HomeMy WebLinkAbout06/07/1965 Business Meeting JUNE 7, 1965 The City Council met in regular session, Mayor Larson, Councilman Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson and City Manager Smith and City Attorney Andrews present on roll call. The Invocation was given by Councilman.Lynch. The Minutes of the regular meeting of June 1, 1965 having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Mayor_Larson welcomed to the Council Meeting, Linda Ketchen & Cindy Hals, Naches High School students, and Pat Bergseth, Davis Highschool- student, who are representing their respective schools at Evergreen Girls State. . An Ordinance appropriating $7,560 to the 1965 Current Expense Engineering Budget having been read in its entirety at the regular meeting on May 25, 1965, was read by title only at this meeting and it was MOVED by Robinson, seconded. by Brown that Ordinance No. 656, providing for said appropriation be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 656, AN ORDINANCE appropriating the amount of $7,560 from unappropriated money in the Current Expense Fund, to Account 124 -020, Part Time, Temporary, Overtime and Special Assignment, of the Salaries and Wages Classification of the 1965 appropriation for the Engineering In accordance with action taken by Council at the regular meeting of May 25, 1965, regarding a Notice of Intention to Commence Annexation proceedings filed by Buren Sheet Metal Co., Council met with the initiating party, Buren Sheet Metal, represented by Mr. Charles Buren on this date, ITune 7, 1965. In discussion of the matter of accepting the indebtedness of th- area proposed to be annexed, Mr. Buren, representing Buren Sheet Metal co. requested that thl- area to be annexed be rezoned M -1, and stated that if this is not possible he would like to withdraw his request.. for annexation. Council advised Mr. Buren that he should make this zoning a condition of his annexation petition. Council also informed Mr. Buren that it has been policy to zone property in accordance with property owners wishes in such a way as to avoid creating nonconforming uses. Council suggested that Mr. Buren attend Planning Com- mission meeting and let his request for M -1 zoning be known. Having discussed this matter fully, and Mr. Buren having stated to the Council that the area to be annexed is willing to assume its share of the city's existing indebtedness under the conditions as stated above, it was MOVED by Robinson, seconded by Lynch that the annexation proposed by said party be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the city's existing indebtedness; carried, Brazier, Brown, Kurbitz, Lambert, Lar- son , Lynch and Robinson voting aye by voice vote. . This being the time for the hearing on the assessment roll for L.I.D. 905, Edgecliff Manor, 40th Avenue and North First Street Water District, and there being no protests in writing or otherwise, it was MOVED by Lambert, seconded by Lynch that Ordinance No. 657, confirming said assessment roll and every part thereof be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. ORDINANCE NO. 675, AN ORDINANCE confirming the assessment roll covefing Local Improvement District No. 905 as created and established by Ordinance No. 395 of the Ordinances of the City of Yakima. This being the time for the hearing on Resolution No. D -810 being a resolution of intention to construct curb, gutter and surfacing of Tri Skool Addition and Other Streets, it was MOVED by Lynch,seconded by Robinson that an Ordinance providing for said improvements be passed as read; A letter of protest having been filed the City Clerk, June 7, 1965 by 100 percent of the home owners and land owners of the Airport Addition No. 2, protesting this L. I. D., it was MOVED by Brazier, seconded by Robinson that the area of South 15th Avenue from West Pierce Street to 136 feet South; the West half of South 14th Avenue from West Pierce Street to 136 feet South; and. the South half of West Pierce Street from South 16th Avenue to South 14th Avenue(Airport Addition No. 2) be eliminated from this L.I.D.., carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Present at this meeting and protesting the cost of said L.I.D. were Clyde Keltner, Lewis Hooper and a representative of the Gospel Hall Church.. A written protest to this L.I.D. was filed with the City Clerk on Jure7, 1965 by Myron Westmiller and others. Those present protesting also complained that the expense for replacing a private irrigation line under 44th Avenue, and which is being utilized by only one property owner in the area, is being included in the property owners assessment. Council asked the staff to study this matter further to ascertain if the user of the private irrigation line could find some other source for irrigating his property. It was then MOVED by Kurbitz, seconded by Robinson that this matter be continued for one week until the next regular meeting on June 14, 1965; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Petition No. 377 having been filed with the City Clerk on June 2, 1965 by A. S. Harker "re - questing the formation of a Local Improvement District for the construction of curbs, gutters and the surfacing of a portion of 57th Avenue, it was MOVED by Robinson, seconded by Lynch that said petition be referred to the City Manager and staff for study and re- commendation; carried, Brazier, Brown, Kurbitz, Lambert, Lynch and Robinson voting aye