Councilmen Brown, Keith, Lambert, J,,ust, McNeice and Robinson, City Manager McMicken and City Attorney'Andrews presen on roll call. • The Invocation was given by.Councilman Keith. The minutes of the regular meeting of November 17, 1969, and the adjourned meeting thereof, having been. duly certified accurate. by two Councilmen and no one present wishing toi..have said minutes read,publicly, Mayor -Larson declared said minutes approved as recorded. Mayor Larson presented awards received from the Association .: of `Wash•ingt'or Cities . for Al Richards, who has been with the City since 1945 and who is currently the Street Superinten- dent and for Kenneth Knight, who has been with "the City since 1956 and is currently with the Engineering Division. John Mayo, Public Works Director, explained that last spring he received a letter from the Association of Washington;Cities asking if he felt there were ;ny men who deserved special recognition, the prime requirement being that these men have • worked for the City for a minimum of ten years. He stated -that 30 awards were given out and the City of Yakima was the only one to receive two. Both men being present:accepted their certificates and expressed appreciation. Mayor Larson then presented an awardreceiVed"from the Federal Bureau of Investigation for fl Captain K.J. LaRue. Mr. LaRue'attendeda 12 week course at the F.B.I. Academy • It was felt that is a great honor- for'the City'of Yakima and the Yakima-Police Department. . Chief Robert Madden stated that Captain LaRue finished the course among the top ten student:.. He explained that he had submitted an application this year hoping to be accepted into this school within the next two or three years and was accepted the first year. Captain LaRue was.the only representative from Washington. He stated'that he felt that the Yakima Police Department, thanks to the present administration', is comparable if not higher than - that of . any other Police Department that he come in contact with. • • An Ordinance appropriating $8,500 ,in the City Garage Fund, having been read in its en- tirety at this meeting, was laid on the table for one week or until December 1, 1969. City Manager McMicken explained that'this appropriation is'necessary to reimburse funds used:'for the removal Of snow, in January o,f this year. • City Manager McMicken referred to. the matter of authorization to;engage George Lemon,.SRA, for right of way acquisition services. He. stated that preliminary approval for the South 24th Avenue improvement has been given. The City has already had Mr. Ralph Korn appraise this property so that we know that the City's offers are appropriate and in line with • comparable sales in the area. He reported that Mr. Lemon is charging $125 per day for eig hi hours of work.. A letter from Mr. Lemon which set forth conditions for the completion.of this work was reviewed by the Manager and theCouncil. John Mayo:explained that there has already been a strip appraisal and the UAB ruling is that the property purchased for UAB • • projects has to be handled by three different agencies. It has been appraised by Ralph Korn, will be purchased through George Lemon and payment will be made by the City of Yakima Finance Department. After due discussion, it was MOVED by Brown, seconded by Robinson that Resolution No: D -1416 engaging George Lemon for.said right of way acquisition, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call. • Mayor Larson then introduced Mr. Kanagi Tsuda, Hyogo Prefecture at Kobe, Mikage;Senoir High School and his Miss Bukko Honko, a foreign exchange student at West Valley High School. Mr. Tsuda was made an honorary citizen of the.City of Yakima., Mr. . Heath, who is the President of the Principals of the secondary schools on Washington, was also present.and explained that Mr. Tsuda is his contemporary in Kobe, Hyogo. :City Manager McMicken discussed the matter of a memo from William Hutsinpillar, Park Director, regarding a letter that the City received from the Greater Yakima Chamber of • Commerce which "requests Yakima County and the'City of Yakima join together to propose an acquisition and development program to the State of Washington for the creation of a Regional Freeway Park." Mr. McMicken indicated that Mr. Hutsinpillar does feel that the City should not have the responsibility of providing a Regional Park facility in Yakima, • and that further study should be made before any action is taken the Council. After due discussion, it was MOVED by Keith, seconded by McNeice that a letter stating this policy, should be prepared and sent to the proper State agency: carried, Brown, Keith, Lambert, . Larson, Lust, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported on the matter of the new schedules for Airwest,,,sta;ting that there will be one additional' flight beginning December 1st:-- Mr..James Eakin,•Airport Manager, being present reported that he had received notification thatstarting in Novem- . ber there would be a reduction of three flights and that he had met with the Airwest Officials