For Meeting of: May 18, 2021 ITEM TITLE: Discussion of petition from lodging properties located within the Yakima County Tourism Promotion Area ("TPA")to charge an additional two dollars per night of lodging pursuant to RCW 35.101.057 in order to fund increased efforts to market tourism and convention opportunities within the TPA and support the recovery of those industries SUBMITTED BY: Ryan Bleek,Assistant City Attorney Steve Groom, Director of Finance & Budget SUMMARY EXPLANATION: In 2020, the Washington State Legislature granted local legislative authorities the ability, under RCW 35.101.057, to impose an additional charge of up to three dollars per night of lodging for stays at lodging businesses located within a TPA. In order to impose the additional charge, the Yakima City Council must receive signatures from lodging businesses who would pay sixty percent or more of the proposed charges. The signatories must specify the proposed uses and projects to which the proposed revenue from the additional charge shall be put, the total estimated costs, and the estimated rate for the charge. On April 14, 2021, the City received a petition from authorized representatives of lodging properties within the TPA whose collective room capacity comprises 78% of those rooms subject to the additional TPA lodging charge. The petition contains the proposed uses and projects to which the proposed revenue from the additional charge shall be put, the total estimated costs, and the estimated rate for the charge as required by RCW 35.101.057. The petition seeks to impose an additional two-dollar charge per night of lodging at stays within the Yakima County TPA instead of the allowable three-dollar charge. The current boundaries of the TPA include the City of Yakima and all unincorporated areas of Yakima County. In the event that Council grants the request to add the additional charge per nightly lodging stay, the procedure would first require passage of a resolution of intent to modify Chapter 5.99 of the Yakima Municipal Code entitled "Tourism Promotion Area." To help rebuild tourism, fourteen lodging properties are submitting the enclosed petitions to increase the Yakima County Tourism Promotion Area (TPA) assessment from the current $2.00 per night assessment to $4.00 as allowed by state statute. These lodging properties comprise 78% of the affected room inventory that pays the TPA assessment, exceeding the 60% requirement outlined in Engrossed Substitute Bill 6592. These funds will help with the recovery effort by bringing more visitors, generate new spending, support our local businesses and create jobs in the hospitality and tourism sectors. With the funds our community will also remain competitive against other destinations like Spokane and the Tri Cities, who have already increased their TPA assessments. ESSB 6592 authorized legislative authorities to impose an additional Tourism Promotion Area assessment charge of up to $3 per night per stay on furnishing of lodging by a lodging business with 40 or more rooms located in a Tourism Promotion Area("additional charge"). Any additional charge expires July 1,2027. To consider the imposition of an additional charge, signatures of the persons who operate lodging businesses who would pay sixty percent or more of the proposed additional charge must be provided to the legislative authority together with: 1. the proposed uses and projects to which the proposed revenue from the additional charge shall be put, 2. the total estimate costs, 3. the estimated rate for the charge, and 4. a proposed breakdown by class of lodging business if such classification is to be used; and WHEREAS,the affected lodging businesses within the City of Yakima and unincorporated areas of Yakima County desire to present to the City of Yakima Council(Council)an increase of the current assessment on all classes of lodging by$2 per night per stay for a total assessment of$4 per night per stay on furnishing of lodging by a lodging business located in the Yakima County Tourism Promotion Area. NOW, THEREFORE, pursuant to ESSB 6592, the signatories herein after of the persons who operate lodging businesses within the Yakima County Tourism Promotion Area who would pay sixty percent or more of the proposed additional charge provide to the Council their signatures and additionally: 1. the proposed uses and projects to which the proposed revenue from the additional charge shall be put, 2.the total estimate costs, 3. the estimated rate for the charge, and 4. a proposed breakdown by class of lodging business if such classification is to be used. 1. The marketing of Yakima County to the travel industry in order to benefit local tourism and result in overnight stays within the Yakima County Tourism Promotion Area; d. The marketing of Yakima County to recruit major sporting events in order to promote local tourism resulting in overnight stays within the Yakima County Tourism Promotion Area. 2. THE TOTAL ESTIMATED COSTS: Yakima Valley Tourism estimates that on an annual basis the revenue from the additional charge collected from the operators of Lodging Businesses within the Yakima County Tourism Promotion Area shall be an increase of approximately$641,400. This estimate is based on a six year average of the Tourism Promotion Area collections between 2014 and 2019. This amount will vary from year to year depending upon the fluctuating occupancy rates of Lodging Businesses in the City of Yakima and unincorporated areas of Yakima County subject to the additional charge. 3. ESTIMATED RATE FOR THE CHARGE Yakima City Ordinance 5.99.040 would be modified to increase the charge by$2.00 and to provide as follows: There shall be imposed a tourism promotion charge on the furnishing of lodging by a lodging business located in the Yakima County Tourism Promotion Area in the amount of four dollars per room per day. THE TOTAL ESTIMATED COSTS: Yakima Valley Tourism estimates that on an annual basis the revenue from the additional charge collected from the operators of Lodging Businesses within the Yakima County Tourism Promotion Area shall be an increase of approximately$641,400. This estimate is based on a six year average of the Tourism Promotion Area collections between 2014 and 2019. This amount will vary from year to year depending upon the fluctuating occupancy rates of Lodging Businesses in the City of Yakima and unincorporated areas of Yakima County subject to the additional charge. 3.
