Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call.' It was MOVED by Robinson, seconded by McNeice that Councilman Keith be excused from this meeting: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. • . The Invocation was given by City Manager McMicken. • The minutes of the regular meeting of November 10, 1969, having been duly accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Since the Council was about to adjourn sine die, Councilman Kurbitz asked permission to say a few words regarding his term on the City Council. Mr..Kurbitz expressed his grati- fication forthe opportunity of working in City government and expressed to each Council member. :and others his appreciation for work•done. He stated that. City government is not a business and probably will never be one because there is no profit making motive but that City government is an art. • Mayor Larson .presenting'a Resolution of appreciation and commendation for the services performed by Alberct_.R. Kurbitz during his tenure as a member of the Yakima City Council, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1415 be passed as • read: carried,. Brown, Lambert, Larson,' McNeice and Robinson voting aye by voice vote.. Keith absent. . • RESOLUTION NO. D -1415, A RESOLUTION of appreciation and commendation for the services - performed by Albert B. James Lust and Walter J. Robinson, Jr., (Lambert and Robinson incum- bents) having been duly elected to the office of Councilmen for four year terms on November 4, 1969, Municipal Judge, George H. Mullins administered, the Oathof Office to these Councilmen. . ADJOURNED MEETING, MONDAY, NOVEMBER 17, 1969; 8:10 P.M. • The new City Council' was again convened by Councilman Larson on this date. Councilmen Brown, Lambert, Lust, McNeice and Robinson present on roll call. Councilman Keith absent - on roll call. (Duly excused earlier) . • The next order of business was the election'of a Mayor and Assistant Mayor forthe next. bienium. Councilman Brown submitted in nomination the name of John M. Larson for Mayor. and Walter J. Robinson; Jr., for Assistant Mayor and Councilman McNeice.seconded this nomination. There being no other nominations.made after due call,'it was MOVED by Brown, seconded by McNeice that the nomination for these two offices be closed: carried, Brown. Lambert, Lust and McNeice voting aye by voice vote. Larson and Robinson not,voting.' Keith absent. Councilman Larson called for the vote on the nomination_of Robinson for Assistant Mayor and the vote carried: Brown, Lambert, Larson, Lust and McNeice voting aye by voice vote. Robinson not voting.. Keith absent. Assistant Mayor Robinson then acted as chairman and called for vote on the nomination of Councilman Larson for Mayor and the vote carried: Brown,-Lambert, Lust, McNeice and Robinson voting aye by•voice vote. Larson not voting. Keith absent. This being the time fixed for the Hearing on Resolution of Intention No. D- 1403, to improve property by the construction of a water main, and there being a protest in writing and those present wishing to be heard for and against said project,. City Manager McMicken requested that Public Work Director John Mayo explain procedures and construction of this L.I.D. Mr. Mayo indicated that this project is outside the City and the property owners will be assessed for a 6" line and that there willbe no fire hydrants included in this L.I.D. because the area is outside the City limits. The fittings will be available..when and if the fire hydrants are to be installed. If there were fire hydrants installed at this time, there would be a monthly charge to each person. Mr. Chauncey W. McDonald, 3410 Fruitvale Boulevard, Otto L. Lagervall, 724'North 34th Avenue, Mr. Daniel Pugsley, • 804 North 34th Avenue, Mrs. R. A. Mitchell, 913 Powerhouse'Road, Mr. Frank Zites, 805 North 34th Avenue were present asking questions regarding the formation of this L.I.D. and its completion. A formal protest was filed in writing by Mr. &.Mrs. R. A. Mitchell statinc that the improvement is too high since 5 acres of the 72 acre tract is fruit trees and they do not plan to subdivide. Also, Mr. Frank Zites, 805 North.34th Avenue, protested the • . 644 NOVEMBER 17, 1969 • • • • ` of.the project for his property and for the whole district. Mr. Otto L. Lagervall's property is divided such that piece of it, 'on which there. has never been any, water and never be any use for water, is charged individually. This particular piece • of property is being used for automobile traffic to turn around and for neighborhood children, to use as a walk way to school. It was suggested that Mr. Lagervall and Mr. Pugsley make an appointment with the Engineer's Office so that different could be worked out for assessing their property. Possibly this area could be dedicated to the City for an access way. Mr. Pugsley indicated he would consent to letting this parcel of land become a public'access way,, and in fact, thought•that it had already.been • dedicated to the City at some previous time Mr. Mayo in conclusion, explained that the people still have 30.days,in which to.file their protests. All persons having been heard both for and against the formation of L.I.D., it was MOVED by Brown, .seconded by McNeice that Ordinance No 1181 creating said district be passed as,,read: carried, Brown, Lambert, Larson, Lust, McNeice and.Robinson voting aye by voice vote. ORDINANCE -NO. 1181, AN ORDINANCE providing for the improvement of certain•property by the • construction of water mains, valves. and other appurtenances; establishing a Local Improve- . ment District, providing for the method of payment thereof, and creating a special fund. -It' was MOVED. by Lambert, seconded by Robinson that Ordinance No. 1182 fixing the time . of delinquency. and providing for the, issuance of bonds for the payment of the unpaid por- • tion,:of.L.I.D. NO 971, Richey Road and Others Paving District, be 'passed as read: carried, Brown;`` Lambert, `Larson, Lust, McNeice and Robinson voting aye on 'roll call. Keith absent • on roll call. . • ORDINANCE -NO. 1182, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 971, and providing for the issuance of bonds with coupons,attached for the payment of the unpaid portion•thereof. • . A letter was received on this date by the Clerk of the Council, from Mr. George H. Gannon, a copy of which was sent to the Yakima Herald - Republic. The subject of this letter was the past election and Cable Television. This letter was read by the City Clerk, City Manager McMicken referred the matter of the State Department of Public Assistance no longer paying medical bills for prisoners to Acting Chief LaRue_. Acting•Chief LaRue stated that notification wasreceived from the State Department of Public Assistance and • that the effective date was November 3, 1969, with no previous warning. He. stated that all prisoners needing medical attention or hospitalization will have.to have their bills _ paid for by the City:and that this cost could run into thousands of dollars.. Acting Chief LaRue stated that these' payments will be required only for those prisoners who have no other way to make payments. A compilation' of facts and figures showing experience for . the past ten months was presented to the Council. Councilman Lambert noticed that many of the names on the list are those of Indians. She wondered if possibly the Indian Tribal . Council could take care of these bills.• Acting Chief LaRue stated that this was being looked into. No formal action was taken at this time. - • • City Manager McMicken referring - to the City - Engineer's report on the completion of L.I.D. No. 975, St. & Decoto Property Water District, it was MOVED by Robinson, seconded by . Brown that December 15, 1969, be fixed as the time of hearing -on the assessment roll for said project: carried, Brown, Lambert, Larson,.Lust, McNeice and Robinson voting aye by , voice vote. 'Keith absent. Mayor Larson concluded the meeting by reading a Proclamation proclaiming the week of . November 17, 1969 as Physical Fitness Week and urged the citizens of Yakima to give . • thought to personal and public health. .