and that one of these flights was put°baek.,.into the schedule. He, also stated that at present there are three flights to Seattle and there will be change except that the flight leaving for Seattle at 5:40 P.M. will be changed to 7:35 P.M. He reported that there are five flights to Portland and that there will be three more Mexican flights added as of December 5th. This was given to the Council for information and no formal action was taken. City Manager McMicken referred the matter of a proposed certification bill for Water and Pollution control plant operators, to Frank Stein, Public Utilities Director. Mr. Stein recommended that a certified'operator should be in charge. Councilman Lambert stated that she felt that the proposed bill which is to be submitted to the 1971 Legislature should be • submitted for Counci /members study. . Councilman Robinson went on record as being against professionalizing this occupation. It.was informally delayed so that further study could be made. • • • 646 • • NOVEMBER 24, 1969 • City Manager McMicken referring to his report.No.67, on Firemen's Pension Law and the. inclusion of additional personnel, stated that Lt. Bill Horst, President of Fire Fighter's • Association Local 469 and Fir Pension Board have received copies of the included City. Attorney's'opinion. Discussion indicated that the City Attorney has ruled that the Alarm • • operators & Signalmen and.Department.Secretary'can not be covered by the 1969 Law. Lt. Ken Groth asked if an opinion can be obtained from the Attorney.General regarding trans- rans . ferring Alarm Operators to Firemen's Relief and Pension from Statewide City Employees Retirement System. City Attorney Andrews explained that he could not obtain this opinion. • • Councilman Robinson stated that if an opinion is desirable the Firemen's Relief and .Pension Board has the authority to write and request such an opinion, but added that the Attorney General's opinion has no more affect than the City Attorney's or any other lawyer. No formal action was taken. • It was MOVED by Robinson, seconded by Lambert that Resolution. No. D -1417 granting a revocable .permit. to Buchanan Transfer and Storage to occupy a public right of way, be passed as read: carried, Brown, Keith, Lambert, Larson, Lust, McNeice Robinson voting -aye on roll call. . • RESOLUTION NO. D- 141 -7, A RESOLUTION granting :.a -revocable permit to Buchanan Transfer & Storage to occupy'a right of way. . Therefore, no formal action was. taken to change this district. Mrs. Marguerite Hackett was present and protesting the amount assessed against her property, She was out of town at the time of the hearing on October 20. . • City Manager McMicken requesting authorization for Larry Carroll and Bill Thomas to travel out -of- state, to retreive'prisoners from_Medford, Oregon and for John Currier and Charles Foster to attend a Mechanics meeting in Tigard, Oregon which previously was scheduled for September, it was MOVED by Keith, seconded by Lust that said travel be allowed: carried, Brown, Keith, Lambert, Larson, Lust,aMcNeice and Robinson voting aye by voice vote. . • The final estimate on the Sewer Sealing Project which has been done by Salem Sand & Gravel Company, subsidiary Gelco Company having been submitted and Utilities Director, Frank Stein requesting that said payment of $9,437.93 be paid to said Contractor, it was MOVED by Keith, seconded by McNeice that the work be accepted and that said payment ' of $9,437.93 be made: carried, Brown, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye by voice vote. • City Manager McMicken submitted an Ordinance relating to Parks & Recreation and the creation of Department of Parks & Recreation requesting that it be studied and that it will be on the December 1, 1969, agenda. . • City Manager McMicken reported that on November 3; 1969, Mrs. Lottie Bell-of 804 North . 3rd Street, had complained about there being no traffic signals at 6th Street and Nob Hill Boulevard. There is an old shed in this area that is located ona curve in the..road which it extremely difficult.to see any oncoming traffic. John Mayo, Public Works • Director, reported that a.count of traffic will be taken and a report will be made. Councilmen Blown and Robinson asking to be excused. from the next Council meeting on • December, 1, 1969, it was MOVED by McNeice, seconded by Lust that they be excused: carried., • Keith, Lambert, Larson, Lust and McNeice voting aye by voice vote. Brown and Robinson • not voting. ,. • 647 . • . NOVEMBER 24, 1969 • • . Councilman Keith requested that another alternate be designated to substitute for him on the Y.V.C.C.A. Board. He explained that in the last few months he had found a conflict of.meetngs, and 4uggested that Councilman Lust serve out Councilman's Keith appointment. After due discussion, it was MOVED by Keith, seconded by Robinson that Councilman be appointed to substitute for Councilman Keith on the Y.V.C.C.A. Board: carried, Brown, Keith, Lambert, Lar.s,on,McNeice and Robinson voting aye by voice vote. -Lust not voting.
