Executive Session regarding pending litigation pursuant to RCW 42.30.110 (1)(i) Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund (attending remotely via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) MOTION: Brown moved and Cousens seconded to adjourn to an Executive Session for 30 minutes regarding pending litigation pursuant to RCW 42.30.110 (1)(1). The motion carried by unanimous vote. Executive session was held and adjourned at 5:16 p.m. 1. Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund (attending remotely via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Clear Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations National Family Literacy Day proclamation MOTION: Cousens moved and Byers seconded to accept proclamation. The motion carried by unanimous vote. Janice Deccio proclaimed November 1, 2022, as National Family Literacy Day and Judith Page 1 of 6 70 Panagakos accepted the proclamation. B. Appointments to Boards, Commissions and Council Committees Appointments to Sustainable Yakima Committee, Bike/Ped Committee, Lodging Tax Advisory Committee and Yakima Housing Authority Councilmember Cousens, Chair of the Council Nominating Committee, reported on meetings held on October 13, 18, and 20, 2022. MOTION: Byers moved and Brown seconded to appoint the following people to the Sustainable Yakima Committee: Jeff Scott, Jennifer Hickenbottom, Jeremy Leavitt, Dan Schapiro, Ray Paolella and Marcelino Osorio. The motion carried by unanimous vote. MOTION: Byers moved and Cousens seconded to appoint the following: Constance Anderton to the Bicycle/Pedestrian Advisory Committee; reappoint Charlie Robin, Angie Girard, Sara Allen, Kristie Holestine, and Lisa Vallejo to the Lodging Tax Advisory Committee; and, reappoint Bob Ponti and Linda Orozco to the Yakima Housing Authority. The motion carried by unanimous vote. 5. Council Reports None. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and Brown seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the October 18, 2022 City Council regular meeting and October 25, 2022 City Council study session B. Project Completion and Contract Acceptance of M Sevigny Construction Inc for the Yakima Police Department CID (SIU) Office Construction Project PD2648 C. Resolution accepting and approving 3rd Quarter 2022 Claim Report RESOLUTION NO. R-2022-143,A RESOLUTION accepting and approving the 3rd Quarter 2022 Claim Report for the City of Yakima. D. Resolution ratifying the declaration of an emergency for the protection of the 48-inch water transmission main and contract with Interwest Construction RESOLUTION NO. R-2022-144,A RESOLUTION ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the protection of the 48-inch water transmission main. Page 2 of 6 71 E. Resolution authorizing acceptance of grant awarded through the Archives and Records Management Division's Local Records Grant Program RESOLUTION NO. R-2022-145,A RESOLUTION ratifying a grant agreement with the Office of the Secretary of State Archives and Records Management Division for$22,218.11. F. Resolution authorizing an agreement with the Rotary Clubs of Yakima for the design, installation, and use of lighting at public recreation facilities RESOLUTION NO. R-2022-146, A RESOLUTION authorizing an agreement with the Rotary Clubs of Yakima for the design, installation, and use of lighting at public recreation facilities. 7. Public Comment Ken Wilkinson, Parks and Recreation Manager, thanked Dirk Bernd, President of Yakima Southwest Rotary, for the support from the local Rotary organizations to improve Parks and Recreation projects for the benefit of the community. Mr. Bernd thanked Council and the other Rotary groups for the partnership and spoke directly to the safety lighting project at Kiwanis Park. Joe Mann, resident and downtown business owner, spoke to the downtown parking plan and requested consideration for a free one or two-hour option to assist downtown businesses in encouraging shopping in the downtown area. PUBLIC HEARINGS 8. First public hearing on the 2023-2024 Preliminary Biennial Budget for the City of Yakima Jennifer Ferrer-Santa Ines, Director of Finance and Budget, reported on the 2023-2024 Preliminary Biennial Budget. She noted the second public hearing is scheduled for November 15, 2022. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. 