R-2010-41 authorizing and directing the City Manager of the City of Yakima to amend the Agreement with the State of Washington Department of Social and Health Services, and the Professional Services Agreement with Kraft Consulting, to extend the Greater Yakima Valley Healthy Marriage and Responsible Fatherhood Program. WHEREAS, the "Greater Yakima Valley Healthy Marriage and Responsible Fatherhood Community Demonstration Initiative" is a federally funded five-year community demonstration initiative intended to facilitate and study the creation of a community coalition providing programs and supporting efforts designed to strengthen family relations, reduce family violence through education and related public services, cooperate with Child Support Enforcement to reach their clients and increase parental financial responsibility towards their children; and WHEREAS, the State of Washington has obtained an OCSE Federal Office of Child Support Enforcement Waiver Terms and Conditions allowing the City of Yakima to obtain federal IV -D match funds to continue to operate the "Greater Yakima Valley Healthy Marriage and Responsible Fatherhood Community Demonstration Initiative" child support enforcement demonstration project for an additional three months; and WHEREAS, the City of Yakima is supporting this effort by serving as a subrecipient and fiscal agent for the disbursement of federal IV -D match funds granted for the project, as authorized by Resolution R 2006-91 at Council's June 6, 2006 meeting; and WHEREAS, the City of Yakima and the State of Washington Department of Social and Health Services now wish to continue this agreement through June 30, 2010; and WHEREAS, KRAFT CONSULTING, a business within the State of Washington, with offices at 408 North First Street, Yakima, Washington, 98901, specializing and experienced in directing, developing and managing complex strategic planning, has been acting as the Executive Director for the "Greater Yakima Valley Healthy Marriage and Responsible Fatherhood Community Demonstration Initiative" child support enforcement demonstration project, otherwise knownas"Healthy Families Yakima" since June of 2006; and WHEREAS the City of Yakima and Kraft Consulting now wish to continue this. agreement through March 31, 2011; and WHEREAS, the City Council of the City of Yakima has reviewed the attached amendment to the existing Agreement, which is responsive to City of Yakima concerns; and WHEREAS, the City Council of the City of Yakima deems it to be in the best interest of the City of Yakima to amend the agreement with Department of Social and Health Services for three months and the Professional Services agreement with Kraft Consulting for an additional year, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute agreements substantially similar to the attached documents. The City Council of the City of Yakima specifically authorizes minor drafting changes, said changes to be approved by the City Manager in consultation with the Yakima City Attorney. No other understandings or representations, oral or otherwise, regarding the subject matter of this Agreement Amendment shall be deemed to exist or bind the parties. All other terms and conditions of the original Agreement remain in full force and effect. The City of Yakima will comply with the following requirement for procurement procedures: (a) Federal regulations require grantees to follow their own procurement procedures as long as they comply with state laws and federal regulations. For purchases not covered under state law, such as professional services, grantees must follow procurement methods set forth in federal regulations. For purchases that exceed $100,000, grantees must formally bid the contract. Grantees may solicit services from only one vendor when they determine awarding the contract is not feasible using bids or competitive proposals, the goods and services are available only from one source or competition is determined to be inadequate. Grantees and subgrantees must document their procurement efforts. All other terms and conditions of this Contract remain in full force and effect. SUBMITTED BY: Cindy Epperson, Deputy Director, Accounting & Budgeting CONTACT PERSON/TELEPHONE: Linda Kraft, Executive Director, 452-1519 Cindy Epperson, 575-6070 (- SUMMARY EXPLANATION: At their June 6, 2006 meeting, City Council adopted Resolution 2006-91 that authorized the City Manager to enter into an agreement with the State of Washington Department of Social and Health Services, Division of Child Support (DSHS), so that the City could act as fiscal agent for a federal child support enforcement demonstration project, which was established as the Healthy Families Yakima program, led by Linda Kraft, Executive Director. The federal program had a 5 year commitment; however, the original contract with the state was only executed for 2 years, with an option for 3 one-year extensions. Because of a three month lag between the original start date of the contract and the date that activities actually began, this contract amendment with DSHS extends the agreement for three months (at their request), from 4/1/10 thru 6/30/10, with no additional consideration. In June, there will be another contract amendment extending the program for the fifth and final year, from July 1, 2010 thru June 30, 2011, with an additional $198,000 in funding available. The contract with the Executive Director is also nearing the end of the fourth year. That agreement has mirrored the contract with the State in the past; however, the City is extending the contract to add the fifth year, as originally set forth in the 2006 agreement. If the program is not entirely wrapped up at the end of this amendment period (March 31, 2011), the City will then negotiate with the Director to extend the contract, so that all of the final grant close-out can be completed before the amended Federal deadline of June 30, 2011. (Currently, the Director is maintaining the targeted completion date of March 31, 2011.) The attached resolution will authorize the City Manager to amend both the State Agreement to continue the project for an additional three months, and the Agreement with Kraft Consulting to continue the project for an additional year.
