The Invocation was given by Councilman Keith. . • • ill. The minutes of the regular meeting of December 8, 1969, having been duly certified accu- . rate by two Councilmen, and no -one. present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Mayor Larson. stated that'there are many persons, Boards and Commissions that have done very fine work for the City, and the City Council feels that recognition should be given at this time to these people, many of whom are present, all having been invited to attend this meeting. In giving recognition to the members of the Yakima Metropolitan Park Board, he gave a brief history of the Yakima Metropolitan Park District which will be dissolved as of December 31, 1969, and will become a part of the City government again. Mayor Larson explained that these members of - the. Yakima Metropolitan Park Board have in- dicated that they are willing to serve on the new Park and Recreation Commission -to be appointed by the City Council. He further explained that it is necessary to establish staggered terms of office for these people and drew names for this purpose as follows: J.S. Applegate, 6 years, Mer Edmondson and George P. • Shuford, 4 years, Mrs. Ruby Dobbs and John F.- .Chesterley, 2 years. After due discussion, it was MOVED by Keith, seconded by Robinson that these appointments to the Park and Recreation Commission be;ma.de-as drawn: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote.. Mayor Larson then .gave a brief history of .the,o,ther Boards and Commissions being recognized, these being,• City Planning Commission, City .Employees Civil Service • . Commission, Police & Fire Civil Service. Commission,..Yakima Vailey:Regional Library Board, Board of Appeals, Board of Adjustment,,Board of Plumber Examiners, Heating Board, and Fair Housing Review Board. Recognition was also given by the .Council. toMr. Mr. .Ed Putnam, II former Superintendent of Metropolitan Park District, who was present .at this meeting. A statement,by the . City Council,as a result of Budget Hearing.s,.1970, was read .by. Coun- cilman Walter J.,Robinson,. Jr. This statement represents the concensusof the City Council regarding major decisions to .be made in, adopting the 1970 Budget. .Mr. James Scott. ,Attorney representing the Police .Patrolman's Organization stated that the requested 15% • salary raise and 15 additional men is a minimum request.and indicated that they are dis- appointed at the City Council's suggested 10% raise and 6'addit.ional personnel. He further indicated that the Patrolmen's Association will meet this week and if they feel • it necessary may take this matter to the people, but did not state how they planned to do this. Lt. Bill Horst, President of the Yakima Fire Fighters Association, indicated that the Council's. suggested 10% salary raise for the Fire Fighters does not at all meet with the approval of the Association, and that they will also be meeting this week regarding this matter: City Manager McMicken stated that a meeting will be held with the Policemen's and Fire Fighter's Union Thursday, and that Ordinances will be prepared regarding the adoption of the 1970 Budget for the Council meeting on December 22, 1969. Mr. Al Coleman, Local 1122 representative, stated. that the Union will not make any statements regarding this matter until after the meeting on Thursday with the City Council. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 975, St. • Johns Street & Decoto Property Water District, and there being one protest in writing, it II was MOVED by Brown, seconded by McNeice that Ordinance No. 1187 confirming said assgHson ment roll and every part thereof, be passed as read: carried, Brown, Keith, Lambert, /Lust, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo explained that the one protest in writing was filed by James J.,Fulme-r, 1613 S.'12th Avenue, who did not protest when the district was formed, and. is now objecting because his property is outside the'City limits and they already have city water. No formal action needed • regarding this protest. ORDINANCE-NO. 1187, AN ORDINANCE confirming the assesment roll covering Local,Improvement District No. 975 as created and established by Ordinance No. 1123 of the Ordinances of the City of Yakima. . Petition No. 650, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on December 4,.1969; by George E. and Ethel M. Gruver, requesting annexation of property situated in the vicinity of North 53rd Avenue and Scenic Drive, it was MOVED by Robinson, seconded by. Lust that this date.be set as the time for a meeting with the initiating, party who signed the.Notice,of Intention to Commence Annexation Proceedings dated December 3, 1969, those initiating parties being George E. Gruver and Ethel M. Gruver: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and • Robinson voting aye by voice vote. Mr. and Mrs. Gruver,.being present and stating that . they are willing to accept the City's existing indebtedness,•it was :dulyTmoved, seconded and passed that the annexation proposed by Petition No. ,650 (Notice of Intention. to Com- mence Annexation Proceedings)- be accepted by the City of.Yakima and that the area sought to be annexed be required to assume the City's 'existing indebtedness. The above MOTION was made by Robinson, seconded by McNeice and carried, Brown, Keith, Lambert, Larson, Lust McNeice and Robinson voting aye by voice vote. . • Petition No., 651, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on December 12, 1969, by E.W. Poulin & Others, requesting annexation of property situated south of the present City Limits, eastward from the rail - • road right -of -way to beyond 1st Street, it was MOVED .by Robinson, seconded by Lust that this date be set as the time for a meeting with the initiating parties who signed the Notice of Intention to Commence Annexation Proceedings dated December 12, 1969, 'those initiating parties being Leone V. Miner, Lois Miner; Albert L.-Hughey, W.J. Beerman, Dona Beerman, Ed Miner, Irene Miner, E. W. Poulin and Blanch Poulin: carried, Brown; Keith, . Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. All the above r ` 0.p�yw� -fT�r 465 DECEMBER 15, 1969 listed initiating parties being present, with the exception of Albert L. Hughey who was unable to attend, and those in attendance being the owners of in excess of ten percent in value, according to the assessed valuation thereof, of the property for which annexation is being petitioned, and stating that they are willing to accept the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition no. 651 (Notice of Intention to Commence Annexation Proceedings) be, accepted by the City of Yakima and that the area sought to be be required to . assume the City's existing indebtedness. The above MOTION was mode by Robinson, seconded by Brown and carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. A Damage Claim having been filed with the City Clerk on December 12, 1969; by James McQuade,. 314 S. 8th Avenue, for the amount of $25,000 punitive damages, it was MOVED by Keith, seconded by Brown that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. It was MOVED by Brown, seconded by McNeice that Ordinance No. 1188 creating the Department of Auxiliary Police and repealing the existing Ordinance relating to Civil Defense and Special Police, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. City Attorney Andrews referred to his Memo regard- ing this ordinance,and two others to be acted upon at this meeting, in accordance with in- structions from the City Council for him to prepare legislation to dissolve the City Civil Defense Department effective January 1, 1970. He explained that originally the Auxiliary Police Department was organized under the City Civil Defense program, and now that the City ":Civil Defense program is to be dissolved, in order to retain an Auxiliary Police Depart- ment this Ordinance creating said department has been prepared. He further explained that the Animal Control Officer and the parking metermen also had special and limited police authority under the chapter in the Yakima Municipal Code relating to Civil Defense and as that chapter is repealed, other legislation must be enacted to .commission those officers. ORDINANCE NO. 1188, AN ORDINANCE relating to local government administration; creating a Department of Auxiliary Police and providing for its organization and administration; re- pealing existing Sections of the City of Yakima Municipal Code providing for a Civil De- fense Department and for special police commissions; adding Section 1.48.050, Auxiliary Police Department, as a new section, and repealing Sections 1.18.190, 5.63.010, 5.63.020, 5.63.030, 5.63.040, 5.63.050, 5.'63.060, 5.63.070 and 5.6.3.080, all of the City of Yakima Municipal Code; and declaring an emergency. It was MOVFn by McNeice, seconded by Lust that Ordinance No. 1189 specifying duties of Division of General Accounting of Department of Finance and relating to parking metermen, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson I/ voting aye on roll call. ORDINANCE NO. 1189, AN ORDINANCE relating to local government administration; specifying duties of the Division of General Accounting of the Department of Finance; amending Sec- ' tion 1.18.065 of the City of Yakima Municipal Code; and declaring an emergency. It was MOVED by Lambert, seconded by Lust that Ordinance No. 1190 specifying duties and authority of the Animal Control Officer, be passed as read: carried, Brown, Keith, Lambert Larson, Lust, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1190, AN ORDINANCE relating to local government administration; specifying the duties and authority of the Animal Control Officer; amending Sections 1.18.052 and 1.18.053 of the City of Yakima Municipal Code; and declaring an emergency. City Manager McMicken reported that bids were received and considered by a Bid Board on December 9, 1969, on the construction of Naches.River Raw Water.Intake, as follows: Mountain States Construction Co., Sunnyside $176,317.63 Venture Construction, Auburn 182,826.93 W. H. Gregory Company, Portland, Oregon 226,138.00 Public Works Director John Mayo explained that this is actually the installation of gates and fish screens for the raw water intake that could not be done prior, to this, and stated that in accordance with a letter from our Consultants, Cornell Howland, Hayes & Merryfield recommending that the contract be awarded to Mountain States Construc- tion Company, Sunnyside; Washington, the low bidder on this project, the engineering department concurs, with this recommendation. It was ,MOVED by Robinson, seconded by Brown that the recommendation of the City Engineer and the Consultants be accepted, and that the bid be awarded to Mountain States Construction Co., Sunnyside, Washington, in the amount of $176,462.00, and that the City Manager be authorized to enter into a contract with said contractor upon the filing the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, _Lust, McNeice and Robinson voting aye by voice vote. Public Works Director explained that a letter had been received from W. H. Gregory Co., Portland, Oregon protesting the bid award and requesting that the Bid be awarded to them because of some technical error in the bids of the other two bidders, but that in conferring with our consultants it was found that these minor technical errors were corrected and the bid should be awarded as recommended.' City Manager McMicken explaining that additional money is required to finance remodeling projects at the Yakima Municipal Airport, and the money is available within the 1969 Airport Budget, it was MOVED by Robinson; seconded by Brown,that Resolution No. D -1421 authorizing the transfer of $1,500 within the 1969 Budget, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1421, A RESOLUTION transferring the amount of $1,500 within the 1969 appropriation for 390 - Airport. 16— • 654 DECEMBER 15, 1969'. . City Manager McMicken explaining that additional,money is needed to provide for overtime pay for holidays and for payment of other miscellaneous expenses in the Transit Department ' it was MOVED by Brown, seconded by Keith that Resolution No. D -1422 authorizing the transfer of $2,500 within the 1969 Transit Department Budget, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1422, A RESOLUTION transferring the amount of $2,500 within the 1969 appropriation for 410 - Transit Department.
