They have reported continued criminal activity and graffiti. Planning. and Legal were consulted to create the attached process /option (memo attached). A quote from last July reveals that a chain -link fence barrier (with locked gates) on both ends of the opening would not exceed $4,500. A "matched" concrete barrier would likely exceed $60,000 to construct. The legal requirement to hold formal public processes is triggered by vacation of the • "right -of -way" or outright sale. • Staff suggests that some public process be engaged even in the case of closure by fencing with no sale or reversion of property. There may be concern by those who use the pathway appropriately. BOARD /COMMISSION /COMMITTEE RECOMMENDATION: A Transit/Transportation Planning Committee meeting is not scheduled until April 2010. COUNCIL ACTION: r 4111 Options and Process for Closure of 23rd Ave and Lincoln Stairwell March 12, 2010 The City owns the property in question and therefore has broad authority to make decisions regarding its use. There are several options to consider should it decide to alter the current disposition. 1.' Street Vacation (RCW 35.79) The City maintains a policy and procedure for petitions from property owners for street vacations. In this case, adjoining property owners could petition the City to vacate approximately 82 feet of the dedicated right of way for North 23rd Avenue, south of Lincoln Avenue. The Hearing. Examiner conducts a public hearing and submits a recommendation to the City Council for final action. Area of Vacation: Approximately 82 feet in length (from back of sidewalk on Lincoln Ave to the end of pavement on 23rd Avenue). The right of way is 50 feet in width. Area is estimated at 4,100 square feet. Utilities/Improvements in area to be vacated: A paved pathway, gas fine and a water line. In addition, the PP &L canal (piped in this area) is located in the right of way. Value of Area Vacated: Based on adjoining land assessed values, the approximate value of the 4,100 square feet considered for vacation is $12,300 ($3.00 per s.f.). Compensation to the City, based on a policy of 50% of the value of the land would be approximately $6,150. The cost of actual reconstruction of vacated right of .way is generally a responsibility of the citizens petitioning the City. 2. Closure Without Vacation The City may decide to close the property with a fence or wall. This could take place with the Hearing Examiner process similar to that described above. The closure of this pathway may generate public comment from citizens. If approved, to secure closure of the pathway, a fence may be required at the top and bottom of the area. Alternately, a concrete retaining wall could be constructed consistent with the frontage along Lincoln Avenue. The cost of the retaining wall and back -fill of soil is estimated at $60,000 plus the cost of any utility relocation that may be necessary. 3.
