property on both sides of the portion of the alley
right -of -way to be vacated is zoned Light Industrial (M -1) except for three parcels on the
east that are zoned Two - Family Residential (R -2). Comprehensive Plan amendment and
rezone processes will be required for those parcels to have M -1 zoning for commercial
uses. The rights -of -way to be vacated and the parcels abutting them are all vacant except
for the petitioner's parcels containing commercial uses to the west.

X. Development Services Team. A Development Services Team meeting was held
on November 12, 2008, to discuss the possible impacts of approving the requested right -
of -way vacation. The following comments were received:
(1) Wastewater: A City sewer main runs though the existing alley and dead -end
street. In exchange for the vacation of the alley and street right -of -way, a sixteen foot
public utility easement shall be reserved and centered over the utility line(s) to allow
access to the sewer lines, manholes and clean -outs. A proper surface to accommodate
vehicles shall be maintained by the property owner. Access shall not be blocked by
fences. Permanent or temporary structures shall not be constructed within the easement.
The owner shall assume all liability for any claims filed in association with property
damage caused directly by a sewer backup from sewer pipes to which the City's access
was blocked or hampered by the property owner.
(2) Building Permits /Codes: No structures are allowed to be placed over any
portion of the easement.
(3) Engineering: An existing sewer line runs through the alley and street
proposed to be vacated. A sixteen foot easement shall be provided for the maintenance of
the City's sewer main.
(4) Traffic Engineering: There are no traffic- related concerns for the proposed
alley and street vacation.
XI. Criteria for the Vacation of Street or Alley Right - of - Way. City policy
provides the following criteria that are to be considered in determining the propriety and
requisites of street or alley right -of -way vacations:
(1) Public Benefit and Reasons Supporting the Proposed Vacation and the
Limits of the Proposed Vacation. The public benefit of the requested right -of -way
vacation would be to allow for the future expansion and development of the petitioner's
property. The proposed alley vacation would connect previously vacated portions of the

north /south alley, together with the dead -end portion of LaSalle Street. The property will
be placed on the tax rolls. There will be no future City street or alley maintenance costs
relative to the vacated property.
(2) Necessity for the Right -of -Way as Access to Property. The rights -of -way
involved in this request are not needed for access to any property because all abutting
properties have access to a public street. The properties have access to South Naches
Avenue on the east and South 3 Street on the west.
(3) Consistency with the Six Year Transportation Improvement Plan, the
Urban Area Comprehensive Plan and other Official City Plans and Policies. There
are no plans for improvement of the subject rights -of -way in the City's Six Year
Transportation Improvement Plan or in any of the City's other plans or policies.
4. Consistency with Existing and Anticipated Development in the Area Based
on Zoning, Current Use and Long -Range Plans. The requested right -of -way vacation
will not adversely affect any existing or anticipated development in the area. It will .
instead facilitate future development of the property. The three parcels presently zoned
for R -2 uses will have to be rezoned to M -1 if they are to be used for commercial uses in
the future.
5. Provisions for Relocation of Existing Utilities or Easements for Existing
Utilities. A 16- foot -wide easement will be required to be centered over the sewer main
located within the rights -of -way to be vacated.
6. Fair Market Appraisal and Compensation to the City. Compensation to the
City is not required under Subsection 1(C) of City Resolution #R- 2007 -126 because the
City has not purchased, maintained nor made any improvements to the rights -of -way to

be vacated and because no planned or anticipated public purpose exists for maintaining
the rights -of -way.
CONCLUSIONS
Based on the above Findings, the Examiner reaches the following Conclusions:
(1) The Hearing Examiner has jurisdiction and authority by virtue of Subsection
1.43.080(H) of the Yakima Municipal Code to conduct open record public hearings
regarding petitions and resolutions to vacate public street and alley rights -of -way and to
make recommendations to the City Council relative thereto.
(2) All public notice requirements for vacation of a street or alley right -of -way
have been completed in accordance with applicable statutes and ordinances.
(3) SEPA review was not required because street and alley right -of -way vacations
are categorically exempt from SEPA review.
(4) A traffic analysis report is not required for the requested right -of -way vacation
under the Transportation Capacity Management Ordinance.
(5) No properties will be denied access to the public street system as a result of
this right -of -way vacation.
(6) This request for public right -of -way vacation does not conflict with any
planned street improvement projects or other City plans or projects.
(7) The City's five criteria governing the approval of public street or alley right -
of -way vacations have all been satisfied.
(8) Compensation to the City is not required in this situation by City Resolution
R- 2007 -126.
(9) RCW 35.79.040 provides that the vacated rights -of -way should belong to the
abutting parcels of property which are all owned by the petitioner.
(10) The vacated rights -of -way should have the zoning of the abutting parcels to
which they are added. The abutting parcels are all zoned Light Industrial (M -1) except

