We had hoped this trend would come and go quickly, however in the last month, more bikini barista businesses have opened. Each time one of these businesses opens we do verify that the business is complying with the City ordinance. We also respond to citizen complaints by explaining what is prohibited under the City of Yakima Municipal Code and inviting complaints for violations of this Code. Many cities across the state are dealing with this same issue and in many cases more extreme situations than we are dealing with here in Yakima (City of Bremerton - baristas in pasties). Regulation of Clothing: An individual's right to express themselves through clothing choice is generally an expressive activity protected by the First Amendment of the United States Constitution and the Washington State Constitution. Regulating clothing choice immediately raises constitutional questions. A city can regulate nudity or indecent exposure in public places. The City of Yakima Municipal Code contains such a provision: YMC 6.55.020 Indecent exposure. - 110 A. It is unlawful for any person to willfully make an indecent exposure in a p ublic place or at a place and under circumstances where such exposure may be observed by any member of the public. An indecent exposure is an exposure of a person's genitals or parts • thereof, pubic hair, or pubic area, cleavage of the buttocks or female breasts below the top of the areola. C. This prohibition shall not be construed to limit or restrict lawful expressive nude activity. Any exposure accomplished primarily for the purpose of sexual gratification or stimulation of one's self or another is not lawful expressive nude activity. D. Except as provided in subsections (1) and (2) of this section, indecent exposure is a misdemeanor: (1) Indecent exposure is a gross misdemeanor on the first offense if the person exposes himself or herself to a person under the age of fourteen years; (2) Indecent exposure is a Class C felony if the person has previously been convicted under this section or of a sex offense as defined in RCW 9.94A.030. The conduct that has been exhibited to date by the bikini baristas operating within the City of Yakima is not in violation of the City Code. I credit the strength of this ordinance with preventing the outrageous conduct occurring in other Washington cities. Zoning Regulation: 411 The Yakima Municipal Code does regulate the location of adult entertainment businesses, and depending on the type of business, may require a license. The bikini baristas do not fit the definition of an adult entertainment business. "Adult entertainment" means any exhibition or dance of any type, pantomime, modeling or any other performance, conducted in premises where such exhibition or dance involves the exposure to view of any portion of the breast below the top of the areola or any portion of the pubic hair, anus, buttock, vulva and/or genitals. The primary purpose of the bikini baristas within the City of Yakima is to sell coffee not to provide adult entertainment. They are not subject to the zoning codes or the licensing requirements that apply to adult entertainment businesses. We could consider zoning regulations as a means to control where bikini barista businesses are located, however, such zoning codes would have to be content neutral and apply to all coffee stands. cc.
