HomeMy WebLinkAbout12/06/2022 Business Meeting83 MINUTES YAKIMA CITY COUNCIL December 6, 2022 City Hall — Council Chambers 5:30 p.m. Regular meeting; 6:00 p.m. public hearings — conducted in person and virtually via Zoom Roll Call Present: Mayor Janice Deccio, presiding, Assistant Mayor Soneya Lund (attending remotely via Zoom), and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera, and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Presentations / Recognitions / Introductions Apple Award for Rich Hunt Utility Services Supervisor Vanessa Sanchez introduced Water Service Specialist Rich Hunt, and Mayor Deccio presented him with a City Apple Award for his exemplary service to a citizen in need. Recognition of Corrections Officer Edward Opsahl for 21 years of service Police Chief Matt Murray, along with Corrections Manager Maritza Davis, introduced and recognized Corrections Officer Edward Opsahl for 21 years of service. 5. Council Reports No Council reports. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. (Items on the Consent Agenda are handled under one motion without further discussion —see motion directly below.) MOTION: Cousens moved and Byers seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the November 15, 2022 City Council regular meeting B. Approval of minutes from the November 29, 2022 City Council special meeting C. Resolution adopting Council Business meeting schedule for 2023 RESOLUTION NO. R-2022-157, A RESOLUTION adopting the City Council 2023 regular business meeting schedule. D. Resolution repealing Resolution R-2005-184 regarding four hours of holiday leave time RESOLUTION NO. R-2022-158, A RESOLUTION repealing Resolution R-2005-184 regarding four hours of holiday leave time. E. Resolution authorizing an agreement with People for People to provide assessment and case management services for the City of Yakima Community Diversion Program RESOLUTION NO. R-2022-159, A RESOLUTION authorizing an agreement with People for People to provide assessment and case management services for the City of Yakima Community Diversion Program through December 2023. F. Resolution authorizing a memorandum with the Department of Defense for a law enforcement support office program RESOLUTION NO. R-2022-160, A RESOLUTION authorizing a memorandum with the Department of Defense for a law enforcement support office program. G. Resolution authorizing an agreement with the Washington Traffic Safety Commission for impaired driving emphasis patrols RESOLUTION NO. R-2022-161, A RESOLUTION authorizing an agreement with the Washington Traffic Safety Commission for impaired driving emphasis patrols. H. Resolution authorizing grant acceptance from the U.S. Department of Housing and Urban Development, HOME -ARP Grant funds RESOLUTION NO. R-2022-162, A RESOLUTION authorizing acceptance of a grant from the United States Department of Housing and Urban Development for HOME American Rescue Plan (ARP) funds in the amount of $1,822,807. Resolution authorizing a grant with the Department of Commerce to provide funding to private and public utilities to help address residential customer arrearages as a result of the COVID pandemic RESOLUTION NO. R-2022-163, A RESOLUTION authorizing a Grant Agreement with the Washington State Department of Commerce for the Federally funded Residential Utility Page 2 of 6 85 Arrearages assistance program. J. Resolution authorizing a collective bargaining agreement for 2022-2025 with the International Association of Firefighters (IAFF) Local 469 RESOLUTION NO. R-2022-164, A RESOLUTION authorizing the City Manager to execute a collective bargaining agreement for 2022-2025 with the International Association of Firefighters (IAFF) Local 469 bargaining unit. K. Resolution approving a contingent settlement agreement by the City of Yakima and Medstar, LLC, and Medstar Cabulance, Inc. to settle the claim brought against the City of Yakima by Medstar, LLC, and Medstar Cabulance, Inc. RESOLUTION NO. R-2022-165, A RESOLUTION approving the conditional settlement agreement entered into by the City of Yakima and Medstar, LLC, and Medstar Cabulance, Inc. to settle the claim brought against the City of Yakima by Medstar, LLC, and Medstar Cabulance, Inc. L. Ordinance amending YMC Ch. 1.60 - Municipal Court ORDINANCE NO. 2022-037, AN ORDINANCE relating to Municipal Court: amending YMC Chapter 1.60, adding fees to the Master Fee Schedule, removing language pertaining to in- house probation services and violations bureau, and other housekeeping changes. M. Ordinance amending Title 7, Chapter 7.68.070 of the Yakima Municipal Code, Water/Irrigation Division, Cross -Connection Control ORDINANCE NO. 2022-038, AN ORDINANCE amending Title 7, Chapter 7.68, Water Division, of the Yakima Municipal Code, amending guidelines for backflow prevention assembly inspection and testing, and removing some of the consequences of noncompliance that are no longer in practice by the City. N. Ordinance amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2022 for various purposes (Second Reading) ORDINANCE NO. 2022-039, AN ORDINANCE amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2022 for various purposes. 