for three parcels abutting the east side of the alley to be vacated which are zoned Two -
Family Residential (R -2).
RECOMMENDATION
The Hearing Examiner recommends to the Yakima City Council that the portion
of the platted north/south alley located west of Naches Avenue between Rainier Street
and LaSalle Street and the dead -end portion of LaSalle Street west of South Naches
Avenue, as described in R/W VAC #4 -08 and Petition #08 -09, SHOULD BE
VACATED subject to the following conditions:
(1) A 16- foot -wide easement for utilities shall be reserved and centered over the
existing sewer main to allow for maintenance of that sewer main. No buildings shall be
constructed over the easement. Any relocation of utilities will be at the developer's
expense.
(2) Upon vacation, the vacated property shall belong to the abutting parcels, one
half to each as provided by RCW 35.79.040.
(3) Upon vacation, the vacated property shall be zoned Light Industrial (M -1),
except that the east half of the alley right -of -way abutting the three parcels zoned Two -
Family Residential (R -2) shall be zoned Two - Family Residential (R -2).

SUMMARY OF RECOMMENDATION:
The City of Yakima Planning Division recommends approval of this vacation request subject to
conditions.
From the view of the site, the matters contained in the application, Development Services Team
comments and a review of the Yakima Urban Area Comprehensive Plan, the Yakima Urban
Area Zoning Ordinance, and RCW 35.79 staff makes the following:
FINDINGS

Request: Right -of -Way Vacation of that portion of the platted north/south alley located
west of Naches Avenue between Rainier Street and LaSalle Street and the dead
end portion of LaSalle Street west of Naches Avenue.
Parcel Numbers: Adjacent Parcels: 191330 - 12482, 191330 - 12432, 191330- 12431, 191330-
12430, 191330 - 12429, 191330- 12005, 191330 -12464 and 191330 - 12014.
Location: That portion of the 10 foot wide alley on the west side of Bloc "G" of South Park

Lot 1 to a point 25 feet North of the South line of Lot 6 thereof. And, that portion

Park Addition to North Yakima W.T. (now Yakima, Washington) as recorded in
Volume `B" of Plats, page 2, records of Yakima County Washington, AND
extending to the West line of said Plat.
BACKGROUND:
On October 17, 2008, The City of Yakima, Department of Community & Economic
Development received a petition from Justin Noel, on behalf of Noel Properties, for the vacation

of a platted, unimproved alley right -of -way located west of Naches Avenue between Rainier
Street, and the dead end, unimproved portion of LaSalle Street right -of -way that extends from
Naches Avenue approximately 133 feet west. All parcels involved in this petition request are
owned by Noel Properties, LLC.
The City has no future plans for development of the unimproved rights -of -way. The City of
Yakima's records indicate that the right -of -way for the north/south alley and streets were
originally dedicated by the South Park Addition to North Yakima W.T. on October 24, 1888.
The abutting properties located north, south, east and west of this proposal had alleys that were
previously vacated. Surrounding properties prevent any future extension of the alley or street.
The City of Yakima's records indicate the rights -of -way contain a public sewer main.
All adjoining parcels have direct access to Naches Avenue or South 3rd Street. The public will
benefit from this vacation as this will place the property on the tax roles and will permit the
property owner to use the vacated right -of -way as private property.
The petition was submitted with the necessary signatures to satisfy the requirement for
consideration of the proposed vacation. Justin Noel signed for Noel Properties LLC, owner of
all abutting parcels.
The petition for the vacation of this portion of alley right -of -way public hearing goes before the
Hearing Examiner on December 17, 2008. The date for a hearing before City Council to
consider the recommendation of the Hearing Examiner has yet to be determined.
HEARING EXAMINER AUTHORITY:
The Yakima Municipal Code states in YMC Chapter 1.43.080(H), that the Hearing Examiner
shall conduct public hearings on petitions and resolutions to vacate streets and public rights -of-
way pursuant to RCW Chapter 35.79. Decisions of the Examiner on such matters shall
constitute a recommendation to the City Council.
URBAN AREA COMPREHENSIVE PLAN:
The subject portions of rights -of -way, once vacated will have a Future Land Use Designation of
Industrial and Medium Density Residential.
URBAN AREA ZONING ORDINANCE:
Technically, street and alley rights -of -way are un- zoned. However, upon vacation they become
zoned the same as the immediate contiguous properties. In this case, the contiguous zoning on
both sides of the subject alley are Light Industrial (M -1) and Two - Family Residential (R -2). The
zoning surrounding the dead end portion of LaSalle Street is M -1 The three parcels zoned R -2
will need to go through the Comp Plan Amendment process and a rezone request to Industrial
zoning. The rezone change will designate the parcels for commercial use. All the parcels,
associated with this right -of way vacation, currently are vacant land.
REVISED CODE OF WASHINGTON (RCW) 35.79
RCW Ch. 35.79 stipulates the State's requirements for the process of vacating street rights -of-
way. All requirements of this chapter that can be accomplished prior to the public hearing have

