RE: Sandwich Boards- Chapter 15.08
Yakima Urban Area Zoning Ordinance
The Code Administration Division has been receiving complaints due to the
enforcement of Chapter 15.08 (Signs), which addresses sandwich boards, the
majority of which are in the right -of -way. Several business owners have
questioned our enforcement efforts, which they feel interferes with the ability to
advertise their business.
On April 1, 2010, I attended a CDY meeting at their request due to business
owners complaining about the enforcement of sandwich board regulations.
Business owners at the meeting made valid points for sandwich boards to be
legal.
Currently, the present language in Chapter 15.08. 110 (Temporary Signs) states:
1. No temporary sign shall be displayed for more than thirty days at any one
time, nor more than ninety days during a calendar year
2. Only one temporary sign on each street frontage per parcel or lot is
permitted
3. No temporary sign shall be placed in a required parking space, driveway,
or clear -view triangle
4. No temporary sign may be placed in the public right -of -way or an
easement unless specifically permitted by the city /county
5. Temporary signs placed on the ground shall be separated from parking
and driveway areas by a curb or other barrier.
6. No temporary sign shall be displayed more than fifteen days after the
event for which it is intended
Currently, there is no provision to permit a temporary sign within a public right -of-
way. The City of Yakima has two regulatory license permit applications which
regulate "Right -of Way Use Permits" and also "Sidewalk Cafes.
Should council wish to amend the Yakima Municipal Code to allow sidewalk
sandwich board signs on the right -of -way, staff offers the following
recommendations:
• Require appropriate liability insurance
• Establish maximum size limits for sandwich boards to be located in the
city's right -of -way
• Limit the number of sandwich boards per business
• Provide guidance on where approved sandwich board signs may be
placed in the right -of -way to assure safe position and ADA (Americans
with Disability Act) accessibility
• Amend existing temporary sign restrictions to be consistent with the new
language permitting right -of -way signs
• Indemnify and Hold Harmless the City of Yakima and its employees and
agents from any and all claims.
Historically, sandwich board signs have been problematic for enforcement for the
City of Yakima codes division. Enclosed are two pictures of sandwich board
signs in another city.