7. Public Comment Randy Lust, resident, shared his concerns regarding speeding vehicles in the area of 66th Avenue and Chestnut Avenue and hopes the City will be able to install speed humps. The following downtown business owners spoke in opposition to downtown parking fees and suggested looking at other options: Steve Mercy, Trena Schab,Corie Ratliff, Joe Mann, Ben Hittle, Larry Hull, Jim Barth, Kathi Mercy and Jamie Burns. Andrew Holt, resident and Executive Director of D.A.Y., discussed the concerns D.A.Y. has received from business owners regarding downtown parking fees and spoke in opposition to to the fees. Tony Courcy, resident, requested notification of a future Council meeting regarding William 0. Douglas Trail, commented on the proposed Master Fee Schedule and asked questions regarding sidewalks in front of the mobile home park on Hathaway. Page 3 of 6 PUBLIC HEARINGS 8. Public hearing toconsider: A) Resolution adopting the amended Six -Year Transportation Improvement Program for the period of2023through 2028.and toamend the Transportation Systems Plan 2040; and B) Resolution amending the Yakima Urban Area Comprehensive Plan Capital Facilities Element City Engineer Bill Preston briefed Council onthe public hearing. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the resolutions bytiUoonly. MOTION: Cmumensmoved and Brown seconded tmadopt both resolutions. The motion carried byunanimous vote. RESOLUTION NO. R-2022-166, ARESOLUT1ON amending the adopted Six -Year Transportation Improvement Program (TIP) for the period of 2023 through 2028 and amending the Transportation Systems Plan 2O4U. RESOLUTION NO. R'2022-167. ARESOLUTUON to amend the Yakima Urban Area Comprehensive Plan Capital Facilities Element toincorporate the amended Six -year Transportation Improvement Program J I P) for the period of 2023 through 2028. DEPARTMENT ITEMS 9. Resolution authorizing the City Manager toamend the Lease Agreement with Grace City Outreach for property adjacent tothe wastewater treatment plant which imcurrently the location ofCamp Hope City Attorney Sara Watkins provided a brief description of proposed arriendr-nents to the Lease Agreement with Grace City Outreach for Camp Hope. The City Clerk read the resolution by title only. MOTION: Byers moved and Coumens seconded to adopt the resolution. The motion carried byunanimous vote. RESOLUTION NO. R-2022-168' A RESOLUTION authorizing the City Manager to amend the Lease Agreement Between the City of Yakima and Grace City Outreach for property adjacent to the wastewater treatment plant which is currently the location of Camp Hope. 10. Resolution authorizing a Memorandum of Understanding with Dispute Resolution Center of Yakima and Kittitas Counties, Yakima County, and OIC of Washington for management, facilitation and evaluation ofthe GRIT Vi||oge.Steering Committee, and structure Mayor Oaccioannounced this item impostponed toafuture agenda. 11. Ordinance tocreate mParking Services Fund (first reading) After Council discussion and amendment, the following motion was approved: MOTION: Page 4 of 6 87 Byers moved and Cousens seconded to table voting on the ordinance until the proponents have time to present alternatives to consider for 6 months. The motion carried by unanimous vote. 12. Ordinance amending the Yakima Municipal Code to place certain fees and charges in a City of Yakima Master Fee Schedule Finance Director Jennifer Ferrer Santa -Ines presented the draft ordinance to amend the municipal code by removing certain fees and charges and placing them into a Master Fee Schedule. The City Clerk read the ordinance by title only. MOTION: Cousens moved and Herrera seconded to pass the ordinance. The motion carried by unanimous vote. ORDINANCE NO. 2022-040, AN ORDINANCE removing certain fees from the Yakima Municipal Code so that those fees can be placed into the City of Yakima Master Fee Schedule via subsequent resolution. 13. Resolution Adopting The Master Fee Schedule for The City of Yakima Finance Director Jennifer Ferrer -Santa Ines presented the draft Master Fee Schedule for the City of Yakima. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-169, A RESOLUTION of the City of Yakima, Washington, adopting a Master Fee Schedule. 14. Other Business Assistant Mayor Soneya Lund reported that John Gasperetti resigned from the Arts Commission; the vacancy will need to be filled. 15. Adjournment MOTION: Cousens moved and Herrera seconded to adjourn to the next Council regular meeting on December 13, 2022, at 5:30 p.m. in the Council Chambers at City Hall. The motion carried by unanimous vote.