been fulfilled. State law provides that the property within the portion of the street and alley to be
vacated shall belong to the owner(s) of the lots abutting each side of the vacated area, with one -
half to the owners on each side of the vacated area. (RCW § 35.79.040)
DEVELOPMENT SERVICE TEAM REVIEW:
On November 12, 2008 a Development Service Team meeting was held to discuss the possible
impacts of this vacation. The following is a summary of the comments received during that
meeting.
Wastewater
A City sewer main runs through the existing alley and dead end street. In exchange for the
vacation of the alley and street right -of -way ,a sixteen foot public utility easement shall be
reserved and centered over the utility line(s) to allow access to the sewer lines, manholes and
clean -outs. A proper surface to accommodate vehicles shall be maintained by the property
owner. Access shall not be blocked by fences, permanent or temporary structures shall not be
constructed within the easement. The owner shall assume all liability for any claims filed in
association with property damage caused directly from a sewer backup from the sewer pipes in
which the City's access was blocked or hampered by the property owner.
Building Permits /Codes:

Engineering:
An existing sewer main runs through the alley and street proposed to be vacated. A sixteen foot
easement shall be provided for the maintenance of the City' s sewer main.

No traffic related concerns for the proposed alley and street vacation.
PUBLIC USE OF THE RIGHT -OF -WAY:
The subject right -of -way for this vacation is currently an un -paved alley and street without curb,
gutter or sidewalk. The proposed alley and street vacation does not serve any public purpose for
access as all adjacent businesses have direct access upon a public street. As a result, the
termination of this right -of -way will not impede or impact traffic within the area.
CRITERIA FOR VACATION OF RIGHT -OF -WAYS
City policy provides, specific guidelines for right -of -way vacations. These guidelines include
five criteria that must be met in the granting of vacation petitions. They are as follows:
1) The petition must explain the public benefit of the project, the reasoning of the
proposed vacation and the limits of the vacation.
The applicant states that the purpose of the alley vacation is to allow for the adjacent property
owner(s) to use the, right -of -way, for future expansion. The public benefit of this vacation
includes placing the property on the tax role. This proposed alley vacation connects to the
previously vacated portions of the north/south alley, together with the dead end .portion of
LaSalle Street.

2) The vacation of right -of -way does not deny any sole access to any property.
This vacation request does not deny sole access to any property. All lots have access to South
Naches Avenue on the east and South 3rd Street on the west side.
3) Petitions should be consistent with the Six Year Transportation Improvement Plan,
Urban Area Comprehensive Plan and other official City plans and policies
The current Transportation Improvement Plan (TIP) does not indicate any planned improvements
to the right -of -ways.
4) Vacation requests should be appropriate with existing and anticipated development in
the area, based on zoning, current use and long range plans.
There is no anticipated development that would be adversely affected by this vacation. The three
lots, currently zoned Two - Family R -2, will be rezoned in the future as the R -2 zoning does not
conform to the existing commercial use.
5) Existing utilities (public and franchised) should be relocated at the developer's expense
or an adequate easement provided. Where appropriate, if existing utilities are deemed
unnecessary, this requirement may be waived.
There is an existing public utility (sewer main) in the unimproved right -of -way. The applicant
will provide an easement over the utility lines.
FAIR MARKET APPRAISAL AND COMPENSATION TO THE CITY
City resolution R- 2007 -126 specifies the requirements under which compensation must be paid
to the City for vacation of public streets and alleys.
Compensation to the City is not necessary for this vacation. No compensation shall be required
to be paid to the City on a vacation of a right -of -way which the City has not purchased,

PUBLIC NOTICE
The Yakima City Council set the date, of this public hearing for street vacation, on November
18, 2008 by Resolution No. R -2008 -159. This is done in accordance with RCW 35.79.010.