by voice vote. MOVED by Robinson, seconded by Lynch that. Ordinance No. 658, an ordinance changing names of certain streets within the city of Yakima be passed as read. On discussion of this matter, it was MOVED by Robinson, seconded by Lynch that Ordinance No. 658 be amended so that section 8 reads as follows: "That the name of the street, presently called East Lenox Avenue, from South 6th Street east to the east city limits of the City of Yakima, is hereby changed from East Lenox Avenue to East Nob Hill Boulevard. " and further amended to include Section 9 and 10 to read as follows: " That the presently unnamed street constituting an alternate alignment of East Lenox Avenue from South 6th Street west to the mainline track of the Northern Pacific Railway Company, on the overpass presently called the. Lenox Avenue Overpass is hereby named and shall hereafter be known as East Nob Hill Boulevard. Section 10. That - the name of the street, presently called West. Lenox Avenue, from the mainline track of the Northern Pacific Railway Company on the overpass presently called the Lenox Avenue Overpass west to the west city limits of the City of Yakima is hereby changed from West Lenox Avenue to West Nob Hill Boulevard. ": carried, Brown Lambert, Larson, Lynch and Robinson voting aye by voice vote. Brazier, and Kurbitz voting Nay. Mayor Larson then asked for a roll call vo e 31! - JUNE 7, 1965 on the original motion as amended to pass Ordinance No. 6 carried; Brazier, Brown,LambertG; Larson, Lynch and Robinson voting aye on roll call. Kurbitz voting Nay. ORDINANCE NO. 658, AN ORDINANCE changing the names of certain streets within the City of Yakima.. . MOVED by Lynch, seconded by Brown that Resolution No. D-822 a resolution relating to water rights held by the City of Yakima and authorizing and directing the City Manager to perform_ certain acts relating thereto be passed as read. Council requested an amendment of said ordinance. It was MOVED by Robinson, seconded by Lynch that Paragraph 1 of Resolution No. D -822, be amended to read as follows: "To request, through the State of Washington Departmen of Conservation, Division of Water Resources, that the 10 c.f.s. water right at Oak Flats and the 30 c.f.s. water right at Nelson Bridge be transferred to Rowe Hill "; carried, Brazie , Brown, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice_vote. Mrs. Roy Rice discussed with the Council the matter concerning diversion of water at Rowe Hill in connecti.n with City Irrigation system. Dewitt Tufts, representing " =.Gray & Osborne and Frank Stein, Director of Public Utilities, were in attendance during this discussion. Councilman Lynch stated that he had received a call from Mr. Newlun protesting the moving of the intake to Rowe Hill. Mayor Larson called for a roll call vote on Resolution No. D -822, as amended: carried, Brazier, Brown , Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll caul. RESOLUTION NO. D -822, A RESOLUTION relating to water rights held by the City of Yakima and authorizing and directing the city Manager to perform certain acts relating thereto. . MOVED by Robinson, seconed by Brown that Resolution No. D -823, a resolution authorizing the execution of a Modification Agreement with J. W. Orkney, be passed as read; carried, Brazier Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on roll call. RESOLUTION NO. D -823, A RESOLUTION authorizing and directing the City Manager and. City Clerk to execute .a Modification Agreement with J. W. Orkney MOVED by Lambert, seconded. by Brown that Resolution No. D -824, a Resolution denying a Damage Claim filed by Pacific Adhesives, Inc. be passed as read; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on roll call. The Planning Commission reporting on and recommending the rezoning of certain property lo- cated at 414 and 416 North Third Street as requested by Petition No. 373, filed by Barbara K. Small, Charles Wilcox and others, it was MOVED by Lambert, seconded by Robinson that June 21, 1965 be set as the time of hearing by the City Council on the matter of said rezone and that the City Clerk give notice of such hearing as required by law; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye onroll call. The Planning Commission having recommended that Section. 12.32.010, Use regulations be amended by adding item #35 under the list of permitted uses in the B -2 Zone, Item 35 to read - "Equipment rental of a type catering to neighborhood residential users ", it was MOVED'by Lynch, seconded by Lambert that June 21, 1965 be set as the time of heating by the City Council on this matter , and that the city clerk give notice of such hearing as re- quired by law: carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. The Planning Commission having recommended the rezone of certain property located at 35th and Englewood Avenue as requested by Resolution of Intention of the Planning Commission, and the Planning Commission reporting . on and recommending the rezone of certain property situated between 15th and 16th Avenue and between Lenox and Viola as requested by Planning Commission's Resolution of Intention, it was MOVED by. Robinson , seconded by Lynch that June 21, 1965 be set as the time of hearing by the City Council on the said rezones, and that the City Clerk give notice of such hearing as required by law; carried, Brazier, Brown, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote..
