RESOLUTION NO. R-2023-032
ratifying the declaration of an emergency and authorizing the City
Manager to execute all applicable contracts for the 2023 police vehicle
order
WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal
Code Chapter 1.80 provide that the City Council may declare an emergency and waive the
bidding requirement for supplies, material, equipment or services; and
WHEREAS, the Yakima Police Department's fleet has reached or exceeded end of
service life and creates a risk of interrupted emergency services to the community; and
WHEREAS, Bud Clary Ford announced a limited window on July 27th, 2022 to order
vehicles due to the ongoing supply chain issues and backlog of unfilled orders throughout the
state; and
WHEREAS, an emergency was declared by the City Manager on August 31, 2022
allowing the Yakima Police Department to proceed with the purchase of the vehicle order; and
WHEREAS, the purchase price for the 2023 police vehicle order exceeds $50,000
resulting in the need to seek ratification by City Council via resolution, in accordance with City
of Yakima Administrative Code ADM 3-500 City/County Procurement Manual which requires
approval by City Council for emergency costs; and,
WHEREAS, the City Council deems it to be in the best interest of the City and its
residents to ratify the City Manager's declaration of an emergency, and authorize the execution
of all necessary contracts for the 2023 police vehicle order, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The emergency, as declared on August 31, 2022 by the City Manager is hereby ratified,
the City Council resolves that there was an emergency, and the City Manager's execution of all
appropriate documents for the police vehicle purchase is hereby ratified and approved.

2023 Policc Vchicl ―Emergency PO Exception rcqucsts
On July 27th,20221received notif-rcation from Bud Clary Ford regarding the vehicle order banks
for 2023. Ford has decided due to the ongoing supply chain issues and backlog of unfilled orders,
to open the 2023 order bank for only a few weeks during the month of August, 2022. In essence,
this gives govemment customers such as the City of Yakima only a few weeks to place orders for
the 2023 year.
Normally, the order banks open in August/September of this year, and close in March/April of the
spring. The City of Yakima would normally place orders during the month ol January, when the
2023 budget is opened.
For the 2023 budget year the Police Department had planned on replacing 11 vehicles and 2
motorcycles. Several of these vehicles have reached or exceeded end of service life. One in
particular is no longer road worthy. To fund these vehicles, the Department planned to use existing
funds within the 552 police vehicle replacement fund. Currently there is slightty more than I
million dollars in this account. I am working on current build quotes, but we would be requesting
to allocate up to $700,000 of the fund balance to make these purchases.
I have already communicated with Purchasing Manager Maria Mayhue and Fleet Manager Kerry
Jones to prepare for this process. They suggested requesting an emergency PO authorization to
place orders now. Once approved we will be able to issue the PO's for the vehicles and secure the
orders for 2023.
The Department is requesting emergency authorization to issue PO's for the planned 2023
replacements immediately, in order to meet the deadlines imposed by Ford. The funding for these
purchases would be later approved as a budget amendment by council using the Department's 552
replacement fund.
If the Department were not able to place these orders by the deadlines this month, it would not be
abf e to replace the vehicles until late 2024 at the earliest. This would create a risk of interrupted
emergency services to community when the vehicles break down or are no longer serviceable.
Chief Murray has is aware of and has approved making this request. The order bank closes on

ITEM TITLE:Resolution ratifying the declaration of an emergency and authorizing
the City Manager to execute all applicable contracts for the 2023
police vehicle order

SUMMARY EXPLANATION:
Bud Clary Ford announced a limited window on July 27th, 2022 to order vehicles due to the
ongoing supply chain issues and backlog of unfilled orders throughout the state. The Yakima
Police Department followed the City's Emergency Purchase policy prior to placing the order with
Bud Clary Ford.
The final cost of the replacement exceeded $50,000 resulting a ratification by City Council via
resolution, in accordance with the City of Yakima Administrative Code ADM 3-500 City/County
Procurement Manual which required approval by City Council for emergency costs. The
approved Emergency Justification form, Purchase Agreement, and Purchase Order are attached
for City Council review. The emergency police vehicle order is funded through Police Capital
Fund 333.