CONCLUSION:
1. Petition signatures for this vacation were obtained from the necessary two thirds of the
property owners fronting this vacation.
2. The subject portion of unimproved alley right -of -way was dedicated to the City of
Yakima by the South Park Addition to North Yakima on October 23, 1888.
3. A traffic analysis for this proposal was not required.
4. Street vacations are categorically exempt from State Environmental Policy Act (SEPA)
review.
5. The petition for vacation of these public rights -of -way does not conflict with any planned
street improvement project or other plans or projects of the City of Yakima.

6. If this request is approved, the vacated right -of -way shall be zoned Light Industrial (M -1)
and Two - Family Residential (R -2).
7. No properties will be denied sole access to the public street system by vacating the right -
of -way. All public and private uses within the block have frontage on a public street.
8. The intended use of the property, once vacated, will benefit the general public.
9. A 16 foot easement shall be reserved within the vacated street and alley for the
maintenance of the City sewer main.
10. All necessary requirements for street vacations in RCW 35.79 are met.
11. No compensation is required for this vacation.
12. No comments were received in opposition to this proposal.
RECOMMENDATION
The City of Yakima Planning Division, therefore, recommends that the petition for the right -of-
way vacation of the dead end portion of LaSalle Street west of Naches Avenue and the platted
alley between Rainier Street and LaSalle Street west of Naches Avenue be approved, subject to
the following conditions:
1. A 16 -foot easement shall be reserved for the maintenance of the existing sewer
main. No buildings shall be constructed over the easement. Any relocation of utilities
will be at the developer's expense.
2. Upon vacation, the property within the limits so vacated shall belong to the
abutting property owners, one -half to each (RCW 35.79.040), and shall be zoned as
Light Industrial (M -1) and Two - Family Residential (R -2).

I recently had a permit meeting and site visit with Sam Brackney, Noel Canning's Manager. He showed me the
old CF Freight building, adjacent to Noel Canning (south side) that they plan to demolish. He said that they plan
to construct a 150,000 square feet warehouse, which will be used to store pop and fruit beverage inventory. He
•
indicated that they do not plan to use the facility for pop/fruit beverage processing at this time. I understand
however, that per their documentation to the City Planners, they left that open in the future. Their wastewater
discharge permit has language in it that they are required to notify the City in advance should they have a change
in use.

Minimum 16' public utility easement required. Easement should be centered over public sewer
line.
Public Utility easements for wastewater pipes shall allow for the access of Wastewkater
equipment to all sewer manholes and clean -outs. A proper surface to accommodate these
vehicles shall be provided and maintained by the property owner. Access shall not be blocked by
fences. The property owner should not plant landscaping or construct permanent or temporary
structures within the easement. In the event that access or repairs cause the removal of any
fences, structures or landscaping, the property owner shall assume the risk and costs associated
with the removal and/or replacement. In addition, the owner shall assume all liability for any
claims filed in association with property damage caused directly from a sewer back up from the
sewer pipes in which the City's access was blocked or hampered by the property owner..

3. This form is primarily for the purpose of establishing the principle applicant for any
proposal to vacate a street or right of way. Often, there may be many parties involved
in a right of way vacation. It is important to establish which party . is responsible for
supplying the technical or detailed information required in this procedure.

Persons or parties wishing to vacate a public street, alley or right of way (for access)
must first submit a petition which provides a legal description of the area. The petition
must be signed by property owners of two- thirds of the abutting property.
In addition, a narrative should be submitted which includes the following information:

vacated should be relocated at the expense of the developer or an adequate

be relocated, this requirement may be waived.
ATTACHMENTS
The following items should be.submitted to complete this application for the vacation of
public streets or alleys. Some items may be waived by the Department of
Community and Economic Development, if just cause for such waiver is submitted by
the applicant.
'17 A title searc.h_or_report, is required to be submitted describing the legal status
and ownership of the right of way (this requirement may be waived),
2. A survey of the area to be vacated (this requirement may be waived) ,
�3. The petition must contain an accurate legal description of the area to be
. vacated and should be accompanied by a map which identifies the area. A
survey plat may be substituted for another map.
✓4. A fair market appraisal if the adjoining assessed values indicate expected value
greater than $4,000. The complete policy of the Yakima City Council regarding
required compensation from Right of Way Vacations is found in Resolution
D -5630, adopted by the Yakima City Council on September 12, 1989.
(512 Engineering plans as appropriate to indicate how the curb, gutter and other
physical features will be treated after the vacation is enacted.
6. A traffic analysis prepared by a Certified Engineer is required by the City of
Yakima Department of Public Works which describes the impact to the City
transportation network of the closure of the right of way. (This requirement may
be waived.) The City Traffic Engineer will provide guidance in determining the
scope of the review required for each individual case.

