RESOLUTION NO. R-2022-150
authorizing a Grant Agreement with the US. Department of
Transportation, Federal Transit Administration to provide funding
assistance for two fixed -route transit buses.
WHEREAS, in 2022, the City of Yakima (City) will order two 35-foot low floor Gillig buses
as part of Yakima Transit's capital vehicle replacement plan; and
WHEREAS, in 2022, the US. Department of Transportation, Federal Transit
Administration (FTA) opened up a grant funding opportunity under Federal Transit
Administration American Rescue Plan Act of 2021 program; and
WHEREAS, Yakima Transit applied for funding on June 27, 2022, and was awarded
funding, on September 15, 2022 in the amount of $1,100,000; and
WHEREAS, the two buses that will be ordered December of 2022 and will be delivered
on or around March of 2024; and
WHEREAS, it is necessary for the City and the FTA to enter into an agreement setting
forth the terms, conditions, and requirements for allocating this funding; now; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to enter into Grant Agreement WA-2022-063-
01-00 with US. Department of Transportation, Federal Transit Administration to fund six fixed -
route transit buses; is authorized to accept said grant funds to be applied to the purposes
specified above; and is further authorized to complete any other forms necessary to procure the
grant and/or grant funding.

GRANT AGREEMENT
(FTA G-29, October 1, 2021)
On the date the authorized U.S. Department of Transportation, Federal Transit
Administration (FTA) official signs this Grant Agreement, FTA has obligated and
awarded federal assistance as provided below. Upon execution of this Grant Agreement
by the Recipient named below, the Recipient affirms this FTA Award, enters into this
Grant Agreement with FTA, and binds its compliance with the terms of this Grant
Agreement.
The following documents are incorporated by reference and made part of this Grant
Agreement:
(1) "Federal Transit Administration Master Agreement," FTA MA(29),
http://www.transit.dot.gov,
(2) The Certifications and Assurances applicable to the FTA Award that the Recipient
has selected and provided to FTA, and
(3) Any Award notification containing special conditions or requirements, if issued.
WHEN THE TERM "FTA AWARD" OR "AWARD" IS USED, EITHER IN THIS GRANT
AGREEMENT OR THE APPLICABLE MASTER AGREEMENT, "AWARD" ALSO
INCLUDES ALL TERMS AND CONDITIONS SET FORTH IN THIS GRANT
AGREEMENT.
FTA OR THE FEDERAL GOVERNMENT MAY WITHDRAW ITS OBLIGATION TO
PROVIDE FEDERAL ASSISTANCE IF THE RECIPIENT DOES NOT EXECUTE THIS
GRANT AGREEMENT WITHIN 90 DAYS FOLLOWING FTA's AWARD DATE SET
FORTH HEREIN.

Award Executive Summary: This grant includes $1,100,000 in ARP Act - FY 2021
Section 5307 funding, which represents a portion of the amount that has been sub -
allocated to the Yakima urbanized area (small UZA). These funds will be used for the
purchase of replacement buses to help prevent, respond to, and recover from the
coronavirus pandemic.
Purpose:
The funds will be used for the purchase of approximately two (2) ADA accessible, low -
floor, 35 ft. diesel replacement buses, and related equipment to be installed on the
purchased buses, including but not limited to, cameras, automated passenger counters,
and safety equipment.
Activities to be performed:
Purchase of approximately two (2) buses and related equipment, to replace existing
vehicles that are past their useful life.
Expected Outcomes:
The vehicle replacements will help to maintain safe, efficient, and reliable transit
service.
Intended Beneficiaries:
Members of the general public within the City of Yakima and the surrounding areas.
Subrecipient Activities:
n/a
The Recipient certifies that it, and its subrecipients and contractors that are providers of
public transportation, have not furloughed any employees since March 27, 2020 (the
enactment date of the CARES Act).
*** Special Condition ***
The Recipient agrees that if it receives Federal funding from the Federal Emergency
Management Agency (FEMA) or through a pass -through entity through the Robert T.
Stafford Disaster Relief and Emergency Assistance Act, a different Federal agency, or
insurance proceeds for any portion of a project activity approved for FTA funding under
this Grant Agreement, it will provide written notification to FTA, and reimburse FTA for
any Federal share that duplicates funding provided by FEMA, another Federal agency,
or an insurance company.
Research and Development: This award does not include research and development
activities.
Indirect Costs: This award does not include an indirect cost rate.
Suballocation Funds: Recipient organization is suballocated these apportioned funds
and can apply for and receive these funds directly.
Pre -Award Authority: This award is using Pre -Award Authority.

SUMMARY EXPLANATION:
Yakima Transit was awarded funding from the Federal Transit Association (FTA) through the American
Rescue Plan Act (ARPA) of 2021 to be used towards purchasing two 35-foot low floor Gillig fixed -route
transit buses as part of Yakima Transit's capital vehicle replacement plan.
Yakima Transit was awarded $1,100,000 on September 15, 2022. These buses will be ordered
in December 2022 and will be delivered approximately in March of 2024. The buses will be
purchased with 100% funding from the ARPA of 2021. Local sales tax will not be needed for a
match. It is necessary for the City of Yakima to enter into Grant Agreement WA-2022-063-01-00
with FTA for allocation of this funding.