9. Public hearing and ordinances pertaining to Ad Valorem Taxes to be levied for collection in Fiscal Year 2023 Jennifer Ferrer-Santa Ines, Director of Finance and Budget, reviewed the proposed ordinances pertaining to Ad Valorem Taxes. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the ordinances by title only. MOTION: Cousens moved and Deccio seconded to pass both ordinances. The motion passes by a 5-2 vote, with Brown and Byers voting no. ORDINANCE NO. 2022-031, AN ORDINANCE relating to the annual property tax levy; declaring the City Council's intent to increase the City's 2023 regular levy up to 101% along with new construction, annexation, refunds and growth in state-assessed property values from the amount levied the previous year. Page 3 of 6 72 ORDINANCE NO. 2022-032,AN ORDINANCE fixing and levying the amount of ad valorem taxes necessary to discharge the expected expenses and obligations for the 2023 Budget for the City of Yakima. 10. Public hearing and Resolution declaring certain property originally part of Drainage Improvement District#39, later abandoned by Yakima County and ceded to the City, to be surplus to City needs Mike Price, Wastewater Manager, introduced the item. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Cousens moved and Brown seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-147, A RESOLUTION declaring certain property originally part of Drainage Improvement District#39 later abandoned by Yakima County to be surplus to City needs and abandoning all interest to the property owners over which the pipeline extends. 11. Open record public hearing and Ordinance to consider the Hearing Examiner's recommendation regarding a right-of-way petition submitted by Columbus Cascade Company LLC to vacate 10 ft of public right of way at 609 South Front Street Assistant Planner Albert Miller briefed Council on the hearing. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the ordinance by title only. MOTION: Cousens moved and Byers seconded to pass the ordinance. The motion carried by unanimous vote. ORDINANCE NO. 2022-033, AN ORDINANCE relating to land use; vacating a portion of public right-of-way along S. Front St., in the City of Yakima, Washington. 12. Closed record public hearing and Resolution to consider the Hearing Examiner's recommendation regarding the preliminary plat of"Canterfield Estates"submitted by Mayling Chin located in the vicinity of 4802 Spring Creek Rd. Assistant Planner Albert Miller briefed Council on the resolution. Mayor Deccio opened the public hearing. Sylus Selberg of PLSA Engineering and Surveying, representing the developer, spoke in favor of the planned subdivision. Following the speaker, Mayor Deccio closed the hearing. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion Page 4 of 6 73 carried by unanimous vote. RESOLUTION NO. R-2022-148, A RESOLUTION approving the Preliminary Long Plat of Canterfield Estates, a 11-lot subdivision, located at 4802 Spring Creek Rd. DEPARTMENT ITEMS 13. 2022 Vacant Building Safety Project- 3rd Quarter Report Code Administration Manager Glenn Denman reported on the 3rd quarter 2022 vacant building safety project. 14. Ordinance amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2022 for various purposes (First Reading) Jennifer Ferrer-Santa Ines, Director of Finance and Budget, reported on the budget amendment, noting this is a first reading and will be brought back on November 15, 2022 for passage. 15. Other Business MOTION: Cousens moved and Byers seconded to add the Martin Luther King Jr., ad hoc committee to the next agenda. The motion carried by unanimous vote. Councilmember Byers reported she would be attending the Greenway Visitor's Center ground- breaking event and asked if any other Council members will attend. Mayor Deccio and Councilmember Cousens confirmed they will attend. Councilmember Byers presented a photo opportunity to take Council member photos at the winged mosaics at Miller Park, and thanked City employee Tammy Regimbal for the idea. MOTION: Lund moved and Cousens seconded to add a discussion regarding green paint for bicycle lane safety to the next agenda. The motion carried by unanimous vote. MOTION: Lund moved and Byers seconded to add discussion regarding Coolidge Road from 72nd Avenue to 84th Avenue to next agenda. The motion carried by unanimous vote. 16. Adjournment MOTION: Cousens moved and Brown seconded to adjourn to the next City Council regular meeting on November 15, 2022 at 5:30 p.m. in the Council Chambers. The motion carried by unanimous vote.
