Staff included City Manager Zais, City Attorney Cutter and City Clerk Kloster
County Commissioners Leita, Elliot and Bouchey arrived at 7:00 p.m. for the joint public
hearings.
2. Invocation /Pledge of Allegiance
Council Member Dave Ettl gave an invocation and led the Pledge of Allegiance.
3. Open Discussion for the Good of the Order
A. Proclamations
• 2010 Census
Mayor Cawley read a proclamation declaring the City's support for the 2010 census.
Mary Place accepted the proclamation.
B. Presentations /recognitions/introductions
• Yakima Valley Warriors arena football
Michael Mink, Greg Dourian, and Steve Sheldon described their activities and the
upcoming season's schedule, beginning April 3 at the Sundome.
C. Status reports on prior meeting's citizen service requests
• Request from Carole Skolrud for pedestrian safety on 88 Avenue
Bill Cook, CED Director, reviewed the report and advised that the City's Engineering
Division will be meeting with Apple Valley elementary school to discuss a solution.
This street segment is proposed to be included in the City's 6 -year Transportation
• Improvement Plan.
D. Appointments to Boards, Commissions and Council Committees
• Community Review Board
ACTION: Benjamin Shoval was appointed to the Community Review Board. VOTE:
Unanimous
4. Consent Agenda
ACTION: Motion carried to approve the consent agenda. VOTE: Unanimous

The Council committee meeting minutes were approved.
5. Audience Participation
Dave Tompkins, owner of Northtown Coffee House, received a notice of non - compliance
for his sandwich board placed on the sidewalk. He asked Council to reconsider the part
of the ordinance that addresses that issue. A staff report will be provided at the next

meeting.
Jim Evans complained about lack of response from the City on the Doty house project
on 44 and Summitview Avenues. Staff will provide an update on the project at the next
business meeting.
Candy Turner objected to the "Word of the Month — Tolerance" that is on reader boards
in the city. Council advised that the School District is in charge of the word selection and
referred her to their board.
Mike Hunnel accused the Council and City staff of discrimination against the disabled.
He asked for restructuring of administration personnel. He requested a meeting with
Mayor Cawley and Assistant Mayor Coffey to discuss the city's alleged non - compliance
of the ADA law.
Javier Gutierrez asked if the City, still owned Fisher Park because he did not see it on the
Yakima School Board's new design plans for Eisenhower High School
expansion /reconstruction. Council advised him the City still owned the park.

6. Joint City /County open record public hearing to consider the City of Yakima Planning
Commission's recommendation for amendments to the Yakima Urban Area Zoning
Ordinance (UAZO), Yakima Municipal Code Title 15 and Yakima County Code 15A
The public hearing was held. No one came forward to speak. Council approved by
consensus to add it to the April 6 agenda to allow for further review.
7. Joint open record public hearing to consider the City of Yakima Planning Commission's
recommendation on proposed text amendments to the Yakima Urban Area
Comprehensive Plan and Transportation Plan 2025
The public hearing was held. Jamie Carmody spoke in favor of the proposed text
amendments.
ACTION: Motion carried to pass the ordinance. VOTE: Unanimous

8. Second public hearing and consideration of a resolution adopting the Office of
Neighborhood Development Services Citizens Participation Policy
The public hearing was held. No one came forward to speak.
ACTION: Motion carried to adopt the resolution. VOTE: Unanimous

11. Public hearing regarding panhandling enforcement
The public hearing was held. The following citizens spoke about their experiences with
aggressive panhandlers:

Brunais; Ruth Simmons; Dave Tompkins; James Mead; Lynn Hardin; George Zimmer;
Virginia Heether; Jamie Lee Stickel; Joe Mann; Sean Davido; Jamie Stickel
Council Member EttI has three letters from citizens to submit for the record. He also
stated his wife had an experience with an aggressive panhandler at an ATM.
ACTION: Motion carried to direct the City Manager to bring back options for Council
review. VOTE: Unanimous

CITY MANAGER'S REPORTS
12. Report from Police Department regarding crime -free rental housing
Lt. Foley gave an update on the crime -free rental housing program.
ACTION: Motion carried to accept the report. VOTE: Unanimous
13. Report from Public Works outlining the process for closure of 23` Avenue and Lincoln
stairwell
Public Works Director Chris Waarvick advised a public process is required if the City
pursues a right -of -way vacation or sale of the property. He also recommended
conducting a public process if the City elected to construct a fence to restrict access to
the stairwell. The issue will be reviewed by the Public Safety Committee who will
forward a recommendation to the full Council.
14. Consideration of a recommendation from the Council Economic Development
Committee for a resolution establishing policy for evaluation of requests for sewer
service outside the city limits within the urban growth area
ACTION: Motion carried to defer action on the resolution pending further discussion
with the County. VOTE: Unanimous
*15. Consideration of the 4 quarter treasury report from the Finance Department
ACTION: Report was accepted.
*16. Consideration of a Resolution establishing a vendor list for the City of Yakima for •
purchases of materials, equipment, supplies or services
ACTION: Resolution was adopted. RESOLUTION NO. R- 2010 -35
*17. Consideration of a resolution authorizing execution of a professional services agreement
with Landau Associates for geotechnical and environmental support services related to
the former landfill site

*18. Consideration of a resolution authorizing signatures for grant applications, filing annual
certifications and assurances and executing grants with the Federal Transit
Administration

Examiner's recommendation to vacate a portion of an alleyway in the vicinity of Chestnut
Avenue and 8 Street

The Council congratulated City Clerk Kloster on receiving the Certified Municipal Clerk
designation.
29. Adjournment — 9:22 p.m.
ACTION: Motion carried to adjourn to March 30, 2010 at 9:00 a.m. for a study session
on the chronic nuisance property ordinance and discussion regarding standing Council
meetings. VOTE: Unanimous