NARRATIVE STATEMENTS CITY OF YAKIMA
PLANNING DIV.
1. The applicant owns all adjacent parcels to the subject alley and street requested to be
vacated.
2. a. The proposed vacation includes a portion of alley of which the section to the north and
the section to the south have previously been vacated, together with a dead end and
unimproved portion of La Salle Street.
The vacation is needed for a proposed plant expansion.
The subject parcels are currently being occupied and used by the applicant. There are no
benefits to maintaining these remnant portions of alley and street.
b. The vacation will not deny sole access to any parcels. All adjacent parcels have street
frontage on other streets.
c. The application does not compromise any official City plans or policies.
d. The vacations are appropriate and consistent for the existing and anticipated development
in the area based upon existing and proposed zoning, current use and proposed long range
plans.
e. There are no existing curb, gutter or other public physical features to be dealt with within
the subject areas.
3. There is an existing 8" sewer main in the alley which may remain by easement.

January 5, 2009
On December 31, 2008, the City of Yakima Hearing Examiner rendered his
recommendation on R/W Vac #4 -08, Petition #08 -09. The application submitted by Noel
Properties, LLC is to vacate street and alley rights -of -way in the vicinity of 1014 South
Naches Avenue. The application was reviewed at an open record public hearing held on
December 17, 2008.
A copy of the Hearing Examiner's Findings and Recommendation is enclosed.
The Hearing Examiner's Recommendation will be considered by the Yakima City
Council in a public hearing to be scheduled. The City Clerk will notify you of the date,

The City of Yakima Department of Community & Economic Development has received a petition from

Naches Avenue between LaSalle Street and Rainier Street, and the undeveloped portion of LaSalle
Street located on the west side of Naches Avenue. The public alleyway is adjacent to parcels of record

A RESOLUTION fixing December 17, 2008 as the date for a public hearing before the
Hearing Examiner. This hearing concerns a petition from Noel
Properties, LLC to vacate the 10 foot alley on the West side of Block "G"
of South Park Addition to North Yakima W.T. (now Yakima, Washington)
as recorded in Volume "B" of Plats, page 2, records of Yakima County,
Washington, from the South line of Lot 1 to point 25 feet North of the
South line of Lot 6 thereof, and; that portion of LaSalle Street lying
between Lot 1, Block "G" and Lot 8, Block "J" of South park Addition to
North Yakima W.T. (now Yakima, Washington) as recorded in Volume
"B" of Plats, page 2, records of Yakima County Washington, AND
extending to the West line of said Plat.
WHEREAS, pursuant to RCW 58.17.212, a petition has been filed with the City Clerk,
requesting the vacation of a public right -of -way located within the City of Yakima, a true copy of
which petition is attached and incorporated into this resolution; and
WHEREAS, such a petition has been signed by the owners of more than two- thirds (2/3)
of the property abutting upon the public right -of -way (or portion thereof) which is requested to
be vacated, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The above - referenced petition for vacation is hereby referred to the Hearing Examiner
for public hearing pursuant to section 1.43.080 of the City of Yakima Municipal Code. The
Hearing Examiner is directed to make written recommendation to the City Council regarding
said petition. The Hearing Examiner Public Hearing shall be held on December 17, 2008 at
9:00 a.m. in the City Council Chambers of City Hall, which date and time are not more than
sixty (60) days nor less than twenty (20) days after the passage of this resolution.'
It is further resolved that the City Clerk give notice of the Hearing Examiner in the form and
manner prescribed by RCW 58.17.080, RCW 58.17.090 and Section 1.43.080 of the City of
Yakima Municipal Code.

Right -of -way Vacations are considered and approved under the Yakima Municipal Code (YMC) Title 14
and are pursuant to the Revised Code of Washington (RCW) Chapter 35.79. The application for a right-
of-way vacation was submitted on June 11, 2008. Following initial review this application has been
determined to be complete as of July 18, 2008. Continued processing of your request will include, but is
not limited to the following actions:
1. We will petition the City Council for a date before the Hearing Examiner
2. Upon receiving a date for the Hearing Examiner, a Notice of Petition & Public Hearing will be
sent to property owners within 500 feet of the site. A 20 -day7 comment period is provided by the
City of Yakima for public comments.
3. During the comment period a staff report will be prepared by the Planning Division, which will
include any recommended conditions of approval.
4. The City of Yakima Hearing Examiner will hold the identified public hearing at 9:00 a.m. on the
specified date in the City of Yakima Council Chambers.
5. Following the public hearing, the City of Yakima Hearing Examiner will render his
recommendation to the City Council on this matter within ten (10) business days. The Hearing
Examiner's recommendation goes forward to the Council for final action.
